They do not let the purchasers who placed RM 5K booking know about this massive 15 acre cemetery!!!

For those of you who are pantang about cemetery, please stay away and don’t throw your hard earned money down the Klang River.

If they price it right, I think people will still purchase. I've seen few development that has cemetery view, and over time it's fully occupied too. There's one near Aeon cheras selatan, they built right beside Chinese cemetery and it's going to ready soon. It looks good though and not that scary after all. Just stay out of it if pantang, no one is forced to purchase.

Suddenly a lot of people pushing O'hako to me.

Came across a few lately.

When asked about the 15 acres cemetery, they were like 'Oh really? How come I was not told?'

My bankers tell me he is super desperate now, pushing the banks to quickly call purchasers so that they will take up loan offer letter and be ready for S&P signing.

Luckily didn't rush into paying booking in the beginning. Did a site visit and the surrounding actually not bad. It's near to my current property but after what I has had read here about this project, I can count myself lucky not to purchase this condo.

Any confirmation the bridge will materialise? It has been the selling point for few projects around this area and some project even VP-ed for years already. There's also another proposal they said will have direct access to Kesas.


Btw, having the bridge might not always turn out to be favourable. Many will use that to skip toll and probably bring more traffic into the area.

I am not understand why people so interested to discuss about the Mr John family members...this is their personal matter...what is his age and who younger or elder...is it related to this Ohako project?

If some of you do not know his history, then please do not simply talked nonsense here...Mr John choose to come Malaysia as Marimo want to expand their business in other countries, plus his wife was from Malaysia with 3 kids here, so is not surprised Mr John was here to develop his new launch project Ohako...please learn how to respect others...but not purposely try to mislead other people...

For me Mr John is very creative and great developer...from the overall concept and design of Ohako...you already can know his effort and hard work....if someone not interested...then may ignore this project but don't try to mislead other buyers....I never see such a developer with patience and willing to listen from buyers...

You are OK with the cemetery, fine. I have many friends who bought it, either because they don't give a damn f*** about the cemetery (mostly young people) or they are buying for investment.

But do you know that a lot of people buying for own stay don't even know about the cemetery and from what I gather they are signing SPA this month? Imagine what will happen if they find out about the cemetery after signing the SPA & bank loan agreement? There will be no turning back. Its RM 500K, not RM 5K mind you smile.gif

You claim people already know? How many of those people coming to sign SPA know about the cemetery?

Again, I have to agree that the orientation of both blocks is not directly facing the 15 acres muslim cemetery but do you also know that many chinese are pantang when it comes to living next to a cemetery even though its 200 meters away (so they claimed with the diagram)

I am just keeping everyone informed, at the end of the day its up to the interested party to go to the cemetery site to see for themselves and make a decision.

I just want to share information, that's all. Nothing wrong in that I suppose? These are facts anyways.

A lot of people who placed the RM 5,000 booking are at risk of buying something that they don't want thanks to the cemetery. Most probably they will regret it after finding out thanks to the developer being not truthful. My sources tell me he forbids anyone in the company to breathe a word about the cemetery. Buyers have to kept in the dark until they sign the S&P otherwise ...

Your must understand muslim cemetery usully is very greenty one. Family will plant tree to cover up th grave. Second the propose site current was full with illegal rubbish dumpling and open burning. The main purpose mbpj cover the land use is to address the problem.

I can think of a couple of projects that is next to cemetery (eg. Silk Residence, Oval Damansara) but not discussed as hot as this O'hako. Is cemetery the real issue here or something else?

Before we even get to that, we have to make sure the basic thing is highlighted.

No matter how beautiful the design or how cheap the price its no point if the cemetery is the main issue.

I did admit in my one of my previous posts that the design is beautiful, though the show unit sucks!
The price is also reasonable if you look around. Another pro would be since this is a Japanese developer, quality should be assured (I hope! keeping finger's crossed)

Most probably those 2 developers were honest and sincere.

Try reading the 1st thread about O'hako, one of ex-purchasers related his experience when he asked the SAs about this cemetery.

I too had the same experience.

You are OK with the cemetery, fine. I have many friends who bought it, either because they don't give a damn f*** about the cemetery (mostly young people) or they are buying for investment.

But do you know that a lot of people buying for own stay don't even know about the cemetery and from what I gather they are signing SPA this month? Imagine what will happen if they find out about the cemetery after signing the SPA & bank loan agreement? There will be no turning back. Its RM 500K, not RM 5K mind you smile.gif

You claim people already know? How many of those people coming to sign SPA know about the cemetery?

Again, I have to agree that the orientation of both blocks is not directly facing the 15 acres muslim cemetery but do you also know that many chinese are pantang when it comes to living next to a cemetery even though its 200 meters away (so they claimed with the diagram)

I am just keeping everyone informed, at the end of the day its up to the interested party to go to the cemetery site to see for themselves and make a decision.

My favourite line -> Make an informed purchase. Don't bodoh-bodoh buy without knowing there is cemetery if your intention is for own stay [if you are a typical cina who is pantang about such things]

I personally cancelled not because of anything else but the cemetery. Thats all

Nothing to mitigate if potential purchasers don't know about the cemetery. From what I see, this is what they are currently doing.

cemetery is always a big no no ..

Why buy one near a cemetery unless its sibeh cheap then maybe just maybe can consider depending on what kind of "cemetery view"..

Can afford to buy is one thing - next time want to sell also headache..

and the capital appreciation will be low in comparison..

competition for condos is getting stiffer by the day - plenty of choices out there..

i can see a way Ohako make a comeback for the money that the invested in this project. By sueing dobson for defamation. correct me if im wrong. the developer only consider mislead customer if they misrepresent their product. Since the cemetery is outside of the "product" scope so there is no element of misleading or deceptive. Unless when u ask the sales representative and they say that place is something other than cemetery. then only is consider misleading. Please have a solid ground when u saying a developer deceptive or misleading

buyer have to understand they have responsibility to do their own homework. If u are lose rm200 because of the cemetery take that as a lesson and not whining like a children

When talking to SA, they indeed misled customers. I remember being told by the SA that the reason this project is so cheap and nice is because this is the developer's first venture in Malaysia, but the truth it is cheap is because of the cemetary! Factoring the cemetary, this project is no longer cheap, it is just priced in.

When I say hide, I meant after it was discovered in April (weren't u the first person who shared the cemetery news?) they did not bother informing the potential purchasers who had placed the RM 5K booking.

As a Japanese company, they should be more "gentleman" and not keep pushing and chasing the potential purchasers to quickly apply for bank loan and settle the S&P as soon as possible in the hope that by the time the they find out about the cemetery, it will be too late.

If u dont dare then dont hide ur identity in forum. As you see from early of this thread im trying to let go my unit myself. But the way u act is over reacting. Please define cheap. It all depend on which project you benchmark against. you should blame yourself for asking the wrong question. You go to all property sales galery which salesman will tell their project expensive. they will say is vale for money and they will find alot of fact to make it sound worth every single sen u spend. If u really wan a developer to be so "gentlemen" then i think u should ask dobsonto start a new developer company because he seem to be keen to be too honest

Since everyone is kutuk-ing me like hell, please please please allow me to say something here.

To be fair to Marimo, the cerita about the cemetery only came about in April when Mr. hornbil_78 shared the information here in Lowyat.

Prior to that, everyone only knew about the small kuci Muslim cemetery opposite Tower B (not exactly opposite but somewhere there)

To me, O'hako is reasonably priced, not cheap. That's for sure. Reason being maybe its because its Marimo's first project in Malaysia.

Certainly not because of the cemetery or the STP.

In this aspect, my opinions differ from Mr. value_investor

Chop!!! This is not the first time I am saying something neutral.

I did mention before in one of my previous posts, the pros and cons of O'hako (in my personal opinion)

If this project was not good, I won't have placed the RM 5K booking myself. Unfortunately I had to pull out because of the cemetery. I am not sore because of the RM 200 sir.
I gladly signed on the stakeholder's letter so to burn the RM 200 is tarak hal smile.gif

Then again, thanks for the advice and info Mr. winsonlee888. Maybe I should not say any more negative things after this.

I will just share as general knowledge.

You need to go from the jalan belakang, along the Klang river.

By the way, are you aware that there is a 15 acre muslim cemetery across the Klang river.fyi only biggrin.gif

Well for property investors i suggest you look at 188 suites (ex Fraser Residence). It was near a cemetery. The subsale prices now is going lower than the initial launch prices 3 years ago.

I think this project might suffer from same fate.

Another good thing is according to HDA you have a right to reject the property if completion is less than 50%. THe developer will have to pay you back

Cheap or not is not by looking at the price, but also this be to look at the size of the unit, concept, and density... My 2 c... Lol... Have cemetery definitely will affect your chances to let go in the future no matter what. But if you intend to stay until u r gone from this world, well... No need to think lor.

Based on the layout, if your unit is facing internal swimming pool view, it won't direct see the huge cemetery view right?
(P/S: Do not choose the corner unit on top of the block should be okay)

Be honest...I had visited the site a few times as before that when we got to know the proposed cemetery...my galf ask me to give up this project as she thought the mentioned new proposed cemetery is just beside the condo...but after we make a site visit...she totally changed her mind and ask me to continue no give up....haha....that is why I am still here.... rolleyes.gif

My last visit to their sales gallery as on yesterday....I think should be around 60%....and quite a lot of people going to their sneak preview after they obtained their APDL with advertisement in newspaper...so the latest one I have no idea...you may check with their sales persons...as I just stay there awhile with other buyers...

After so many months investigation and did a lot of homework and also going to site and their sales gallery for a few rounds to understand every aspects...last Saturday me and my galf got a clear picture about this Ohako and just hopefully for loan approval...den can sign snp close case...

Logically speaking, I believe many still don't know about the cemetery.

A friend of mine went yesterday, was speaking to an old uncle which placed the RM 5,000 booking. As expected, he did not know about it as well. All he knew was the STP and the smaller Muslim cemetery nearer to Tower B & Koi Kinrara smile.gif

During last Saturday...I managed to spoke with some walk in visitors...we have some communication and discussion...

after they noticed me as buyer...then asked me a lot questions....I just try my best to answer and given my opinions and comments...including the mentioned new proposed cemetery which opposite the klang river...some get to know after me...of course they are very lucky as I did a lot of survey and site visit...so just told them my views...

Some visitors said got to know from forum but they think is not an issue as they noticed it was opposite river and not direct facing as well...so not an issue according to them...

Depending on which side Mr. yck1987

I believe if you choose the left side of Tower A's pool view should be OK.

To me, only Tower B Sunway facing units are the safest bet. Followed by Tower A's Pool View, left side units.

This is of course provided, the purchase does not pantang living 200 metres away from a 15 acre Muslim cemetery

Haha, i really prefer stay near to cemetery rather then the bloody jam highway and bloody expensive toll....

plus Muslim cemetery will not have heavy smoke like others cemetery...

How sure the bridge to cross over to Taylor's lakeside will materialised? I know since Koi Kinrara still under construction for 1st phase, they already sell this point. But it's just 'proposed'... until today nothing yet.

Stay in Cheras/Selayang/Kepong/Serdang, work in KL ...
Stay in Shah Alam, work in PJ/Subang/USJ ...

one may prefer puchong, maybe there are 'something' in puchong that a personnel is not able to find it in other places like pj/usj...
one may prefer pj, as the access is very good, but for those nested in puchong for years alraedy won't be saying pj is better, let's go and stay there..

have to agree. one thing i do think is, when one get used to one area, it's very easy to stay there and get to know the "toll-less" road to other area.

toll-less might not be the smartest though......

Just to add some update what happened at ohako sales gallery. Today, they stopped selling block B, Mr John (the boss) was having discussion with a big Tao ke, seems like that Tao ke want to da bao all unit left in block B (not confirm, just heard from air).

Slowpoke a bit but still have to say, they mentioned the cemetery black and white in their information kit.

Ohako is a good buy.

If I were to share this, people will say I sabotage again.

A few of my friends went to sign the S&P, both Saturday and Sunday.

* Please note that my friends are investors hence they are aware about cemetery and don't give a damn about it.

But just to test how genuine and sincere John Taro was, they decided to tekan and stretch the SA to the max.

Personal opinion, if the developer/ SA did mention the cemetery(size/distance) to the buyer/potential buyer, then is consider fair play jor. Then the buyer should consider themselves whether to buy or skip.

It will depends on the buyer whether want to "dig" for further info from the SA. After all, it is impossible to ask the SA non stop mention on the cemetery part.

For eg, where ever SA mentioned the cemetery part and the buyer dont really mind or care bout it. Then impossible the SA will cont tell them :Cemetery wor!! kubur wor!! tombstone wor!!

If they did this, i m sure gt fired instantly haha. my 2cents

1. That so-called towkay that people claim is buying over Tower B does not exist. The guy that was in 'deep discussion' with John Taro was actually one of the bosses of the main real estate agency selling the project. I am unable to find a photo of this 'towkay' online, else I will post.

How sure are we that John Taro wont selit/put something else in the middle of the SPA since its not initialed by the purchaser? Don't you think this is very suspicious? Why is there a need to do such a thing in the first place? Does that even give you confidence at all? Only the newbies who don't know about such arrangements will bodoh-bodoh just follow what the lawyer said and sign on the last page etc.

My friends who reluctantly signed the SPA, forced the lawyer to make a copy of the SPA.

If this is the case, I the lawyer/law firm is also culpable.

Perhaps purchasers should report this to the Bar Council, after that see if the law firm is still willing to defend/stand by our friend.

Initial each page of the SPA just common practice in industry no legal right in behind.
Important get the document stamping and makesure the project is under HDA protect.

You missed an important point ( to highlight). From the point of SPA signed to the point it is stamped, they are in the hands of the SPA lawyer which are inclined to the developer. If they are not initialed on every page, then the question of tampering SPA could arise.

That's why one buyer ask for a photo copy. Presumably he will check every word of the stamped SPA again when received. LOL.

Pesky SAs told my friends who bought that the finalized version of the SPA will be provided later.

Meaning to say this stupid copy that they sign is only a draft. Then sign for what???
First time I hear such things, developer ask purchaser bring balance of down payment only to sign a draft copy of SPA.

Subject to changes! Else why would our good friend not allow the purchasers to initial on every page.

Like I said, what game is he playing here?

What legal action you can take if the developer tamper the document later even you initial each pages of the SPA my view it just go back to HDA procedure.

First time i heard SPA lawyer not allow to initial every-page... interesting...

and IF they are using HDA format SPA then there is nothing to hide, so why can't get a copy? (if want to use GREEN way then can scan and email) Also interesting....

2 month got another SPA? Maybe is the newbie SA giving the wrong info only...

Photocopy costs money. Scanning also costs money. The lawyer can't charge this to the developer perhaps, so both scanning and printing are not allowed.

2 months get another SPA is probably 2 months to get the stamped copy.

but maybe is from those so call 'experienced staff' / 'adviser' / 'professional marketing agency' ...

Btw, please check this SPA is under HDA protection or not.

Really didn't have any reason to do another SPA in 2 month later since they already get the APDL that can sign the SPA immediately.
IF they collected 10%, they have to bank in the payment (and all other payment related to SPA price) they collect to HDA account.
Withdraw from HDA account have to follow T&C and the banked-in amount should tally with the report on unit they sold...
plus now KPKT asking developer to send the HDA account statement on monthly basis, so they should easily to trace if the HDA account got any problem...

Saw you are asking this case in property Q&A sub-forum, really do homework before shooting ah.... brows.gif

The reason is very obvious. Think everyone! Think!

Otherwise why would he suddenly ask purchasers to come and sign SPA and only to tell them that it is DRAFT, cannot initial on each page bla bla bla.

A lot of first time buyers apparently, thats why they bodoh2 sign as per lawyers instruction. Not knowing that they are required to initial on every single page in the SPA.

The one's complaining are the seasoned purchasers or those who are buying their 2nd property.

My million dollar question is this :-

How come the lawyers are willing to do this even though they know this is not right? 知法犯法!!!


My friends made inquiries with the Bar Council, and they were advised to report this incident. They gladly did.

Some "hot" selling projects may ask buyers to sign Draft SPA simply because they want to LOCK IN the sales as early as possible.

However, all these practice is unethical and is wrong as far as legal professional code of conduct and HDA are concerned.

I am still quite puzzled. What is the need for draft ?

Many developers just lock in the buyers by giving them the actual SPA but just delay in getting them stamped, 3 months or 6 months or whatever.

Because they want to only stamp the SPA until they got enough buyers. Otherwise they will be very stressed by cash flow problem.

So why draft ? Just not making sense.

Actually layout plan and carpark location is ok to amend under HDA SPA (just said is under authority requirement will do)...
And they also can delay on stamping (if they didn't want to touch payment under HDA account),
so there really didn't have reason to sign such draft SPA...

They can modify the layout and they probably are thinking going to modify it, that's why they don't want you to initial on it. Because if you initial all pages and then they suddenly change the layout, then the changed copy will not have initial. If you don't initial any pages, then they are free to change. That's what I mean.

I know this is slightly out of topic but I guess would benefit the buyers on this property as well seeing how shady the process is..been following this thread closely especially about signing S&P. I'm about to buy my second property but still a bit clueless about what I should really look out for in the agreement other than a few important things such as,

You need to aware on Adjustment rate that will determine penalty by developer in case the actual built up smaller then SPA...

Completion date actually is follow by HDA, developer can't change it unless got approval from MOH.
So you should know it before buying and no point make noise upon signing since you only got option by sign or not sign...

With regards to the Sales & Purchase Agreement (SPA) signing for O'hako, we will be having an Question & Answer session on the 7th & 14th of November 2015.

Both Marimo Land Sdn. Bhd. (MLSB)'s solicitors Pretam, Nor & Co. & purchaser's solicitors Michael Chen & Co. and Iqbal Hakim, Sia & Voo will be present during these 2 days.

During these two days, all pages of the SPA will be initialed accordingly.

Purchasers will be required to sign by the 8th of November.
Both MLSB & its solicitors will sign on the 9th of November.
The SPA stamping process will start on the 12th of November in batches. Purchasers will receive a of the stamped SPA.

MLSB's solicitors, Pretam, Nor & Co.will be present during these 2 days.

Generally, since the Sales and Purchase Agreement (SPA) is a standard agreement under Schedule H of the HOUSING DEVELOPMENT (CONTROL AND LICENSING) REGULATIONS 1989, many purchasers do not want to, and do not have to initial all of the pages.

However, if there is a purchaser who wishes to sign all of the pages, then arrangements can be made with the purchaser's lawyers to assist him in signing all of the pages.

firstly if developer explain well during the s&p signing i think outsider will not even stand a chance to 'over react'.
secondly developer should already be prepared with explainer onsite, or maybe developer trying to highlight they are not well understood the procedure in MY, this lead to thirdly.
thirdly if developer does not understand the MY style, how are they going to do sale ?

If during the signing of the SPA... Developer explain to the purchaser, do you think the purchaser will accept?You wanna take purchaser's money but yet only give bloody draft?
Why cant you finalize everything only ask purchaser to come and sign on the dotted line? Waste of time aye?

From what I know, they were chasing the purchasers to quickly come sign the SPA, of course with the 2.2% rebate CARROT.
If you are purchaser, won't you be angry? You chase me like hell to come sign SPA, promise me 2.2% rebate. Then during signing, I find out its only a draft copy. Don't you feel cheated? please please please dont tell me there is no element of deceit here?

Draft SPA is an internal matter. If its not ready, why inform purchasers the SPA is ready for execution? When you involve the purchaser, it should be a final version.one and only.
When you buy a car and sign on the dotted line, is there such thing as a draft?


Thirdly,
I don't think this is about Malaysian style, South African style or Japonais style.
This is basic common sense la.
Finalize your agreements / documents then only get purchasers to sign.
Not ask them to come pay, sign only to find out that it is draft!
Or, at least inform them first before them come. Let them know that the copy they are signing is only a draft as developer is still finalizing. That way people feel confident and secured.

Not call the whole world to quickly come sign the S&P...only to find out that they are not allowed to initial on each page.

I don't think its Marimo Japan's fault. If it is, they won't have successfully completed so many projects.
To me, the issue lies with Marimo Malaysia's management. No one else.

I say allegation coz I'm just hearing from u, I don't know which is fact. U could be right, but they too could be not wrong. Maybe it's misunderstanding?

Everything also must listen from both side then only easier to judge. But after following the update and knowing they reveal and not hide stuff, it is a very commendable move by the developer. Benefit of the doubt yo!

But kudos to u for raising it up. I always like stuff like that, like we need a strong opposition then only govt can improve smile.gif

you do know that they did not inform purchasers before hand that the SPA is draft copy. if this is not considered hiding, then i don't know what is.

please bear in mind that, its only after all this complaints/grumblings that the developer decided to buka mulut.

otherwise they just keep quiet and expect the purchasers to go along with their game.

if you tell me they pre-inform the purchasers before they come to sign SPA, then itu baru kira commendable. gua respek sama lu brader!

the fact is, they only ask purchasers to sign SPA by a certain date to enjoy the 2.2% special rebate.
purchasers only got to know that the SPA is a draft on the day they come with the balance of the down payment. before come duno, after come only know.
