did the letter said that by end of 3 months, contact them if you still did not get response?
if yes.....then most probably it is a random audit.....
may I suggest you get your documents ready and contact lhdn...instead of waiting for 3 months

Hi guys. I received a summon letter from LHDN 2 days ago saying i havent paid my tax for year 2015 and 2016. The issue is my employer pays for my tax yearly. They even provided me receipt of the bank transfers but according to LHDN, they haven't received the payment. Now they're asking for proof that the transactions were successful.

Also, for 2015 I was deemed a non-resident and charged 25% eventhough I was in the country for 340+ days and I wasn't out of the country for more than 14 consecutive days.

I'm planning to make an appeal for this on Monday with my supporting docs but I doubt that something good will come out of it. I'm a foreigner by the way.

Any pointers you can give before I walk in there?

under the new Lifestyle tax relief....

Effective for year of assessment 2017 (tax filed in 2018), the lifestyle tax relief at a limit of RM2,500 yearly, also includes new categories such as the purchase of printed newspapers, smartphones and tablets, internet subscriptions as well as gymnasium membership fees.

Income remitted from outside Malaysia

Income tax Malaysia starting from Year of Assessment 2004 (tax filed in 2005), income derived from outside Malaysia and received in Malaysia by a resident individual is exempted from tax.For example, if you take up a job while overseas and you only receive the payment for the job when you are back in Malaysia.

Does this rule apply to those selling bitcoin at US based exchange for cash ?

This kind of question has been asked 12343 times already.

Derived = where you are or where you performed the job to earn the income, not about where you sell to.

If you are in Malaysia and a tax resident Malaysia, disregard where you sell your stuff, or wherever server/online platform based or to whom, it is considered derived in Malaysia, and subjected to Malaysia tax.

Your employer is just merely a agent to collect PCB and hand it over to LHDN, doesn't mean the tax is file.

Show them proof like your passport, EA form. No submission on tax filling would attract penalty, just talk nicely with the officer.

Im still confused on 1 part. By internet subscription, does it include my monthly telco mobile data (umobile, celcom, etc)?

okay thank for clearing my doubt . next , how much i need to earn on yearly basis to be taxed ( from 2017 onward) and to declare my income i need to earn RM 30,000 right ?

Hi all, is it necessary to put the exact bank account number of the BE form owner?

I've placed it under my parents account and realized that it may cause some issues with verifying the owner's details during remitting.

Yes, but only the portion for internet is qualified for deduction...

To be exact RM30,672 and declaring your income is everybody responsibilities. If your income had reach this level(after epf deduction&after including all taxable allowance and income such as bonus), you must register to open tax file. After that, you need to update and declare your income annually, eventhough there a year/years that you didn't have to pay tax, you still need to declare for it.

Its mean undeclared income...eg. You received bonus payment for year 2013 in 2016, in which you did not declare in 2013, you need to put the figure in column E(for income that is not common in nature-eg performance bonus)
