 Petition to Boycott Dell, Due to non-honor of Dell 22 inch monitor

Dear Forumers on Lowyat,

I am sure that most of you have received bad news from Dell, only to find out that they will not honor their sales. I have spoked to one of their managers and they said they will try to give us the option to buy the Dell 23 inch at RM399. Sadly, they did not approve the sales to us. So right now, since Dell Asia Pacific does not look after its customers, its good to raise this issue back to Dell in America. Anyone here want to sign a petition to show dissatisfaction, please put your nickname here plus your Internet Reference Number. Hopefully this time, Dell America would take us seriously on our future purchases. I am sure the recent mess that Dell Asia Pacific made has made us lose our customer loyalty on them. And their massive price-throwing has dwindled our Dell monitor price and also other similarly inched monitors.

I want to join also.
I got email that the Account manager admit is their mistake. But they never do anything to correct their mistake!
Push the responsibility to their poor reseller and end consumer.

I cannot disclose any detail now. Still in the process on negoing a compensation plan with poor reseller. I will had full disclose when i got my conpensation.

For me, I will boycott DELL!

Their code of conduct is for shown. NATO! (No Action, Talk Only)

It is not a mistake, it is advertised as limited units but I think they overshoot the order taking. Means too much order, not enough stock to supply.

Wah lidat oso can? As long as the order is confirmed they MUST honor it. It's their problem to stop taking orders if they dont have stock. This case surely must let USA principal know about it. I think u guys should get together n make a report to the trade ministry too.

They shouldn't overcommit in the first place. Dell greedy, then they had to pay the consequences.

Do U guy notice Dell recently act very bossy and arrogant toward end consumer like us? Like we own DELL something while in reality, we are customer. We take out money and pay because we thing the item worth buying.

I'm pretty sure the domestic trade n consumer affairs ministry will look this up if u all bring it to their attention. It's 1 of the few really efficient Gov departments arround. It's really easy, just go to the office, fill up a form and they will investigate.

Yes..I am actually building up the case. Collecting any communication proof, recorded down event chronicles. Going to complain to tribunal For Consumer Claims.

with so many peoples here, More people more louder voice we can get.

Any1 can make up a banner like what we did on tmnut's stimyx sux connection? I will be glad to put them up. smile.gif

is internet reference number same as quotation number or order number that i know of when i deal with dell? furthermore is internet reference number legally binding?

If their unit is limited, they shouldn't even allow us to proceed with the ordering process. For example a few weeks ago they have this midnight sale for Dell netbook and laptop, limited to first 8 units if i am not mistaken. After all the 8 units have been taken up, the rest of us cannot even place our order. For this case is different, imagine those who place order and TT in the money to DELL already.

the e-mail itself has some fine print

Dell will not be responsible for typographical, pricing or other errors and reserves the right not to process orders based on such errors. Dell reserves the right not to process orders for any other reasonable reason as otherwise determined by Dell.

If consumer had paid and got a confirmation order. That mean in already engage in Contract of Sale. http://en.wikipedia.org/wiki/Contract_of_sale

It Dell didnt honor, they are violating the contract. They might get away with their well protector T&C but keeping a tree and losing a whole Forest or win a Battle but lose a War is not really a wise move. Especially in this highly competive world. Trust and reputation is as important as price.

That is why we need to voice out that Dell this kind of sale practice is not acceptable by us, end consumer

I've TT'ed over the amount since Saturday last week and right now have not yet been refunded. I've emailed the Sales manager and said they are trying to 'expedite' the refund thru my bank. That was on Tuesday.

does the 500 unit is all sold internally to Dells employee or their relatives only?? (is thats why their system is haywire as the LCD is sold "internally")

the thing is, dell CS and their boss treat us all as rubbish. Look at the mess they create, people buy in bulk then resale in Lowyat.net. Easy profiteering at the expense of us naive people. Same goes to the Dell Mini 9 issue. One time is too much already.

If this was in USA, they would have their pants sued off so bad. I am collecting as much people here and emailing them to each bigshot in Dell. Just don't think us Malaysians are easy to please and be ripped off with. It sucks that Dell aims to be number 1 in sales, but their lousy customer service means that, they better think twice then

To be honest, i dont think we can take any action against Dell. There are alot of minor clause in the terms that will protect them.

DELL customer support are so arrogant now. I experience 1 time I called DELL about why my order cant sent through.
The Biatch just say after 8 units no more already. The Biatch didnt even say a single sorry to me. After she say that and let me talking at the other end. She just keep quiet. I asked her why keep quiet. She didnt answer. I hold the line for like 10 mins.

Nothing can be done, but we can least let Michael Dell know that we aren't happy with the way they do business and treat their customers. No wonder even the Americans feel Dell is not so good. I guess HP is a better choice now for customer service

hmmm, but under global law business you can't sue the company because anything they advertised is considered "invitation to treat" no?

unless you already purchased and they didnt wanna reduce the price that would be misrepresentation...i think

past few days ago , i being told by friend's that he recieved email saying got chun promotion. 22 widescreen with webcam built-in ONLY rm399 ...omg ,faster tell my customer coz currently looking for lcd. next day, he said to me stock finished, and the official link to that lcd is missing aswell... i help him to call 1800, the answer , "finished", and promote me "why dont u look for other promotion,also not bad blablabla..." then i hang up that phone call. i feel that this is terrible mistake , someone should responsible for this mess lo , dont u think?

The problem with them is, after the limited units is sold, they didnt take any steps to take down the page and stop accepting orders. Normally, when we know about this offer, it is already too late. Insiders had snapped most of the units and left nothing for the consumer and then selling it at a higher price later on.

My friend bought 2 units for this model.

But, the PIC called him and say the no units available.

As I was told, The internet ordering proccess goes like this:

Drop Order--> Payment via credit card--> auto generate notification of order-->confirmation of oder--> Proccess.

1. Check if your money had been transacted, when you r using your credit card to pay.

2. Check if Dell send out the notification saying your order is accepted and confirmation of order.
Note : Number appears in Auto generate notification and confirmation order might vary.

3. Check if you have the case number before you wanna take any action towards Dell @ US.

I dunno whethr this help or not.

To be honest, there is not much we could do about to Dell. We can at most complain to the newspaper or write to consumer association. Tell me what can we do?

The reason people buy Dell is not because they are cheap or good. People buy them because of their after sales service, at least for me. If they continue to give sub standard service regradless of before or after sales, people will automatically stay away from them. Once their reputation is bad, it is hard to bring the image back up. They is no need to do a big hoo ha to bring down Dell.

What Dell can attract its customers is that the next working day on site repair which not alot of other brands had in common. Even their service had gone down alot but they are still among the other brands. It is just that last time they were above the rest. This is what i see them from my point of view.

Just saw this thread and am now feeling quite unhappy and sympathetic to all the customers here that Dell has disappointed. I'm not involved in this current issue, but as a long-time Dell customer of over 13 years (Over the years have bought at least 5 desktops, 3 laptops, monitors, etc.. - until I lost count what I have bought from Dell). Even recommended and bought Dell computers for my parents, girlfriend, nephew, niece, etc. At one point, I was even a Dell shareholder (invested in Dell shares when I lived in the US).

It appears from the story so far in this thread that their customer service has gone to hell. Once you've accepted payment and processed the order, it means there is a contract between the seller and the buyer, and the seller is obligated by law to provide the product. It wasn't an error in the pricing, so that cannot be used as justification to rescind the order. I was seriously considering ordering 3 more Dell monitors for my own needs, but having seen this thread, I am now seriously reconsidering this, and may decide to go with another brand. I do not wish to support organizations that do this to their customers.

I call Dell since last Thursday until just now (Everyday call twice) but also no one pick up my phone shakehead.gif . What the services that Dell provide to their customer now. For me very easy, just answer my phone, explain & appologize to me, then I will accept it. But now never answer any call make me like fool and all the transaction just hang there and make me donno whether need to buy another or not mad.gif ........ It's totally unacceptable.

Edit : Due to some negative response from some forumers here, I will post my old Order acknowledgement form from dell as well as a new one they process for me, by tomorrow, just to lay everyone's mind at ease.

Um.. actually no. I called them. Told them how disappointed I was with what they did. Then I email them saying basically the same thing. Was perfectly polite verbally and in the email. Never raised my voice. But firm was pretty firm lah... dont sound like softy they can push around/ignore. I also included the names of the all the agents who handled my calls into the email. It's a good habit to always ask for their names before talking further.

So I reckon, if we just take the initiative to "talk" to them, they will look into sorting out this issue.

Edit : Due to some negative response from some forumers here, I will post my old Order acknowledgement form from dell as well as a new one they process for me, by tomorrow, just to lay everyone's mind at ease.

First time for the 22" they did not charge my CC. Yesterday, the replacement, they charged my CC.

Well, a lady from customer service "Sandra" called me up about 3 days after my last communication with them. But I think she already got instruction to replace the 23" before calling me up.

Yeah, i tried getting a Mgr to attend to my call but the call center attendant has no such authority. She didn't have any e-mails either (General Manager Sales / Customer Service was what I asked for).
The 2nd time around I waited for another 30 minutes of being put on hold before I put the phone down. I sent an official e-mail complaint via their Contact Customer Support page and got the support confirmation mail. Let's see if someone from Dell calls me tomorrow.

To update, got call from Dell delivery, wanted to deliver the replacement monitor yesterday, but I was busy. So, told them to deliver tomorrow instead. My CC payment all charged/approved etc.

Why don't you guys try to contact the media and lodge a complain with the consumer tribunal? Cases in malaysia falls under their jurisdiction.

Even if it doesn't work out, it'll still guarantee you guys a voice and the publicity to shame Dell. The reason why their manager is asking their CS to ignore these complains now is because they want to let the issue die off. Malaysians do have a very short term memory.

i am not sure if this is another marketing error from DELL USA. Found this from fatwallet. After coupon discount it's $710 (~RM2500) for A860 Celeron laptop and an unlocked N97. Still thinking if I want to buy or not.. biggrin.gif

it's the same old formula/story on sales orientated companies where sales department can get away with most things, since they're the ones generating visible/direct income~

i bump into similar situation before... haihz... i avoid buyin dell stuff nowadays thats on the hot market item category if possible

I suggest we forward this to DELL US support website. Just link this thread there. It's a dell support forum, where dell employees and manager constantly there to provide support.

suggest all of u wrote to every single newspaper. everyone...not just 1 person as repsentative. 3-4 person each day. continuously for many days. also..start working on bringing dell to the chamber of justice. give them 2 option...replacement or sue.

IANAL, but wouldn't Dell would have the right to sue the government if they did? this isn't a dictatorship where the government can force you to do something that is extralegal smile.gif

The thing is, did they actually complete the order? if they did they might have a case, if not then maybe not.

Actually yes you can, people have sued some dewan bandar (I forget which one) and won. It was because a railing gave way when he leaned on it. I can't find the article now though.

If Dell closes down a lot of people will lose their jobs.

PC World had a slightly more detailed news on the Dell Taiwan's mis-pricing of the 19" Dell E1909W:

After a second run in with low, low, low prices on particular products at Dell Taiwan, Dell has shut down that country's online store until it can sort things out. Apparently this time it was the Latitude E4300 which would go haywire with particular CPU configurations. Dell is offering a 20,000 NT (about $600 US) discount to those who ordered the mis-priced PC, but apparently that only just matches the regular street price in Taiwan for the computer so people are naturally up in arms. We're not sure what they're so grumpy about: sounds like a paradise on earth to us.

This is what I got after I sent them an email about why someone get the 23" replacement whilst I didnt get, together with URL to this thread:

You dont need an accountant to tell you what is worthy of pursuing and whats not. Few hundreds ringgit of trouble is just not worth crying for. Its as simple as that. BTW, I vote for PKR, you nuts. I just got a letter from the Trade and Consumer Affairs Office in Penang. They're looking into the complaint and forwarded the request to the relevant enforcement agency to probe further.

Dell fined $30,000 by Taiwan government over pricing mishaps

Let this be a lesson for all you kids thinking about opening some online shop with a funky database: pricing errors can cost ya, especially if you're doing business in Taiwan. After a couple of downright embarrassing slip-ups on Dell's Taiwanese web store, followed by a failure to compensate those who got orders in appropriately, Taiwan's government has levied a NT$1,000,000 fine (that's just over 30 grand in Greenbacks) on the computer giant. The actual details of the penalty are somewhat vague, but it seems as if the fine will be imposed until Dell decides to "take consumer rights seriously." In other words, Dell's stuck paying up unless it flips a 180 real quick and honors the flood of purchases made at rock-bottom prices. C'mon Dell, do the right thing. Or write the check -- evidently it's totally your call.

So, how about the Malaysian problem? Did DELL honor the Dell 23"@RM399 deals that were billed for, or as the person puts it a fair resolution?

Hi, I suggest someone among us who are affected writes an official complaint to Domestic Trade ministry and cc to say,Fomca/CAP consumer group.

There is an offer for sale and there is acceptance of offer, so this is a contract.Dell is breaching contract!!!!!!Don't let businesses,especially foreign owned, treat us like pariah consumers.
