Yes agree with amint. The appartment overall looks nice my unit also with minimal defect.
The issue is the handover to purchaser before complete. I don't know how is block A condition. But for block B definitely "feel" not completed.. Workers all over the place still fixing the unit still not handed over.. Cement and dust everywhere.. The service lift and garbage area with urine smell. I'm moving in soon.. Rumah sewa already declare to owner sept last month.. That's why la really worry and piss off |

From my SPA, clause 27, it is stated that the Vendor (developer) fails to complete the common facilities in time (36 months) the Vendor shall pay immediately to the Purchaser liquidated damages to be calculated from day to day at the rate of 10% of the last 20% of the Purchase Price.
The time stated in the SPA is 36 months from the date of the SPA and not upon VP. Is everyone's clause 27 the same as mine? |

Further, cause of action to claim liquidated damages shall accrue on the date the Developer complete the common facilities.
So we still have plenty of time to gather more buyers. |

1. should protest to pay maintenance
2. write a letter as owner of elements to complain 3. demand compensation for the loss of utilization even after VP 4. demand a date for all to be completed or will seek authority's help but before we can do all that, we need to have a JMB. if not, then not strong enough. |

Cheryl_Mummy, count me in please. I am so disappointed with the hand over. lot defect, and can say major facility not ready and still dare to collect maintenance fees!!! Let's do something about this. can claim or not is not the main thing.. the main thing is we have to show the owner power.!!

you need to form a committee first before appoint your JMB. Amint for the chair man.
Yes, all common area and facilities as listed in SPA must VP together with building unit. All else, LAD the developer up to 10% of SPA value. Developer must honor every single details in SPA. SPA is your right! Team up and all the best! |
