Hi wanna ask.
My car was hit inside condo compound.
Now checking CCTV camera. High chances can get the car number.

My question is, if I file police report, can I claim the other party that hit me?

Hi.. need advice..

My car got knocked by someone and he admitted it's his fault.. both of us already lodged police report so I can claim his insurance for my damages..

from what I've read on the forum, I should be able to claim under OD-KFK, without impacting my NCD.. but weird thing is, my insurance agent is telling me that for my next insurance payment, I will need to pay insurance amount in full (without NCD), and the insurance company will rebate back? I'm a bit concerned because it kind of means that my NCD is affected..

anyone here faced the same thing before while claiming OD-KFK?

thanks in advance for any advice..

most likely they did a OD claim instead of OD-KFK

best you could do is to call the insurance company up and ask why did they took back the NCD (most insurance company has dedicated hotline for NCD enquiry)

never trust agent or workshop word fully unless you are given official written confirmation

Hi, just asking if my friend is driving her brother's car and ran into a minor accident with a motorcyclist. Now the motorcyclist is claiming for RM700 (for medical fee & motorcycle damage). Can he?

Both of them have yet to make police report.

Is it better to make police report so that the motorcyclist would not able to simply claim rm700?

But will there be an issue since my friend is not the car owner?

And what if the motorcyclist intended to claim for insurance? But my friend is not the car onwer.

you can't stop anyone from making claim against insurance once they prove collision occurred

filling claim and successful claiming are 2 different things

in order to successfully claim, you need to further proof that
1. the other party is at fault
2. you have documents to proof your claim (medical report, medical bill, repair bill...)

I am assuming biker is asking RM700 directly from the driver

So the next question is, if you pay him RM700, can he still claim against your insurance?

The answer is Yes

My suggestion is to lodge a police report, go as detail as possible, like rider ethnicity, sex, age (estimate), bike model, bike colour... but leave out the plate number

By doing this way, you will avoid kena compound for late reporting in the event the biker decided to lodge police report against you

Once you confirm the biker has lodge report against you, all you need to do is to lodge additional police report to add on the bike plate number

unless you confident you are not at fault

the purpose of leaving out the plate number is to avoid police investigate the case further

police can't issue compound(saman) without full investigation

and police tend to side the injured party

This is a serious reply, this comes before any insurance claim, and not meant to be racist whatsoever, but this is gathered from my peers that are tired and old. And experienced.

If you get into an accident, you might think of settling for an amount right on the spot, especially if it's a relatively minor matter, and you both agree to not report to the police and go about your days. This happens in a lot of semi-rural areas in Malaysia.

My advice is, and when I say this I guess the advice of my multitude of peers is: REPORT TO THE POLICE NO MATTER WHAT. Especially if you are um... how do I put this. If you're not of the same skin color. I have heard many cases where they "kena". The motorist was in the wrong, bang, stop, they both settle and agree it's minor and no need to report police, and just when the fellow went back to his job or business working, the other fellow went behind his back and reported to the police. In the end there was a court hearing and they bite and clamp on the fact that the fellow didn't report to the police and was "avoiding the law" and he was ordered to pay WAY more than he would've even if he was saman-ed if the police took the motorist's side after a police report. The innocent fellow paid and the real offender laughed right to the bank.

It was found time and again these reckless drivers were from very "new" rural areas that didn't know shit about driving etiquette, moreover the law. Who do you think told them to do what they did?

Welcome to Malaysia. Especially if you are from Sabah like my peers are.

I'm sorry if I sound racist or anything but this is just how things are and we're mostly at the receiving end of it so take this however you wish. But be calm, and take as many pictures and videos as you can if you can. It'll help a lot. Good luck.

1. lodge police report & get a favourable police investigation outcome
2. send car to panel workshop
3. tell workshop you want to do od-kfk
4. workshop will find out whether the other party is insured under comprehensive policy
5. if yes, will fix under od-kfk
6. if no, then you have either the option to do TPPD or OD
