i'm not happy with the police decision. After explaining to him, he told me is still my fault. Is the police always the final decision saying?

Situation: A car knock into my car 30sec later after I cut into the lane. The best part is the driver steer to the right to knock my car making it look that I am at fault.

Now the person who knock my car want to use the police report to claim my insurance. Is his words against my words, and yet the police trust him. Someone from behind knock my car and end up being my fault.

Will my insurance solely base from the police's decision? I'm contacting my insurance, but not sure what are the procedure to dispute this.

Hi, recently i got into an accident. Both parties made police report on the day itself (12 JULY). But Sarjan said 17 July only take salinan repot polis. May i know if it usually take this long? Because now become both our cars unable to start repair without the salinan repot polis.zz

After 3 month long battle with insurance at last they reinstated back my ncd even after they open standby file. As long as no injury claim make by motorcycle

To your guys that have been bang by motorcycle and not your fault you can claim your insurance 1st and ask your insurance change to tppd(claim from motorcycle insurance) and pressure them to reinstate ncd back. My adjuster meet me and lucky i ask him about this..at 1st i want give up and accept ncd lost than my adjuster advice me to call my insurance and ask them to claim back from motorcycle insurance and reinstate back ncd.i did shot them at fb before they call me back and promise to give my ncd. You can also claim loss of use from motorcycle insurance

Do anyone know how can I dispute my police saman to court, like what are the procedures?

Don't pay the saman

Once you fail to pay within certain period, court will issue subpoena to you to attend hearing to explain yourself

Go to court and explain yourself to Magistrates (lower court judge) with necessary evidence (dash cam, witness, photos...)

Be humble and polite and pray that Magistrates buy your explaination

Unfortunately I don’t have evidence (dashcam), the photo also is just the damage part. In the police statement it is between my words against the 3rd party, and the police side the 3rd party story.

Also want to ask, my wife is in the car with me. Can my wife be my witness or usually is just me to explain myself to the judge? Thanks!

It depends on the magistrates availability

Due to MCO, a lot of cases got pile up

Those traffic case is consider least important and will only go on at last in queue

You can ask your wife to standby as witness

Again, it depend on magistrates. Some willing to let you and witness explain, some already decide even before you come to court

Just wear decently and present your case politely and let the magistrate know that you merely want to explain your case and will accept magistrates decision full hearted no matter

The 3rd party car hit my behind and there no rear dashcam. Somehow the story turns up I cut on his lane instead and cause him not able to break in time and bang my car. The report turns out that the police conclude is my fault and tell me if I’m not happy go court then.

In a case of accident, can I keep quiet and only say something when police arrived or we go to police station ?

Like if the person who bang me and he/she is in the wrong say do I have dash cam, I just keep quiet and say will answer when police arrive / or we are in the station.

Only proper interview given to police will consider as evidence

You can see during proper interview, police will hold a small notebook at scribble on it

So be mindful cause whatever he scribble during interview, will be use against or benefits you
