I also received the vacant possession letter today. But there are late payment charge and misc. charges total of RM1,085. Will find out from them tomorrow.
Do go through your S&P, my defect liability period is covered up to 24months & LAD said liquidated damages shall be paid by the Vendor to Purchaser immediately upon the date the Purchase takes vacant possession of the said building. I think we have file in Tribunal to claims the full amount since they did not mention any LAD payment when I called the office. I had called my bank to check this morning, the bank officer inform me that the final release amount already credit to developer account. The official letter and cheque already send to lawyer side.
Added on August 30, 2012, 2:23 pmHi Phase 3A owner, any of you encounter the late payment charge by developer? I call both party financier bank and loan lawyer, all of them also escape the issue. Don't pay any interest to vendor, my cousin phase 3 facing this case october 2011 before. Refer to lawyer inform no need pay any late payment charge to vendor, don't be stupid purchaser you deal with bank only. before hand over just pay syabas & Tnb deposit only. my cousin know the rules argue with vendor, Vendor hand over key to my cousin, one cent also no need to pay.

Phase 3A Owner, Serious problem!!!
Just now (4.30pm 1/9/12) i go to visit my Phase 3A house, i found that SYABAS meter has not installed yet. Talked to developer officer at site office, he say may be install on next week, is MAY BE. We will collect the key on Monday, but can not use any water, is this call "finish completed" and hand over to customer? I cannot collect my key on next Monday or Tuesday, if any Phase 3A owner collect his key, kindly bring this issue to developer that we cannot accept the date of delivery of vacant possession as stated on the letter. I don’t find any reason why we should pay high amount for miscellaneous cost including for Security. They just have one pondok buruk with grandfather sitting inside without doing any checking.
Anyone can enter and go as their wish so why we need to pay!!!!!!!!!!!! This is ridiculous, they don’t even have a access card entry I can only think how stupid the developer with the wall height that they have built to protect the community, anyone can jump into the housing area…so call guarded community, I believe even dog can jump that high. Hi GUys
Just came back from the phase 5 site, 1st floor and ground floor bed room tiles has been changed from porcelain (as what stated in the brochure) to cheap ceramic tiles size 1 x 1. WTF!! This is consider cheating d... Can we do something about it, stop them from further installing? Meet with the developer? file a suit against them? Since this a a collaboration project between states agency ( setiausaha kerajaan negeri selangor), can we go and meet up with Sepang MP? Shall we meet up and discuss about it? |
