Are you subjected to income tax?

im a sole proprietor can I pay my tax under personal tax ? how do u guys calculate p.a. income and deduct everthings and rebate to pay by yourself with no hire accountant do for u

For personal without business income will fill in BE form. With business income then must use B form.

Just spend sometime goto near by LHDN ask for help.
They will able to offer some basic assistance.

If they ask u seek for professional assistance, then u gonna study business tax yourself or hope some Tax ppl can offer u free service.

I believe yours business is not high volume and complex. The fees should not be high.

bro, tax and accounting service not judge by the business space and type of business. It will depend how complex, turnover and the volume of the business. Even a making loss business may more expensive the profitable.

Some may charge RM500 and some maybe RM1000 just for tax submission. If no proper P/L recording, then they will need to do more job which mean higher cost.

If it's classified as BIK in EA form, then it's not taxable.

That's taxable income cos it's a fixed amount based on days "on standby"

Hi All, got something to ask for suggestion, example , i set up a sole partnership company, declare 20% tax per year company tax, n i write payslip to myself(do i still need declare my individual tax?) or company itself be enough

Company sales 100k

Your salary from another permanent job - 36k

When you declare tax with sole-prop, this is the amount to declare : 50k + (36k + 20k)

I got the stupid question here.

I recently get the penalty from LHDM for late submission. They send me the assessment forms and ask me to paid in 4 separate installments otherwise court action will be taken.

If I choice to ignore it, then what will happen? They won't take action for small amount right?

I didn't paid my car saman also nothing to me. tongue.gif

Maybe LHDM is different. Please share your view.

Why take the risk? If someone bad mood then you get charged 100% more for tax, worth it?

Last time that happened to me (non-declaration because not working a few years while studying) I just went to their office to rayu and all settled without paying anything. Rather than ignore...

1) The amount comes up to around RM800.00. Is the pain in the ass. I didn’t commit any crime, why penalise me so much to this crony’s government?

2) I also read it somewhere in the forum that someone go there to rayu his penalty but end up paying additional taxes because they checked back his/ her previous years records and found out additional discrepancies in his/her previous year tax return. That’s why I think twice first before going to LHDM.

3) Are you sure they can charge 100% penalty to us? I tot they have the guideline to follow. Cannot simply hentam one right?

No comment on the politics, but submitting late still has penalty. Its considered a form of tax evasion. Its not a crime, that's why no jail time.

Are there issues with the earlier years for you? If so then better just to pay up. Doesn't mean you won't be audited later though.

i'm still checking to see if a Microsoft Surface Pro qualifies as an Ultrabook or tablet since it has about the same computing power as an Ultrabook, though the Microsoft Surface RT is confirmed as tablet.

Hi all sifus,
Need some advice on rental income of property:
1. A condominium is registered under joint names of person A & person B;
2. The agent fees for introducing tenant can be deducted as expenses from the annual rental income, right?
3. Monthly maintenance fees paid to the JMB cannot be deducted from annual rental income, right?
4. Furniture + electrical items to furnished the condominium can be deducted from annual rental income, right?
5. Cukai pintu + Cukai tanah can be deducted from annual rental income, right?
6. Repair of hardware in the condominium during the rental tenure can be deducted from annual rental income, right?
7. If tenant run away and owners suffer losses such as unpaid bills, this can be deducted from annual rental income, right?
8. If by tenant request, owner did some renovation to upgrade the living conditions of the condominium such as replace old tiles with new tiles, replace old fans with new fans, these can be deducted from annual rental income, right?
9. Termite treatment during the rental period can be deducted from annual rental income, right?
10. For a landed property, if tenant request and owner has proceeded to install awning at car pouch during rental period, this can be deducted from rental income, right?
11. For a landed property (but not G&G), security fees paid by owner to the security services organized by the neighborhood, can be deducted from rental income, right?

The biggest grouse that a property owner has come tax submission season will be the amount of taxes that he has to pay on his property rental income. He will then naturally start to rummage through all the property expenses he had incurred to determine what is tax-deductible and what is not.

In situations of doubt, I have known of property owners turning to other property owners asking, “Do you claim such-and-such expenses in your income tax return?“ Well, my sincere hope is that the person he is asking has a good understanding of the tax laws, otherwise it will be a case of the blind leading the blind and both will end up having to face unnecessary tax penalties when it comes to a tax audit.

This article hopes to shed some light on how to determine the tax-deductibility of those expenses.

I have often been asked if there is list of standard expenses that a taxpayer can deduct against the rental income from letting of his investment properties. Quite honestly, there is no ‘‘standard‘ list of allowable tax deductions as the expenses that a taxpayer incurs may be unique to his/her own situation.

Therefore, the taxpayer will have to fall back on the letter of the law to determine if an expense is tax-deductible against rental income. Essentially, the law states that an expense wholly and exclusively incurred in the production of income under subsection 33(1) of the Income Tax Act (ITA) 1967 and which is not prohibited under subsection 39(1) of the ITA, is allowed as a deduction from rental income. What this means in laymen‘s terms is, any expenses that you incur for the year to generate the rental income would generally be tax-deductible. This also means that no private or personal expenses are allowable as a deduction.

Common deductible expenses

Aside from the ‘standard‘ list of tax-deductible expenses that a lot of property owners is asking for, what I can provide you here is a list of common expenses that generally may be claimed as a deduction against rental income:

• Advertising for tenants
• Assessment
• Insurance (e.g. fire, burglary)
• Interest on loan(s) to finance the purchase of the property being rented out
• Legal expenses (renewal of tenancy agreement, recovery of rental arrears)
• Maintenance/service charges
• Pest control
• Property agent fees/commission
• Quit rent
• Rental collection fee
• Repairs and maintenance
• Replacement of rental ass
ets

It is important to note that the expenses are deductible in the year they were incurred, even though you have not made any payment for them during the year.

Having said that, do ensure that your obligations as a landlord towards the expenses which are to be borne by you, are clearly spelt out in the tenancy agreement to avoid any disputes by the Inland Revenue Board (IRB) against your claims for the said expenses.

Non-allowable expenses

Having touched on the tax-deductible expenses, it is also important to know what expenses are not allowable. Typically, initial expenses are not allowed to be deducted from income of letting of real property assessed under paragraph 4(a) or paragraph 4(d) of the ITA since those expenses are incurred to create a source of rental income and not incurred in the production of rental income. Examples of such expenses include:

• Costs of obtaining the first tenant for the property, such as:
° Advertisement;
° Introducer’s commission;
° Legal fees incurred for the preparation of tenancy agreement;
• Other expenses incurred prior to the property being rented out; or
• Renovation and improvement costs.


In the case of expenses incurred prior to the property being rented out, particularly relating to annual property expenses such as quit rent, assessment or insurance costs, then the proportion of the expenses in respect of the period before the property is rented out is not deductible and have to be adjusted accordingly.

However, a distinction (although in many situations, a difficult one) has to be drawn between what expense is deemed to be ‘repairs and maintenance‘ (which is tax-deductible) and what is ‘renovation or improvement‘ (which is NOT tax-deductible). Typically, an expense is deemed to be ’repairs and maintenance‘ if it is incurred on ordinary repair to maintain or restore the real property in its existing state. It will not materially add to the property‘s value nor substantially prolong its useful life, but merely to keep it in good and efficient operating condition.

In the case of ‘renovation or improvement‘, the reverse would then apply, i.e. the expense incurred would:
• materially add to the property’s value;
• substantially prolong its useful life;
• adapt the property to a new or different use; or
• enhance the property’s income-generating ability.

What happens during the period when the property is not rented out?

As explained above, expenses incurred prior to the property being first rented out, are not allowable in calculating the adjusted income from the letting of that property. However, if the property which was previously rented out is left temporarily unoccupied while you are looking for the next tenant, the expenses incurred during the period of non-occupancy will still qualify for deduction. This is on the condition that the property is being consistently kept in a tenantable state and is ready to be let out at any time.

How long then, can a property be ‘temporarily‘ left vacant and yet the property expenses qualify for a tax deduction?

The IRB’s Public Ruling 4/2011 further explains under what circumstances where the expenses incurred for the period the property is temporarily not rented out will be allowable. The circumstances are:
• repair or renovation of the building;
• absence of tenants for a period of two years after termination of tenancy;
• legal injunction or other official sanction; or
• other circumstances beyond the control of the person who lets out the real property.

Under the above circumstances, the expenses for the period the property is not let out are allowable, provided that the property is maintained in good condition and is ready to be let out.
Of course, having explained the concept of tax-deductibility of expenses against rental income, one must never forget or ignore the underlying basis for claiming for a tax deduction, i.e. the need to keep proper records and documentation relating to the claim for those expenses. When it comes to a tax audit, the IRB‘s basis of allowing you a tax deduction for the expenses claimed would all be about the availability of evidence.

Then you only fill 90K in BE form?
A few of my friend have do this, deduct 10K from EA as part of the expenses related to work(eg petrol/toll from home to office). and they also check and confirm with income tax officer on this matter, they no problem.

Any ideas?

Of course everyone will deduct, but there's specific categories and comes with proof. Petrol/toll can deduct if its allowances given by your company.

To my understanding no.

Most of us spend our own money to come to work, so if this is allowed sure we all want to claim. But cannot simply deduct, everything must be justified and according to various regulations.

2 years ago, the criteria to judge whether a tablet can claim under the computer relief is whether the tablet can make phone calls. If it can then it is a phone, if it can't then it is a computer.

iPad cannot make phone calls therefore it definitely qualified for computer relief. For now I am not sure whether this rule still applies

Hi everyone, I've been researching this thing for income tax but still am unable to fully understand this. I started working a few years earlier and has an EA form provided by the company, so everything was so easy declaring my income tax online.

But now, I started a small business last year and seriously don't know where to start regarding my income tax. Could somebody explain to me the basics?

My situation is like this, my company has income and I get salary from it every month. Should I declare for company only or do I declare both for personal and company?

so i still need to declare even if i didn't work full year?

at year 2012, i work from march to december, obviously my annual income did not reach the point where i need to pay income tax, but still need to declare?

at e-filing website it still says TAHUN TAKSIRAN 2012 for e-BE form, means i still got chance to declare for year 2012? i thought it should be over deadline already since its now year 2014

and i still cannot declare income tax for year 2013? since there is no e-BE form for year 2013

I am currently doing some consultation work and receive income from a Singapore company (I am based in Malaysia).

My question is, can I claim the Capital Allowance for my "business income" although I did not set up a company?

What are others deductible expenses? e.g. rental, petrol, internet, utilities, car insurance & road tax, car repair?

If husband/wife file income tax separately.. i believe husband can get a tax relief for wife (RM3K).

As for the wife, when she files her own income tax, can she also get the Rm3k tax relief for having a husband?

If separately there's no category for tax relief from having spouse. It used to be (think still is) RM8k, but only if file jointly.

You got it all wrong lah doh.gif doh.gif If it works like what you said, you get double tax relief.

If you assess separately, you don't get Spouse Tax Relief lah... assume you are single (though married) in the eyes of IRB. Only when you do COMIBINED ASSESSMENT, you can claim Spouse tax relief.

Hi,

I would like to ask anybody face this problem before?
I never register for taxation before. Then I plan to declare this year for previous year 1, then today I want to register but I check it said I already got account. Got any help here?

I think what it means is that if your business is a share trading business whereby the proceeds are the main source of income to your business, then proceeds from sale of shares will be subject to income tax. I don't think so. Unless you main stream of your regular daily income are from share trading or you are the full time share traders.

BIK is NOT the same as allowance. Monthly bills paid by employer is considered BIK. Allowances are monies (cash) paid to you, it can be used for any reason-pay bills, buy char koay teow etc . To emphasis again Telefon/transport allowances are forms of cash allowances

Fixed allowance in the form of cash should be considered as part of income and hence, it's taxable.

Fixed allowance such as OT allowance, shift allowance, off site allowance and etc.

These few days the Borang TP1 has been in limelight... Ensure you get your HR to process the TP1 as soon as possible, in order not to "overpay" your Monthly Tax Deduction (MTD/PCB)

1/3 is the norm i guess, this 1 u dun have to prove the ration. if you wanna apportion 100% to business use only, then u have to prove it.

I have a question.. last year i did my firat income tax submission online and then they calculated extra and they pay me back. I received the letter and money in my account few days later.

Today i received a letter stating that i have to pay 200+ for the tax of 2012. Is this normal?

EA form came di, just logged in to e-filing.

My EA form jumlah potongan doesn't match (is lower than) the amount which is shown on e-filing (which is calculated by LHDN). Why the discrepency? I don't have my individual payslips with me to doublecheck, but will do so Monday.

I think nobody here can answer this question for you.

You need to bring your letter to the LDHN office and request their explanation.

Previously I kena that also. They explained that they have checked back my tax submission and found some mistakes which they want to rectify.

Hi guys.. When filing income tax, in the dividend section (HK-3), there's a column to enter warrant or voucher no.

However, my warrant no is longer than I could enter. For example, warrant no is something like this DH1300001234567 (15 charactors & digits), but in e-filing, the maximum it can accept is 14 charactors/digits..

What should I do?

May I know what is acceptable for the 5k parent's medical expenses?

Second, the "3 tahun berturut-turut" should be referring to you have been claiming for this relieves since YA2010. You may need your loan statement and BE form from 2010.

Correct me if I'm wrong.

If you have other source of income beside full time employment, house rental, dividend, royalties and etc. and your business is registered sole proprietary, you should file for eB.

but hor... when i rethink of it, it somehow sounds a bit weird..
bought house on 2010...

first claim : 2011 (for 2010 punya tax)
2nd claim : 2012 (for 2011 punya tax)
3rd claim : 2013 (for 2012 punya tax)

if i really claimed on 2011, means it has been already 3rd times wor...
4th claim : 2014 (for 2013 punya tax) ? ??

One of the things that I need to provide is NO. PENDAFTARAN (SYARIKAT)* or REGISTRATION NO.(COMPANY)*.

Actually, I think no penalty. But you may have overpaid your taxes already (BN loves you!!). Usually ppl paying PCB and they declare cause they want to claim back over paid taxes, got all these deductions here and there.

If you still have a receipt of your exchange rate back then, use it. Otherwise, pluck a figure from Forex Historical charts + 30% on the rate. (this is for estimation)

Why add 30% ? Banks usually profit from here, so that's their published selling price.

If credit card, its easy to see how much its in RM.

Guys, hope someone could shed some light. Do I need to fill in the "Pendapatan tahun kebelakang yang belum dilaporkan" as I have arrears payment on my EA, its a non fix standby allowance.

Can I just leave it blank, PCB and KWSP is deducted from that amount.

LHDN can see there's extra PCB debited from your incometax account, but it's not shown in your e-filing (because you choose not to declare the arrears income & arrears PCB paid). So, there's a mismatch there between what LHDN see vs what you've file in e-filing.

If you happen to get audited, definitely they'll ask you to come to LHDN, either to punish you, or to ask you to fix your income tax filing ..

In each year, I will fill in the e form around Apr and submit in the last week of April. It is bcoz one year my colleague get audited when he submit early. When I submit around last week, there is many form around and they dun care small fish like me anymore. I know it sound silly, but I lazy to get audited.

It's supposed to be based on the exact price you made your exchange. But if you don't have one, the best bet is from the charts. Average is for the entire year, what if you made the change at a higher price than the average ? You'd be loosing out on the deductions.

I wan to ask i bought HLA Wealth Builder, can I claim the 3000 tax relief as deferred annuity?

You can download the form from LHDN website and pass it to your HR dept. Please check with your HR dept.

As I know, it not only limited to PRS, I heard my colleague got offer for GE (great eastern) regarding something in the same category of PRS, may be it will fall under deferred annuity, as we know, GE is not the PRS provider. So, u may call LHDN for clarification.

@birdman13200, you're correct it's either deferred annuity or PRS.

Better check with the wealth management provider for details/eligibility. You need to keep the annual statement for claim in case of audit.

They don't verify now, but later on you may randomly kena audited, then they'll just ask you to provide proof.

Meaning there's a chance if you never get audited that you can get away with lying.

But check the rules on what happens if you're caught eh, not worth it.

Once you complete with digital signature, you CANNOT amend it. You need to go to your nearest LHDN to make amends.

Hi sifu sifus , this year i just start doing some small business making around fix income of around 200k-250k . Its a enterprise business so it would be crazy if kena 50-60k income tax . Any advice?

Another problem is my ex company let me handle a lot of cash , they bank in money to me then i take the cash and pay out to indon worker and bangladesh workers . More than rm 120k monthly in out my personal account and i'm not profiting from it . Whats the worse case scenario for my situation of this? And pls edvice me what to do because i need to handle those cash for my worker as im their manager

hi Sifu I am very unfortunately kena audited by income tax. Anyone got the same experience ? I am a small business sole proprietor. my problem is I actually never do book keeping and just throw all my receipt and invoice to my accountant, I also seldom issue receipt to my client. for my income I just agak agak only . so now the income tax ppl call me and tell me they will send a letter to me to ask for certain document, Now I also don know how. I only 2 years plus into business

any help is appreciated. thanks

you put company B (latest employment as at 31/12/2013), and also all your income, including from company A.

this is income tax, which is to tax all your income for the year.

does this means the cheque is void if its not bank-in within 3 mths from the date of cheque issue?
which department i need to find for re-issue of the cheque?

I just receivd my "borang J" plus fines for not filing my tax on time. As Im studying part time, hopefully can reduce the amount of tax payable by making an appeal.

I just declared my tax for year 2009-2012 using manual form this year. Since my mistake for assuming PCB is the final tax to be paid. Then the LHDN will send u a Borang J which states the amount of tax payable plus the fines for year 2009-2012. Borang J is personal just like our EA form man.

If u noticed u can't do e-filing for year 2012 now. Thats why the need for manual form or Borang BE. The calculation for the tax will be done by an officer. Its really tedious task calculating it. So my advise is better do your e-filing on time.

For the past few years, I have been entitled to get back excess tax paid but not this year as I have to top-up. My tax relief/rebates have been consistent, only basic things like books/epf.

Does it mean I have surpassed certain figure of annual income? Is there anyone knows what is the exact figure? What is the figure then?

Or could be I have keyed-in wrongly? Highly doubt that.

Do u mean hard copy of tax form?? If yes, I think most of us is using e-filling now.

my friend quit job on june 2013 and after that she become freelance and estimate earning 3k per month(no do any bookkeeping regarding receipt and no invoice to client as well),and she didn't register company also,so now she get the ex company EA form until June 2013 around 15k ,so she need to put in penggajian 15k right? and how about the freelance income 3k per month(Around 18k) ,put at section Apa-apa perolehan atau keuntungan lain right? as i said she didn't register company and not keep any receipt and invoice.so if put the freelance income at " Apa-apa perolehan atau keuntungan lain " when LHDN audit time how?

i suggest her no need to declare the extra income since no receipt and invoice at all tongue.gif but she plan to buy house future and worry hard to get loan,so she plan to let LHDN tax some,so what the best option for her?

And coming day any advise to her either register enterprise or just keep it same free and easy like current. biggrin.gif

FOr this section, I should file under which category?

Got a question regarding section E (Caruman yang wajib dibayar oleh pekerja kepada kumpulan wang pencen atau simpanan yagn diluluskan) of the form.

It is the total amount of money u hv paid to KWSP, thru monthly deduction.
This amount is under max 6k tax relief for "life insurance + KWSP".

It's subjective. It's rather the irregularity in the claim that we discovered that may cause you might be audited.

Actually, I have a question for any unofficial tax advisers here and hope you can help shed a light.

My wife's EA form stated that her company trip's cost for food and tourist passes (excluding air fare and accommodation) is under the taxable item. Is this true? Is that legal?

My company trip's all costs are not reflected on mine, but it seems weird that her's is. We are working in different companies.

Q1: As long as your S&P date and other criteria are met, I don't think the refinancing will affect since you still need to service the loan inclusive of the interest.

Q2: For pregnancy, I don't think this is eligible. Medical expenses claim are only eligible for:

A. Parents (rawatan perubatan, keperluan khas dan penjaga)
B. Supporting aid/apparatus for yourself, spouse, children and parents
C. Chronic sickness for yourself, spouse and children
D. Full body medical check-up for yourself, spouse and children

A investment linked life insurance policy or product is eligible for claim and usually the certain percentage of the premium is allotted for life insurance portion, medical portion and etc. You need read the annual statement from your insurance company for correct relief claim in the filing.

Badminton is a sport activity is an approved sport under list from Ministry of Sports

Equipment: Racket
Consumable: Shuttlecock

Both are claimable.

The tax relief of up to a maximum of RM5,000 is in respect of medical expenses expended by taxpayer for his parents. In your case, you are not entitled to claim the tax relief for your mother-in-law.

If your wife is working and/or earning an income, she would be entitled to claim the medical expenses for her mother provided that the claim is evidenced by a medical practitioner’s receipt.

Yes, because income tax is based on annual income.. in your case, your annual income = 180 days salary..
So, you still have to declare and file your income tax..

Yes, just logon and submit 0 income. If a few years you never submit they'll investigate you, then you have to go over to their office to rayu (happened to me while doing post-grad studies), waste time only.

No point to claim rebate as taxable income won't ever go lower than 0 (so you won't get free money).

Nope, not the first time. Last year, it was 14 days on the dot. But this year I'm going to get like 3 times more than previous year. My new company deducted more than Rm2k during my first month on the job. So I want to make sure I get that excess amount back without any interrogation.

Just submitted my income tax declaration. Hope pan get refund by end of this month...

Somehow, my life insurance/kwsp i put it as max while my insurance i put rm2400 although it is medical + investment policy... hope they dont queries me..

what u mean refundable?

The tax rebate only applied to ur tax amount, let say ur calculate tax amount is less than RM400, ur tax after rebate is RM0, not refund from the tax rebate.

For example:
Tax amount need to pay=RM320.
Tax rebate (with taxable income less than 35k)=RM400
Ur final tax=RM0 (not -RM80, which u hv refund)

sorry to say, the forumer is incorrect. it is taxable even if its not a cash. imagine Company giving out a house/car instead of cash bonus, taxable ? the answer is yes. Income tax is NOT based on cash only, else it will be called Cash Received Tax, not Income Tax. sigh, tired with half cooked answers.

for your case, i suppose you already done your Borang E. if its included in Borang E, then fill it in ur Company account, if not better do not disclose these non-cash incentive and you urself have to bear the tax instead of transferring to the employee. but theres loop holes of course. but end of the day, its either if the Company can deduct, meaning the staff have to disclose and kena tax, if the Company cannot deduct then the staff do not have to kena (that is the norm of income tax basically).

Income tax is NOT based on cash only, else it will be called Cash Received Tax, not Income Tax. sigh, tired with half cooked answers.

for your case, i suppose you already done your Borang E. if its included in Borang E, then fill it in ur Company account, if not better do not disclose these non-cash incentive and you urself have to bear the tax instead of transferring to the employee. but theres loop holes of course. but end of the day, its either if the Company can deduct, meaning the staff have to disclose and kena tax, if the Company cannot deduct then the staff do not have to kena (that is the norm of income tax basically).

as an employer, u will need to prepare Borang E and EA for your staff. and the deal date is 31 march if im not mistaken.

as for Employer it will be inside your tax computation, may it be staff incentive, bonus, gratuity whatever you name it.

as for employee side, it will falls under Paragraph 13(1)(a) which is same category as salary, wages, leave pay, bonus, gratuity. because your Laptop is consider convertible into money, meaning your staff can sell that laptop to get the money.

by the way, if i were you. i would rather buy that laptop as company asset, and then give it to ur staff to for office use (meaning when he resign, he has to return the laptop to you). that way, u save tax and your staff would not be taxed. win win situation.

U can save up to 25% tax with high allowance and low salary.
But, your boss wil pay bonus by calculationg based on monthly salary, you will get same amount of month bonus.
But, total amount of bonus in ringgit is low cos ur slary is low.
Wil it best to save tax but get lower bonus?

It is not surprise me, my company hv that few year ago, the phone allowance and transport allowance is consider as a income to me, I check with HR before, they say it is follow LHDN declaration.

for those who likes to juggler around with allowance, it is taxable. however you can deduct those allowances with expenses, example petrol allowance month RM1k and u have your petrol receipt of 1.5k... meaning u can deduct all the rm1k out, but not tat rm500 from your income. so hope this will give a bit of light for you guys who do not understand why allowance is listed in ur EA form.

I have bought an insurance policy by Prudential (life + medical card) last year 2013 and a bit confused on which column should I key into. I have also invested in PruCash and as claimed by my agent it is also deductible.

oh what i mean is company pay me 10+% on epf, but if i receive that commission, my tax bracket is 20+% already. so if they willing to pay me separately for that amount, they can save 10+% on epf, i also can save 20%+ on that amount..

Prudential should have itemized your statement already.. It should look something like this.
You can see clearly the first amount is for insurans nyawa & kwsp, and the second amount if for your education & medical insurance..

Every tax relief you have to keep the evidence such as the receipt for 7 years i think.

Everything you claim for relief must have supporting documents and most of them are receipts as the proof of purchase that needs to be kept for min retention period of 7 years.

If say it is for Car allowance, I can deduct the allowance with my car service receipt, right?

Hi All,

I've got a question here, this is my first time doing tax.
I Joined Company A in 2013 (January - August) then joined
Company B in 2013 (September -December).

I got both the EA from Company A and B now, how should I fill tax form ?
Cos when I login to the e-filling , it ONLY shown the total income from Company B, but the PCB deducted during my tenure in Company A is capture in it ??

Also, for company register number , which one I should filled in ? A or B ?

I Joined Company A in 2013 (January - August) then joined
Company B in 2013 (September -December).

I got both the EA from Company A and B now, how should I fill tax form ?
Cos when I login to the e-filling , it ONLY shown the total income from Company B, but the PCB deducted during my tenure in Company A is capture in it ??

Also, for company register number , which one I should filled in ? A or B ?

Put in the Total Income (Company A + Company B) when E-Filling
PCB should show Total for both companies, unless Company A has not been paying PCBC from Jan to Aug
Fill the Company Registration of the current company (I assume Company B)

i have a sole proprietor business. Most of the income is from retail sales overseas (income from overseas sales, and paid to paypal or TT into Malaysia bank account).

I found the excerpt below, but would like to make sure if the income from these sales are non-taxable?

For those who filed for home loan interest payment, please beware that this relief has expired in 2012 and if you have claimed for 3 years consecutively, you're not allowed to claim again even though that field is not grayed off like the PC relief claim.

The only reason is was still that because it is meant for those who has S&P date is at the end of 2010 (31 December 2010) and your bank started to charge your loan interest on January 2011.

If you don't want to believe me, it's solely up to you because my friend is just being audited for this clause. He filed early and has claimed for this rebate since YA2010. Income tax officer is willingly to pardon him but he needs to bring all his proofs back to YA2010 for verify his claim.

My frn self employed with own business between rm3.5k to rm5k income will go into his bank. Not yet deduct car loan and buy stock. Will The tax charge the total income?

Or 3.5k to rm5k - rm500(myvi) - rm1k(stocks) = rm2k to rm3.5k chargable tax?

OK. Need help here. I got letter from LHDN stating I need to pay excess tax for my YA 2012 assessment (submitted last year). I think they deducy my whole KWSP amount.

So how do I appeal? Or did I input the form wrong last time?

I have made the same mistake as this person did:

Basically just filled in the tax relief into the wrong column. I called the officer and planned to visit them soon.
I noticed that I need to prepare a letter explaining the error made... in Malay...

hi all
would like to ask that i've paid extra tax last year which is the CP38 that the LHDN sent me and my employer a letter and request my employer to do so.

I've seen the PCB in the e-BE form but i don find any field for me to put in the CP38 which is what they've taxed me in advance.

can anyone guide me on where should i fill in my CP38?

It's better to resolve early since the due date has not expired. You may need to pay a visit to the nearest LHDN office.

I've read that income I received from oversea (outside Malaysia) is exempted from income tax. Just need to confirm with the sifu here. If I am contracted by an overseas company (Australia) to support APAC region technical support, how do I go about in declaring this? I would submit invoice every month to the company and the company would bank in my income to my Malaysian account. Would this be exempted? Some of my friend said it taxable and some said it is not so I am a little confused now. Thank you.

Is there any discrepancies in my claim resulting in the delay?

I've got mine today, am surprise that I got it this soon as mine involve arrears payment for year 2012. Funny thing is the return is RM236.37 more than what is suppose to return stated in the (Pengesahan penerimaan e-BE)

Yes ... I file my tax on the 19th march so was it fast or not ... Im not so sure as some got it in 14 day. The sum of 5k is because of over deduction (pcb) on the arrears payment for year 2012.

To my knowledge, refund is one thing and call up for audit is another, IRB could refund you and could call u up for audit a few month later. A friend kena before, refunded and 3 month later got a love letter from IRB.

hi David,
unfortunately the EA form they prepared for us didnt list in section G leh.
so i cant manually do a calculation and update myself in BE form, deducting RM6k from my gross salary (Which is stated in EA form)?

Hmmmmm........doesn't look good indeed. So how do I proceed with declaring my income for next year? Can I do PCB myself? Thank you again.

Finally got my return today after days of waiting, refreshing account 3 times a day...19th March submitted - Total 23 days of wait..

I try to log in but cant seems to log in although I keyed in the IC and Password same as E-filling.

What u choose? ßG or OG or C?
What exactly the income tax number u key in?

Do u key in Ref No (Registration No)?

What exact message show to u after u try to login?

It is SG.. I did not key in any Ref number because it is stated is for Registration number for Business

The message, "Wrong identification No and/or wrong password, please enter the correct one !"
