is this information from the customer when keyed in to get the quotation?

all insurer had their own risk appetite and not using the same factors.

u have to claim third party. rocedure wise, use search button in this thread, search pesuruh jaya sumpah or oath

whenever your car at workshop for repair, u cannot use your car. but u can claim loss of use as u unable to use your car.

LOSS OF USE (LOU) claims a.k.a Compenssation assessed repair time (CART)

1. u can only claim from third party insurance. ask your agent.
2. For case no.1 above, after u make claim from your own insurance under ODKFK, u have to claim against 3rd party for LOU. a bit hassle
3. For case no.2 above, u claim one shot lah since u claim from third party anyway.

Scale of Compensation for Assessed Repair Time (CART)

Vehicle Type
Private Use Vehicles
Up to 1500 cc - RM 30
Above 1500 cc up to 2000 cc - RM 40
Above 2000 cc - RM 50

Motorcycles
Up to 250 cc - RM10
Above 250 cc - RM15

Terms and Conditions
1. The above scale defines the minimum amount payable by third party insurers for
CART claims where the claimant is unable to produce satisfactory documentary
evidence, receipts, etc. to support his/her claim for CART.

2. In cases where receipts can be produced for vehicle rentals, insurers shall pay
the amount shown in the original receipts
and original car rental agreement
subject to the principle of indemnity and subject always that the claimant shall
only be entitled to the rental of a vehicle of an equivalent nature to the damaged
vehicle. Such rental must be only from a rental agency/company duly registered
and licensed by the relevant authority.


3. The number of days for computation of CART shall be based on the independent
loss adjuster’s recommendation on the number of days for repair
of the damaged
vehicle subject to the insurers’ discretion to apply an additional seven working
days grace period for unforeseen delays.

i have a question regarding a recent accident case of a friend.

1. My friend's car kena bang from the back (Axia bang by BMW)
2. both cars pulled over to assess damage
3. BMW driven by a hired driver (car owner remained in car refused to get down) - not much damage just minor scratches on BMW
4. Axia has big dent and bumper damaged, almost fall off
5. both parties agreed to settle without report police - he will take his car to workshop and get quotation
6. my friend took picture of each car individually, and also the driver's license (he forgot to get the car owner's IC and no picture of both cars in one pic)


Now this is where the problem starts :

1. my friend gave workshop quotation of RM500 to the driver
2. he said it is too expensive and doesnt want to pay, he rather get RM300 saman from police
3. he asked to go to his own workshop located in bangi - my friend lives PJ side (damn far)- and he only willing to bear rm250 - becoz thats what the workshop will charge apparently
4. my friend then said bangi is too far and troublesome, so he will charge petrol and any extra expenses
5. the driver then started getting rude and shouted "report la! report la!" and hung up - he was not contactable ever since - blocked my friend's number
6. my friend decided to make police report and submitted all photo evidence - and he reported as langgar lari tanpa berhenti

so question is... will my friend be able to claim against the BMW insurance? (since different driver/owner)

and secondly, what is the best approach to get reimbursement? he only wants his money back for repairing his car.

Hi bro.

My Myvi 1.5 kena langgar from behind and was in workshop for almost 6 weeks. I claim already Loss of Use, they offer RM30x16 days only. I understand that they only pay for working days, but 5 weeks is like 30 working days. That RM30 is the minimum rate per day right? What is maximum rate for Myvi 1.5? The workshop wrote the initial appeal for RM50x40 days.

not working day la. the actual number of days taken to repair your car. like do repair to your car. if laying at the back yard waiting for sparepart not counted.

Hi TS! My situation

- Car hit by another car back in Jan 2019
- Police determined other driver is at fault, got the keputusan already
- Tak sempat bring to shop my husband pulak got into accident (own fault)
- life happened, so basically only today finally got the chance to bring car to shop
- our concern is to get the car back as soon as possible. paling boleh tahan 2 weeks, by raya memang really need it already
- damage is minor cracks to bumper and license plate

was told by an agent that one option is we can claim using lawyer, so the car should be out in 4-5 days. the lawyer will take our LoU as his fees.

is this legit? what's the risk? any other procedure?

lawyer want to claim third party instead of odkfk.

so basically he wants to pau ur lou coz other insurer will pay his fees. crook find other lawyer or workshop
