I've just received a call from LHDN officer saying that based on my recent Semakan Khas audit for 2012, I will be penalized about 45% from the undercharged (or underpaid, I am not too sure) tax. This is for not having a receipt of computer purchase.

Q: How do we calculate the undercharged/underpaid tax? I want to calculate how much damage I have made.

Hey bro, under S113 Incorrect returns - liable to a fine of minimum of RM1,000 and maximum of RM10,000 and shall pay for a special penalty of double to the amount of tax which has been undercharged.

Don't mean to scare you, but this is from the act.

The amount you supposed to pay and the amount you have paid. That's difference - considered portion undercharged? Then, probably you can guess how much is the damage.

But still, i am not 100% correct, wait for others to double confirm on this.

Sorry one more quick question here - Basically can i just claim my ACCA exam fees and annual membership subscription under personal education, because i see nowhere where can i claim deduction on this.

Maybe anyone can enlighten me on this???

ACCA exam fee - NO

Professional membership to perform your duty in the course of employment - YES (deduct directly from perdapatan berkanun). Make sure you have receipt for it

I'm not sure if professional certification courses is eligible as that relief is meant for tertiary education such as full fledged degree/master/PhD in relevant field at approved higher learning institutions.

understood, as you said just now, the professional subscription can deduct under employment income which means now the employment income with be different as what in my EA form? is it?

Yes, and that's why you need to have receipt as proof of payment of your annual professional membership fee.

hi guys, property agent fee can deduct in rental income? some said can some said cannot? im not understand. and rental income need to pay pcb?
