RM50 for the cpu? OOhh i know where that number come from hehehe (/me poke guilty party) but RM50 for the cpu i guess is a fair deal. Since it is not likely he is gonna break his sets of mobo/cpu to give u another. Ur ram ppl r selling from RM15 to RM40. N the mobo should not be more than RM50.

SO taking RM50 for the cpu well its better than none i guess...

4. I received the goods. Great. I will test it in weekend. But hell, Irritating message came in. Example " if you dont do i will what what what la." "you becareful, watch out la.....this la that la..", "I will call u non stop everyday". Hello....please be mature....You are this 1st kind of people I am dealing since...........10 years ago i think...primary time.....

5. Why cant he wait? Why cant he polite? Do you think I will entertain this kind of people with full hearted?

Finally,
I have the right not to refund him. Well, I check the procs and it does not work. So I message him about the warranty. He is proud and ignorance attitude. Since he refuse the offer. I already made up the decision not to provide any alternative the this person.

hi guys, been following this issue from page 1 till now.
IMHO, EPN is right in some parts, but not all. if his point 4 is true, then what will you react in this kind of situation? dealing with impatient people? harass you with non stop call everyday? oh gosh, this is absurd.

his reputation now is kinda wrecked already, and have to fork out rm50 more to cover Avenger's losses.
if his packing style causes the item to malfunction, then why there arent any other customers lodge complaint here since he deals with many others?

overpriced item? not for you all forumers to judge. its an agreement made between seller and the buyer. if the buyer doesnt think its overpriced, then is it not overpriced.
just like rich people buying designer brands.

As for being a businessman? I think u should look long n hard, Espionage. Because apparently u dont know the word. Only kind of businessman i think of r local ethic stereotypes to discribe ur practices but it's definately not how international or even national businesses deal with ppl n products (expect for those idiots running Streamyx). Even most home grown shops treat their buyers with better repect.

Fact one of ur lack of business knowledge:

His item (cpu) has to be returned within the warranty period of 7 days starting on the day he receives the items(state by u on ur warranty covering cpu, mobo, ram).

U did not state ur return policy either only after the sell of the item with warranty was being claimed.

That means ur warranty is illegal because it has a catch 22 for the 7th day since he is most unlikely (poslaju) to be able to return it that day.

Warranty means that said item is in working condition and that the time given is used for inspection of that item for defects. If ur return policy conflicts with ur warranty given than u're issuing an illegal warranty.

Fact two:

He notified u that the item was unacceptable within that warranty period (day 1 of his warranty).

U accept fault was caused was not by him thus accepting his warranty claim. Therefore the item was defective when it reached his hands. That means u must replace or refund the item other u commit a Breach of warranty.

***For example, a consumer buys an item that was discovered to be broken or missing pieces before it was even taken out of the package (item was damaged or already defective before use). This is a defective product and can be returned to the seller for refund or replacement, regardless of what the seller's "returns policy" might state (with limited exceptions for second-hand or "as is" sales), even if the problem wasn't discovered until after the "extended warranty" expired.***

U stated ur return policy to be within the warranty period. Again, u have issued an illegal warranty.

What this all means is that Espionage either does not have a warranty at all or really he is issuing illegal warranties (warranties that he can break anytime).

Hi, I'm not a businessman, I'm only a consumer, but I understand that customer is always right, as a businessman, customer is your boss, you shouldn't critic your customer just because you have a bad experience with him. This is my opinion from the consumer point. No offense from me.

I might not be in a position of a businessmen, but hopefully my experience as a part time computer parts seller can show you how the ethical businessmen do it.

Speaking about warranty, there was this seller once bought a CRT monitor, and entitled to 1 on 1 exchange for 7 days from day of purchase. On the 6th day, he called, complaining got problem all that, and ask whether he can come next week to check or not. that time I n00b in the shop's policy so I ask my boss lor, so he say okay lor, get down his receipt number, name and faulty item. I think 1 1/2 weeks later only he come. I go ask boss again, boss say change only since item was reported faulty within warranty period. So if he can apply such policy, why not you?

Regarding fact 4 & 5
Like it or not, in the business world, no matter how rude a customer are, if they're entitled for a refund, then give them. Working in a computer store, you sometimes do have customers coming to your shop shouting "f*cker why this PSU cannot work you all never test arr before selling you stupid #$%^&* ". But still, buyer has a faulty PSU, rude or not, we have sold him a faulty item, therefore we have to replace for him. We can't just tell the customer "You very rude la...I dowan change for you".

Of course, I'm merely an employee... I do not set this policies, so if I'm not worthy to comment, forgive me. I just hope some of this real life business experience might help. All policies above is made by my boss. Maybe because we have tight competition from rival stores that's why my boss focus on customer service to attract buyers.

Since u saying u r a Profesional Business man(& u r proud of it)..I have to admint that u did nothing wrong in the trade with avenger(send the stuff next day, give warranty 7 days & blah blah...).

But when doing the packaging, u act like an idoit wthout logic thinking..How would anybody pack their " Proc+HSF with mobo " together & send through POS LAJU?
Did u provide receipt or any documet to avenger state that the warranty was 7 days, the total price &...U r just simple a pasar malam ah pek selling his proc+mobo+ram...
A pro business man will settle this case wisely, not like how impatient u r.... sweat.gif
I suggest u goto ebay to do ur pro business... thumbup.gif

Let me type out the sms i sent to him (normally i sent only things like "are you there?", ,but this 1 is a bit different?)

Date : 12/10/2006
Time : 12.00 am
(since i send him sms at midnight, he got whole day to reply me via sms)
Message : "Why you never give me any answer? Pretend deaf there? Everyday I will give you a call until you give me answer, no matter online or sms."

does this considered harass? no, i was looking for answer. same thing goes to shop customer service. I dont get reply that i want, i can go continuously call until shop ppl know my voice. nothing wrong.

True, the price agreed upon is none of our business, but you're indirectly quoting what I said in my post earlier. You have obviously taken it out of context. Had you read it properly, I said that the seller "should feel gratified" that the buyer is actually willing to fork out extra for the items. THAT is the point, not the money.

I don't believe this is about money, it is about goodwill. The buyer is already paying extra, and the seller can't even give 2 days grace period? What about the fact that the items originally put on sale are not the items agreed upon (128MB vs 64MB RAM), without any discount? Added to that, the buyer DID notify the seller about the problem on the second day, well within the warranty period. Come on!

Espionage, you keep complaining about Avenger harassing you everyday. By the looks of it, he won't stop. So, just accept your losses, offer him a better refund and have peace of mind. Your reputation is already thrashed, do you want your sanity to go down the drain too?

im started to think of different situation here... just my curiosity.... i think that the processor was earlier faulty n espionage knows bout it n sell the item to avanger..... in da package... u makes it lie da postman did the damage...... theres no other reason to include da HSF together with the mobo unless u want to make damage to it... only a dumb do such a thing....... now he's defending himself with 7 days warranty..... dont u guys see that he's trying to make his concase into 7 days warranty problem.....

haha, dont simply say ppl selling the faulty item.. we dono either the seller sell the faulty item, the items shiping in shipping, or other reasons.
i think the seller should refund him or exchange a new cpu to the buyer.
for me, i will refund juz because the buyer found out the item faulty after received it.

sunday got post office meh ? if sunday u post, the parcel just process on monday, and the seller should received it after tuesday

I beg to differ, I sent my own used proc + mobo + hsf ONLY together, never seperate them.
Especially for socket A platform, as too many buyers don't have the proper skill to install the heatsink correctly.
This is a fool proof solution for both parties FYI.

I think I had sent more than 20 parcels with this way and no complaint so far.

So u said this seller is idiot, indirectly also said me and other seller sent the parcels with the same way also idiot isn't it? doh.gif

So same goes to PC manufacturers also lah? MUST remove the hsf from PC and ask the end user to do the job? Well very logical thinking eh doh.gif
