Maybe you should ask those who sell w/o paying RPGT.
The 5 year period is calculated from the date of Sales & Purchase Agreement of the current owner.

Would like to get feedback regard this tax exempt benefit:

(d) Leave passage for travel (confined only to the employee and members of his immediate family i.e. spouse and children):
- within Malaysia not exceeding three times in any calendar year (cost of fares, meals and accommodation); or
- between Malaysia and any place outside Malaysia not exceeding one passage in any calendar year, is limited to a
maximum of RM3,000 (only cost of fares);

Read from a book that if our company does not provide this benefit, we can suggest to the company to replace guranteed bonus with this to reduce paying tax. If the company agreed how do we go about it?
Do we need to submit receipts when claiming from the company?
Does cost of fare include taxi, car rental, boat, cruise during the trip?
Only meals with receipt can claim?

For domestic flights, fares + meals and accommodation is applicable. You'll need to get the receipts and company documents for record purposes.

As for international flight, only fares are applicable. Cost of accommodation, foods and allowances are not applicable. You can only claim fares.

what other tax relief that we are able to cushion of total income tax beside books, sports equipment and computers.

i want to ask if i purchase some dumb bells, weight plates and normal gears, is it possible to submit them in one receipt and get the tax relief under as sports equipment? when it meant sports equipment, can it be a medicine ball or kettle bell any light weight equipment for gym or those threadmill or weight stations?

Ask your HR to revise the EA else inform your boss HR don't know how to comply with ITA 1967.
RPGT applies on all REAL PROPERTY including the shares in a Sdn Bhd that is deemed Real Property Company.
If you buy a property that has been owned by the vendor for more than 5 years, no RPGT need to be withheld.


Added on February 7, 2012, 2:26 pmiPad qualifies as Computer for tax relief. Confirmed by IRB officer.
But not Galaxy Tab 7.

Hello to all,

I have a question here.

I worked for company A from August 2010 to March 2011. In April 2011, i did not file any income tax but my company A has deduct the PCB.

My income has not reach Rm 25000 pa. Can i still get back my PCB deducted?

Then, i stop for working until then i worked for company B from August 2011 to current. My income has not reach RM 25000 PA for this period.

Do i need to file tax for this year?

Since Company A had deducted PCB and submitted to IRB, meaning that you have tax file number.
Therefore, you need to declare your income every year to IRB even though you have no income at all for that particular year.
If u have tax file number but you didn't submit your Borong B/BE, IRB will penalize you.

Since my income for that year has not reach target income, still need to declare to them.

Hi, forumers.
Want to ask that is it whether I need to register myself as a tax payer only i can pay tax or once i got a company i would automatically need to pay tax?
This because I've just established a sole proprietor last year february and it is going to 1 year already.
I want to pay some tax so that its easier if i apply for any loan in future.
But i dont know anything and what is the first step i should do.
I do keep all my receipt for the whole year.
But i didnt register myself as a tax payer yet.
So, can i still pay tax for this upcoming terms?

Got a couple of questions to ask here regarding my taxes for last yr. i was working at company A for 8 months of questions2011, then joined company B for the rest of the year. while in my previous company they regularly deducted my tax monthly. After joining the new place, i did not have any deductions in 2011. Now i'd like to know the following

a) from whom do.i get my ea form for last year, company A or B. Or both ?

It's always best to email LHDN on this matter, rather than based on individual experience as you may or may not get audited.

For Tax purposes you need to declare your income for YA2011. Since your company was established in Feb 2011, you need to declare your income from Feb11 till Dec 11. If you have not open an income tax file, you may open at any of the IRB. As you have business income, your tax (if any ) will be due on 30/6/12 instead of the normal working employees who need to pay tax by 30/4/12.

You need to compute your income less any deductibles(Fe 11 to Dec 11) to determine whether you will be taxed or not
