Please read the main post, already stated how to proceed with this scenario

A : Yes. Apart from normal documents like police report and Police Investigation Result(must show third party compounded for traffic offences), you need to sign statutory declaration(SD) to affirm how the accident occurred. SD can be done through commissioner of oath.

Been involved in an accident in August, my car hit a motor and the motor driver injured, as usual the motorist claim insurance..my insurance company lawyer said will need to attend a court later on..what would be the next procedure? Do i need to pay anything like court fee, lawyer fee, etc.. I'm worrying like hell everyday

From police station, issued by the police in charge

Name of police in charge will be stated in your police report

You need to take initiative to persuade him to issue result or else they just buat bodoh

Nope, insurance company will pay everything

Include if your lawyer lose the case, the amount you need to pay to biker

nothing happen

will just go down with the car

upon declaring total loss, only the physical car belongs to the insurance company

Q on driver not named in schedule.

1. As long as they are qualified, I'll just need to pay RM400 excess for damage to my car, right?

2. If i don't claim damage on my car but only have to pay compensation to the other party (say, hit a pedestrian), will it matter if the driver is not named in my policy schedule?

3. If there is a new driver (probation period), I don't have to bother including her name in my policy, right? Afterall, still kena pay the RM400 excess.

4. Is it the same situation if my car is driven by a workshop worker (say, tyre alignment or normal test drive after repairs)?

1. Yes if you intend to make an OD claim

2. No. Unnamed driver only affect you (pay RM400) if you intend to do an OD claim

3. Yes

4. Yes. But workshop worker is by law required to hang a trade plate when they test drive your car. Hence if any accident happen, it will be claim against the workshop and not your car

Thank you for your clarification. Didn't realise a trade plate is required in Q4 to claim from workshop insurance. I wonder if any independent workshop has trade plates.

My question is there anyway to prevent the front car to claim my insurance since is not my fault and instead claim the insurance from the car that hit me?

Sandwich accident usually the last car kena claim/lose NCD...

Last time I was the 3rd car in a 4 car pileup... didnt lose my NCD

nope, filling the claim is a right and you can't take it away

whether to allow it depends on the claim officer or judge(if file in court)

what you can do is obtain a copy of siasatan police which stated the car at back at fault

in the event you found out your NCB hilang, you call the claim officer and argue with them, insist them to restore your NCD since siasatan police shows car at back is at fault

but usually in chain collision, car at the back will be the one at fault and insurance company/lawyer/workshop will automatically claim against the last car

While turning my car, I hit a pole and there is a minor dent near the door. Can I claim under insurance? This happened 8months before, can I claim now? Thanks

sometimes the insurance try to take advantage.

Initially i found out Allianz void my NCD... until I went to their office and make a fuss.. then the officer apologize say he entered the "wrong claim code" what a load of BS...
