What happened to my post? why was it removed?

Sighed...

Basically, I went to MPS yesterday to complain about the road to my house. It's only 28' but the MPS officer told me that the standard for road is suppose to be 40'.

They have already given their comments to the developer to "rectify". The officer asked me to check with the developer on this problem but I've yet to received my keys. My lot No. in 84A & B. She said that they would definately not issue the CF if the matter is not rectified.

They did comment that house to house distance is suppose to be 40' for safety reasons; ie fire engines and ambulance needs to pass in times of emergency. Even garbage truck would have difficulty in passing.

The 28' is suppose to be the back lane, but for our housing project there is NO back lane as as the houses are back to back.... so I don't know how are they going to rectify. Perhaps by demolishing my row or the opposite row or... compensate by giving us Amansiara 2?

I know someone in MPS. He did mentioned that sometimes, developer may use "under table way" to push through the CF.

Dunno... awaiting for my keys. I can't understand how can the developer be so poor in the standards. Some of the car park are slanting inward'so that some of us can have a minipool in the carpark during the rain', carpark fit only for kancil or kelisa(developer must be a perodua fanboy), toilet that is only 6'???? and last but not least.... 28' road to some of the houses? Brainless, if a car is park outside, the opposite house owner would have a hard time reversing into his own parking space. If 2 cars park at the shoulder(which household has less than 2 cars??? pleasezzzz) cars can pass the road. *sigh*

But , as to the back lane issue...I guess that's not a problem for us coz we falls under the condominium category.....surely, there's no min. req. for backlane rite...

I spoke to leadmont's staff requestg 4 clarification on the matters posted by princeoclark. I was informed and I quote as follows:

(1) ' If there's any problems, our project people will deal with them, so, what is your problem'

(2) ' By the end of the day ( it can be in 2 weeks, 2 months or even 2 yrs!!) , it is our duty to get CF'

(3) ' Dun worry, if ur house is delivered after ue SNP expires , we will pay u according to e late interest rate, so what is your problem?'

The dev. feels that it's alright not to deliver vp in accordance w e stipulated time...

I was so frustrated when she refused to tell me who are their project people! When , I askd her , if their project people are based in mid valley..she said 'yes' but seldom in e office...

All phone calls on Amansiara are directed to her..but yet she knows nothing...

I'm not asking for much, I just need e dev. to be honest and keep us updated!

Hi All,

I had collected key and sign the letter.

I checked with my friend (LAWYER), this lawyer tell me, the Late of delivery is counted from the date of VP ISSUED and is NOT CF. so if let say (HOPE NOT GOING TO HAPPEND), the CF is issue by another 2 years, the developer is not need to pay on the late of delivery because it is counted from the date of the VP's letter is issued, even you are not sign, it still will count after 14 days from the VP issued.

I just want to found out from anyone here , it's this true for above statement???

I got some link you can checkout what we can do for the case like this, i had email them still waiting for reply,so may be call them tomorrow .

hey guys, 3 weeks a go shafary did fix an appoint with hba for us all, but only me and shafary went, the rest did not come. By the way where is shafary, Not posting in this forum anymore.

I went to the sight yesterday evening the guard was so strick, don't allow us to go in without sticher, even park car outside and walkn in also cannot he said. I told him kenapa hari tu boleh, he said hari saje skrg itu management tak bagi masuk sudah. Tunggu sampai kamu dapat kunci.

Dear Amansiara,

Do understand that we need to have locus standi before we can take action. Some of us have no locus yet, coz we havent rcvd our vp letter n our SNPs have not expire.

The reason why we are posting here is not mere 'talking' but to keep all our fellow neighbours updated....so that, once a committee is formed, we would have a list of our observations...


BTW, tsohtan,

your friend is correct, once you signed or rcvd ur vp letter, the developer is not bound to pay for LAD. H/eva, on the other side, it clearly states in the SNP that our VP letter must come with a CF. Since, some of us rcvd VP letter w/out CF, can we consider the VP letter to be valid?

these are just my humble opinion, it can be wrong as well...

Further, LAD payment need to be paid by the developer to the aggrieved buyer upon taking vacant posession of the said property. So, once you signed w/out any objections, the developer has escaped from paying LAD.

BTW, Alan, Raymond...y so quiet, havent heard from u guys for quite some time...

OK amansiara, i will go there at 11am,sat(28 Feb 2009) as u mention and discuss about the matters and what we should fight for. and i think the most important thing is are the developer follow the original floor plan to build up the house or not, friend of mine said we can go MPS to get the original submitted floor plan by developer to see whether they follow the plan or not. Me very piss off with the toilet. Is very low ceiling and small, and it is not mention in the S&P, in S&P just mention about the total height of the toilet.

yes, the LAD claim period will be ended from the date of VP. the calculation is as such:

Selling price x 10% x days late/365

days late = if ur spa date is 1/1/06 & ur spa is 36 mths delivery, then the due date for dev to deliver vp is on 31/12/08, if the dev deliver vp on 1/3/09, days late will be 1/1/09 to 1/3/09 = 31(jan)+28(feb)+1(mar)=60 days

as for amansiara, if according to mps they hv not given the green light for borang E submission, then the vp is invalid. even u hv collected ur key, the vp still consider invalid. u still hv the right to claim LAD until the day mps accepted dev borang E.

after mps accepted borang E, meaning mps will sure issue CF within 14 days as this is the regulation from the govt to issue CF within 14 days. so ur friend comment is right but since the mps not accepted dev borang E, u still entitle to claim LAd until the valid vp is delivered to u.

So if that is true, how should we get evidence that can prove that the Borang E is not accepted to avoid them to pointing each other when come to LAD claim.

these are just my humble opinion, it can be wrong as well...

Further, LAD payment need to be paid by the developer to the aggrieved buyer upon taking vacant posession of the said property. So, once you signed w/out any objections, the developer has escaped from paying LAD.

yes, you can treat the vp invalid even u hv signed the acceptance of vp as when u accepted the vp, u did not know the vp delivered to u is invalid. so u still can claim ur LAd till the valid VP delivered to u.

I experience that b4. I accepted the vp then found out vp is invalid. i went to tribunal to claim. they paid me the full LAD till the correct vp date.

go to mps and get the confirmation letter from them stating the correct borang E acceptance date when u hv got ur cf. with that letter proceed to claim LAD.
