Hi I am recently selling my used car which I already have finished paying and have the geran with me. I'm selling privately to another buyer which is taking a hire purchase loan but he does it through a dealer which helps him apply the hire purchase with the bank.

Recently, he has gotten his approval and has sent me a picture of the letter of undertaking that the bank has issued to his dealer. I need to ask what is the correct measures needed to be taken from here.

1. Take car to Puspakom to get B5 & B7.
2. Do I now proceed to cancel my insurance and bring the car to JPJ for ownership transfer?

This is where I am very cautious. I do not want to do any transfers until I have been given the money for the car purchase. Does the transfer come first or the money first? Does the bank disburse the money to the dealer which then transfers the money to me? This doesn't seem very trustworthy as the dealer can run away with the money after we transfer the car even if the buyer is genuine.

So far, neither the bank or the dealer has called me up, I am worried that I will get cheated.

Really appreciate your advise guys.

Update:
3.Proceed to JPJ for change of name request with geran and all the documents above., request change of ownership(tukar nama) document at front desk. Fill form of new and old owners details. Obtain que number from front desk and proceed to counter for IC and thumbrpint verification for both new and old vehicle owner.

4.If one party is out of state, they can go to their respective JPJ branch and complete the procedure seperately.
For those who cant go to jpj directly:

Runner fees for inspection can range from rm80-rm150, and change name rm300. for those who dont have time, can use this services. For those who needs special request due to punched engine number, mounting modification, no approvla for sunroof etc or aka special case, you have no choice but to bare the fee's of a runner which is going to cost definitely more than Rm150 for special case. I even heard of Rm1k for this kind of situations.

Prepare your geran, photocopy of IC buyer and seller and hand over to runner. He will also need the original signed copy of the forms mentioned above.

ADDED:

For those who want, can aslo call puspakom 03-20527474 and schedule an appointment 3 days in advance to come over to your house and perform the inspection Rm100 service fee+rm30. However only certain branches can offer this services, so check at the link above or contact them.

you can change name, just cant get roadtax if insurance isnt active. as jpj procedure requires owner to cancel existing roadtax

that would be best practice.

Old owner usually doesn't need to worry since transfer of ownership was completed, any new offences is under the new owner. New owner can also buy insurance and roadtax after change of ownership is done. As in right after. Depends on new owner.

Some do it before and straight apply for roadtax, some do it after change of ownership, they contact their agent or go outside and choose an insurance provider, then later go back in and get their roadtax

Can we skip Puspakom inspection if buy direct in cash? No more loan. And no need to tear off tinting.

From my understanding, you have to change name of the ownership to the new owner first before the bank would pay you the full purchase price. Make sure the e hak milik has the banks name as the financier before you pass the documents to the buyer for name transfer.

You can't!

Without puspakom report in JPJ system, no transfer of ownership can be done.

If road tax still not expired, can still use. Buy road tax after current road tax expire to save some money.

I've read all the steps but i'm not sure if i understand it right. All these steps are only applicable if you're dealing with direct seller, correct? Can we actually use these steps with used car dealer to avoid the ridiculous admin charge?

thats where they make alot of money from additional markup. They pay the runner about rm100-300 depends on the arrangement. and charge the buyer rm500-800..

Hi guys, need some clarifications.

If I were to buy a used car directly from the owner, would his/her traffic summons (police summons, not JPJ's) going to be transferred to me, the new owner? Assuming he/she didn't pay the summon when transferring ownership.

I know that you'll have to clear all your JPJ summons before you can transfer ownership, but I'm not sure with police summons.

1) buyer agrees to buy in cash
2) car still with outstanding with bank

a)Do I proceed to settle with bank first or puspakom first?

b) assuming buyer agrees to buy , I collect a non refundable deposit, then I settle bank loan and then to jpj to change name ... then only collect full payment from buyer?

C) if buyer pays with cheque, I'll need to wait for the cheque to clear first before handling over the keys? Wouldn't the buyer be worried if cheque cleared and car is notwhere to be seen?

What's the best practices ya

a) you can get the puspakom inspection done first, no issue, its only the validity period that may expire IF the buyer flakes.

b & c) [once u have the ebatal] if cash, just count it when both are at JPJ (discrete la ofcourse), if cheque, it should be bankers cheque, as way less to zero chances of bouncing, as the buyer has paid the full amount to the bank in order to get the cheque.

As precaution, while waiting for cheque amount to clear, the owner may take the registration card with his name on it, while you (the ex-owner) keep the car & only send it to him once you see the cash in your account. Just make sure there is black & while on this agreement to prevent any miscommunication/hassle.

Not legally, as the current owner's thumbprint is required. Used car dealers may be able to assist (as they have then facility), but be prepared to pay (should be seller cost, due to seller issue, not u, logically).

Insurance must be purchased & active (with roadtax not exceeding the insurance coverage period) before JPJ will transfer the ownership.

Insurance cannot be transferred.
