There is a Chinese saying: your money is in the bank, but you are in the Heaven. My friend, try your best to avoid having LAL between floors. There are far too many mishaps and accidents from this type of design which led to many permanently maimed or disabled with fatal cases caused to the owners and consultants for the past years. Almost every year, we hear such misfortunes. Most of them are filthy rich. Such type of design is a booby-trap to the owners. So, do be careful and to reconsider.
*
i agreed with lucas....生命重要过财富。。。我本身也不喜欢这样的design,很危险,我也听过很多case发生。。。如没办法的话,可以在LAL 作铁围

thank u cergau, you don't seem to be lack in everything, you should be the committee for the Malaysia association which office is in Kedah, i still disturbed  that how can a Federal association office bear an address in Kedah .

lukas, i guess you have a checklist and numbers to call already when encounter such problem. notworthy.gif

I think that's good to have a checlist or 101 Survivor guide book for all . Call it The Red Code book.

Sample:

Code Orange

1) Receive letter
2) Prepare Documents and licenses if have
3) Start Calling Lawyers, Associations, Buddies, NGO , Adun etc.

Code REd
1) Receive Warning Letter
2) Appeal for longer time frame to rescue baby birds.
3) Accept the consequences due to new law but fight for compensation due to lack of understanding in the past and no such law was produced in the past .
Is this a wake up call to some already?
*
Good question and suggestion........... as far as I was told is that before the office is in KL and since the Executive Secretary is from Kedah and he has 2 of his staffs attending to the swiftlets matter for the Association, it is best in the interest of the Association to move there. If more answers are needed, it's best that you get them from the Executive Secretary or Mr. President himself, I presume i.e from the horse's mouth. The above reason is what I get from the AGM held recently. I wonder if any of the Committee members of the Fed is with us for at least, he can answer all the question pertaining the Association and swiftlets matter here and then, everyone can have a good night sleep.

Hackwire, Why till now you haven't got a BH and if you have done so, you will surely and truly be one of us, a Swiftlets Sanctuary Protector and you will be like Cergau cos until you are one of us and truly feel like us, I really don't know where you are standing...........pardon me for being frank.

Do go, buy or build one and you will understand our true feelings, sentiments and love for the lovable swiftlets....otherwise, I really don't believe you truly understand what we are all about........if only we, human being can be like the swiftlets, giving without asking for any return, then the world will surely and really be a better place to live in and only paradise can only be a comparison.

i want to ask all sifu here, is all believe fengshui inside BH?????/

fengshui can divide into 5 elements like : water, fire, wood, gold and soil

我只想证明一些金丝燕的风水是否存在,i hope all sifu here can give me some opinion about 金丝燕...

thanks...

I'm no lawyer, but since the Bill already propose to give them just as much authority as the Police;
And in the absence of any assistance from our Feds.
I have here the link from the M'sian Bar with a handy book of your rights when faced with such situations.
Coincidentally it's called the RedBook.....
I figure they can be loosely known as the Wild Life police force if the Bill get's passed as is.
They can arrest you and bring you to the police station, from then on criminal procedures applies.
In effect, anyone outwith this proposed Act will be treated like criminals.
As such for those of you who prefers not to do anything abt the Bill...the Redbook is a must-have.
http://www.malaysianbar.org.my/index.php?o...=628&Itemid=332

Power of arrest
93. (1) An enforcement officer may arrest without warrant
any person whom he reasonably believes has committed or is
attempting to commit an offence under this Act or any of its
subsidiary legislation.
(2) An enforcement officer making an arrest under subsection
(1) shall, without unnecessary delay, bring the person arrested
to the nearest police station, and thereafter the person shall be
dealt in accordance with the law relating to criminal procedure
for the time being in force.

Only the postman, garbage collectors, TNB and water meter readers remain and awaiting to be armed.

It is and often those seeking publicity and saying something that they know nothing about.......sad story but true those Da**** stupid D** barking at wrong tree. He should read and understand that swiftlets are already in town long long ago and that only new BHs need birds call to invite the birds to visit the building but if the birds don't like what they see, they just fly away. Looking at the hugh increment of swiftlets will know that we are infact protectors of swiftlets and our birdhouses are sanctuaries for the town's swiftlets.......a new specie and infact, more and more sub species as we talk.

The birds are and will stay at town anyway and just which BHs is better and the bird calls invite them to see for themselves. It is just like you are opening a new hotel and calling out to customers to visit your hotel just to see for themselves, otherwise, the birds don't know that your building is a bird sanctuary; they just may bypass your BH and stay next door BH. If it's a town swiftlet, it will remain a town swiftlets until death and you can remove the tweeters, you can remove the planks, they still will stay by building their nests on the wall and ceiling top. Why make life miserable for the birds and you called yourself, SAM President. I wish that I can tell the So called SAM President right in his face to read well before speaking out otherwise, he may look and sound like a Fool...........

thank you west wing. i don't have network much on the industry and only people i met are a few forumers here . we had discussion before and some of us still don't own any bh yet and i think i myself cannot speak on behalf of those who already in the struggle for so many years but if they had done so or not, today is the results of what happened in the past . It is not now.

When i saw hills got cut , limestone in perak and cameron highlands, sabah and sarawak, peat fires in selangor and other states of the country.... i wish i could have done something but to the extent i cannot be everywhere at one time and only those who lives nearby can initate it. I had even been invited to be with the NGO who fought for open burning once in Selangor and also met up with Elizabeth Wong before. Initially they are very understanding and later they fade of , the environment director of the Jabatan also see us but her promise is all fake . In the end, we move on because we can't rally enough of people because many of them said that the problem cannot be solve because of the land ownership by many BN warlords there.

I would like to see my own bird house soon but even people like Lukas had sold off his BH due to the uncertainty of this cancer. I feel the right time is when the law is more clearer. The problem in malaysia is that legality and illegal is pretty identical or not much a different. Im also in the DVD and Blu Ray Business and i see the similar problem almost identical in every dept. Malaysia Original DVD is not really an original and many buyers don't know that. Only certain company are legally licensed to provide quality disc.

Moreover, Cergau had highlighted the rights of authorities to conduct legal raid into the premises . they love that . It gave them the sense of power and authority to show off to the public but they don't get the same glamour if they Close Down those 24 hours mamak shop for unhygene food preparation and staff dirtiness.

I think so far, the birds are doing so great and it doesn't really need my help yet. I think Dolphin in Taiji needs our help before this Sept where another killing seasons.

No reason to ban swiftlet farming
[U]
I REFER to the letter “Ban all swiftlet farming activities” (The Star May 5).

The writer’s concern for the welfare of the birds and his call to allow them to live in their natural habitat are laudable. However, I do not think swiftlet farming is cruel to the birds.

It is true that swiftlet farmers set up houses to lure the swiftlets to nest inside. But it must be remembered that if the house does not meet the swiftlet’s “taste”, it will not stay. That’s why the success rate of swiftlet farming is low at only about 30%.

Now, if the swiftlet stays, it means as far as that swiftlet is concerned, it is its natural habitat. We must not forget that the swiftlets migrated here from Indonesia because their natural habitat was affected by open burning.

A farmer cannot compel the swiftlet to come, neither can he compel the swiftlet to stay. All he does is to get ready a place and hope the swiftlets like it. The swiftlets come and go as they like; they leave in the morning to hunt for food, and come back in the evening – if they want to.

Personally, I think swiftlet farming is more humane than chicken farming. The chicken layers are kept in cages with the sole purpose of laying eggs for human consumption, without once seeing any of the eggs hatch. And when their job is done, they are sent to the factories to be processed for meat!

As far as harvesting of nests is concerned, the farmer knows that his long-term profit depends on the multiplication of the birds. It is suicidal to harvest the nests before the fledglings are mature. Of course, there are some dumb ones but they are the exception rather than the rule.

As for the noise from the speakers, I would rather listen to the chirping of the birds than the deafening music from some shops and the roaring traffic.

What about hygiene? A knowledgeable writer to this column had earlier explained that these birds have very clean habits – they only do their “business” inside the house. So one does not need to worry that they will drop anything on one’s head. Also, they do not hang around food outlets, unlike crows.

I am not a swiftlet farmer. But I know of a small town where, for generations, many of the town people made a living by operating small provision shops. Then the town was invaded by supermarkets which sold items below the cost price of the small traders. Within a short time, some of them were reduced to poverty level. Swiftlet farming threw them a life line.

It is for this reason that I think the call to ban all swiftlet farming activities is inconsiderate. Most of the nests are exported, earning the nation valuable foreign exchange. Swiftlet farming helps both the farmers and the nation. I appeal to the Government to do all it can to help the farmers.

HUMANE,
Klang.

Dear All,
After discuss with Veterinary Dr. Fazilah and Menteri Perumhan Dato Sri Kong,
The amended Bill has taken out Walit from the list.
Thank you
Dato Beh

--------------------------------------------------------------------------------

All,
I was forwarded the above self explanatory email from Dato Beh and I have taken the liberty to share the good news here.
However,.... it still bugs me cos' AF never was listed specifically anywhere in the Bill.
Again I stress AF is NOT listed in any of the Schedules in the Bill .....to be taken out.

My layman reading of the Bill has been that AF is included implicitly through a combination of clauses.
It worries me even more that both Dr Fazilah and Dato Sri Kong has chosen to assure Dato Beh that it will be taken out from the list.
Again AF is not on ANY list!!!!!
Does anyone actually has a handle on this?
Do we have to ask the PM personally? rclxub.gif

Appreciate any comments if you hold a different view or I am being too cynical to take any good news at face value.

i assume AF is Aerodamus deciphagus , the correct species for swiflet.

so you mean the swiftlet is too general ? correct me if im wrong. It's good to be more specific as i saw the same case happen to the dolphin documentary lately that Japanese does not recognize dolphin fish as one of the species in the whale category thus it was exempted and legal to be kill by the japanese govt but according to scientist dolphin is in the family tree.

The thrust of my earlier posting was that the issue was treated so flippantly.
When AF was not specifically stated in anywhere in the Bill...how then can the assurance be stated as taken out of the list?
It's not in a list/schedule....and as pointed out privately the corrective action ought to be a specific exception clause similar to the example (below) from the Bill
"Pecari tajacu (except the
populations of Mexico and the
United States of America)"

AF = Aerodramus fuciphagus
where in some ref also loosely known as Collocalia fuciphaga
http://en.wikipedia.org/wiki/Edible-nest_Swiftlet

Yes, your assumption is correct, the current Bill is not sufficiently precise
A contentious point may arise from Collocalia esculenta in the First Schedule.
tuckfook has offered his take on this and I leave it to him to elaborate on this point.

So you see, I was telling you all to forward to the person concerned if you have questions cos' it concerns our future....As it' wasn't mentioned has many possibilities.

1. It was taken out from the list before it was tabled at Parliament due to objection.
2. It wasn't in the Bill at all in the first place.

Anyway, to be on the safer side, why not advice your state representatives to ask the Fed President to seek that the phase " does not include AF" in the Bill tabled at Parliament,. This way,, we can be assured that AF is not affected in any way by the Bill.

Just looking at the Bill is really scary cos it give too much power to the Perhilitan. It is like giving Perhilitan a "007" license to seek, kill and destroy.

Added on May 8, 2010, 4:32 pmGood News......The Fed. Asso. Boss is calling for an Emergency Meeting on the matter concerned and that's a positive sign that the Fed. Asso Boss is concerned.

Will keep the forum updated on the matter...... when I get the latest news.

FIRST SCHEDULE
[section 3]
PROTECTED WILDLIFE
Interpretation of the First Schedule
1. Species included in this Schedule are referred to—
(a) by the name of the species; or
(b) as being all of the species included in a higher taxon or designated
part thereof.
2. The abbreviation “spp.” is used to denote all species of a higher taxon.
3. Other references to taxa higher than species are for the purposes of
information or classification only. The common names included after the
scientific names of families are for reference only. They are intended to indicate
the species within the family concerned that are included in this Schedule. In
most cases this is not all of the species within the family.
4. Where there is conflict between a scientific term and a common term in
the use of the name of any species in this Schedule, the scientific term shall
prevail......

CLASS AVES (BIRDS)
Anatidae
(Duck, geese, swans)
Anas bernieri Bernier’s Teal
Anas formosa Baikal Teal
Branta ruficollis Red-breasted Goose
Cairina moschata Muscovy Duck
Coscoroba coscoroba Coscoroba Swan
Cygnus melanocoryphus Black-necked Swan
Dendrocygna arborea Black-billed Wood-Duck
Dendrocygna autumnalis Black-bellied Whistling
Duck
Oxyura leucocephala White-headed Duck
Sarkidiornis melanotos Comb Duck
Apodidae
(Typical swifts)
Collocalia esculenta Glossy Swiftlet
[U]

The above extract shows that it is clear that all Apodidae, all Collocalia, are protected. There is no distinct exemption for C. Fuciphagus.

It is like saying Protected humans are Fukkiens, Surname Tan. listed example. Tan Ah Beng. (Note that there is no mention of Tan Ah Kow .)
Whereas we want to exploit/make use of Tan Ah Kow. For sure the authorities insist that Tan Ah Kow is NOT on the list !

Of course Tan Ah Kow is not on the list BUT all Tan is on the list which includes Tan Ah Kow.

We must seek that C. Fuciphagus and A. Fuciphagus or any sub species known generally as the "Edible White Nest House Swiftlet - as suggested, C. Domesticus, Cranbrook" be clearly exempted/excluded from the wildlife protection Bill 2010.

The old bill that the 2010 will replace used to list specifically each protected species and sub species. In this 2010 bill the whole family is listed.
