My car was hit by a car at the back On the 29/8 while waiting at a junction. My bumper needs to be replaced and his car had his bonnet dented. The person and I immediately went to the police station to make a police report. While waiting to make police report, he told the police that he will come back later As he had to do something.
I have waited and made my police report. Also submitted my claim to Honda with the Honda Insurance. Claim all approved and car should be ready next week.

However I was just told by Honda workshop that the person did not make a police report. So according to him the investigation is not complete until he makes a report.

I understand that if he don’t make a police report, I cannot claim his insurance and I will lose the NCB. I’ve had checked and his car has a valid insurance.

I have Dashcam evidence and also the photo of his car.

What are my options now?

Push for the sarjan to issue police investigation outcome (ensure he saman the other guy)

Use that to bargain with the insurance company

Some insurance company will allow you to claim under OD no fault claim where NCD will be retain

your NCB will be gone temporary until you are able to submit the "kuputusan & lakaran" to your insurance company AND your insurance company gets to claim from the other person's insurance.

Wish u luck. Keputusan should be in 14 days from you first meet the sarjan. Contact the case sarjan to know more.

With the evidence, you can still claim without affecting your NCB even though other party didn't make a police report. I was a victim of hit and run, but lucky my car dashcam caught it.

But have to do additional steps, where you need to go to the commissioner of oath to get some documents stamped. What you need to bring there is:

1. Your police report (with pictures etc)
2. The police decision that you are right, the other party wrong
3. IC
4. (if able) the other party's insurance details. Usually, anyone in the car insurance line can help you get the info.

Get the commisioner of oath to stamp, then bring it to Honda. Ask to see the person in charge of claims.

Hi

want to ask , just got banged behind my car recently, he admitted his fault , we both had made the police report. Sarjan was not there when we made the report so the police told to wait for call.

Should I just wait or go and try see the sarjan?

Also I have Allianz as my insurance , can I go to perodua SC to to fix my car? My car is 3 years old. I should be able to claim for OD-KFK right?

Usually workshop people will get it for you

Just got told by the officer , he said just come to the kaunter , no need to wait for sarjan. Then go claim insurance laugh.gif

Hi guys, my car just got hit from behind by a motorcyclist on MRR2 Sri Gombak near Batu Caves. The cyclist slipped and fell while I was stationary in a traffic jam.

He is ok at the scene and agree to settle with me after. So I left the scene and came home. Now people are advising me to make a report with my Dashcam footage to safeguard myself. So my question is should I make the report? And which police station should I report it to? Is it the one at Jalan Bandar?

My next question would be is there anyway for me to prevent losing my car's NCD if the keputusan shows that I'm in the right since this involves a motorcycle? Thanks!

NCD means No Claim Discount.

Biker can make a claim even if you think he is as fault, it is up to the judge to decide

During that process, insurance company will hire lawyer for you and incurred cost

Even if judge dismiss the claim (which is less then 0.01%), the fact that insurance company spend money to defend you, cost is incurred

So once the biker file a claim, your NCD is gone

They can't (typo) deny due to the law

Insurance company can only resist the claim

Claimant will bring the case to court and let judge decide

And you need to testify infront of judge to convince him that you are not at fault

From my perspective as a personal injury lawyer, whatever the outcome of the investigation results the judge is still entitled to decide on the liability based on his findings, the investigation results will only aid in favour of one party if any, however rest assured your insurance will find their panel lawyers to defend against/resist any third party claim made by the biker.

Make sure you keep the original memory card in case you need to testify in court

You need to present the original memory card as evident

Need some advice..
My car was hit in the condo carpark by my neighbour. He admitted it and we went to fix it at the workshop he suggested. Midway of fixing, he left and said he will come back to pay. But after the repairs were done, he didnt come back and asked me to settle first. It was my fault to believe he will pay me back because after more than 1 week now, he still havent paid me back.

Any advice?
