if the project is not under HDA , there is no such LAD thing could happen.

the developer vp fast because of need money to progress ,
the bank let the loan out because it almost finish the bank need to transfer the risk to buyer,
if whole project fail , bank will hold an abandon mall and office which is not for sell in retail.

got LAD clause one lah. last time for ED, MEH got compensate a few K to me. but this time round, they gotten wiser, VP even earlier to avoid LAD as much as possible. they even waived 2 or 3 months of maintenance fees after many owners made noise over the unliveable conditions when they already started charging maintenance fee.

Borrower/buyer commence loan repayment the month after property vp. believe many are flippers or bought to rent. those had a year reserve for loan repayment may soon depleted, and if this untenantable condition doesn't improve soon, could start a domino effect on kv property market.

Dear Colonial Loft purchasers,
my law firm is representing a client who purchased a Colonial loft unit in November 2010. The Developer delivered vacant possession to my client in September 2015. The said unit and the common areas were still not completed when vacant possession was delivered. My client is obviously dissatisfied with this situation.

The main issue here is whether the Developer can avoid it's obligations and responsibilities by delivering vacant possession of a grossly incomplete building to a purchaser and avoid payment of substantial compensation to a purchaser. Apart from this main issue which is linked to liquidated ascertained damages (L.A.D.), there are a number of other issues which the Developer has to answer for.

As such, my firm, Messrs Lopez & Chin and our associate from Messrs Azri Lee Swee Seng & Co wish to call for a meeting of Colonial Loft purchasers to discuss and resolve this matter.

If you are a dissatisfied purchaser of a unit/units at Colonial Loft or any other building in Empire City, kindly send us an email at action@lexlnc.com.

We intend to set a meeting date before the end of March 2016 and we want to get an indication of how many purchasers want to get this matter resolved.

Get the master purchaser list and call each and everyone of the purchasers to team up against the developer, architect and banks.
