Submitted my Borang BE on March 2011. Supposingly there should be few hundred refund I can get. However, I just got a letter last week, saying that "akaun tuan tidak menunjukkan apa-apa baki kredit yang boleh dibayar balik"..
Past few years I also able to get the refund, just that this yr I receive such a letter...
Shall I visit / call / email and request them to check for it?

If I was u, then I will check the tax file.

1). If the net outcome is, I earned (i.e. IRB calculated wrongly and I untung), then I will close my eyes and bank in the "tax credit".

2). If the net outcome is less than RM 1000 (whether earned or lost), then I will close my eyes.

3). If the net outcome is, I lost over RM 1000.00, then I will inform IRB (this also depend on situation whether it is worthwhile to do so).

Since it is IRB making mistake, let them to settle the problem themselves if it is outcome (1) and (2) above.

im not sure about the PCB, but they asked me to open an account first, which i did (e-filing).
so, do i have to do PCB or i just can submit my file manually every April?
*
If u have tax file number, u need to give the tax file number to u employer. Then u just sit down and rest, u don't have to worry anymore.

It is the duty of your employer to deduct (PCB). Whether they (employer) do it or not, u don't have to worry, because u are nothing wrong in tax law.

In fact, I really don't like my employer to do PCB for me, because I don't need to worry about my tax credit. FYI, If u want to claim back tax credit, u need to bring in all sort of prove, receipt and sometime to might got into trouble if u mis-do u Borong B/BE!

I changed job on January and my ex-company HR don't know submitted what form to LHDN. End up I had been requested to submit the Borang BE directly to the Jln Duta branch. The officer did asked me to bring along all original receipts for her checking. Therefore, I am 100% confirmed I had declared all thing correctly.

Well, if they want to check back few yrs ago records.. then that a problem.. I need to dig for all the receipts...
*
When I was audited once by LHDN, I brought along 3-5 years receipts, etc.
They did check my 3 years declaration and when everything in order, they let me go in 20 minutes.

If you do not bring the past-years receipts, I'm not sure if they'll let you go, or will they request another date/time to ask you to bring those ? hmm.gif

If the forms are submitted in order, and does not raise alarm, then the individual will get back the tax credit (if any) automatically without the need to prove, or goto LHDN counter, or email/tel.

Definitely. Those are your money. Even my friend request back 20 cents, as it is his principle.

Not sure. Couple of months. The point is, he wants his 20 cents back from LHDN, even after wasting more time, tel bill, etc. than that.

Generally, the waiting is between 3-6 months. Anything more than that, the individual must follow up with LHDN to get it sorted out. Silence does not amount to LHDN acceptance. LHDN may still dig out the individual previous years declaration (up to 7 years) for audit purpose.

LHDN made it compulsory for company to make PCB, as there are a lot of people who do not submit their tax declaration.

Anyway, if LHDN really wants to audit you, they can easily recalculate backwards from your EPF contribution and/or BNM to check your banking/financials. Unless you do all in cash and keep it in pillow or under the bed. Remember the bungalow house that got affected by the land slide near Bukit Antarabangsa ? rm500k cash in house rolleyes.gif and no one audit them whistling.gif

Mine waited about 3.5 months. They send me a letter a few weeks after submitting my tax saying that it's under audit and if I do not hear from them in 3 months, I should contact them. So I contact them late June and got my cheque a few days later.

Hello,

I need some help regarding on income tax issues. I would be glad if somebody can explain my situation.
I'm an offshore contract worker which hired by Switzerland company and my salary in USD which transaction by Tele-Transfer from Switzerland to Malaysia Bank.
I don't pay income tax in Switzerland. and I dont pay tax in Malaysia also but recently I've register an Income tax account in Malaysia.
My question is, is it taxable on my income situation? As far as I know, earning foreign currency is not taxable right? But the officer in LHDN told me that I need to show prove that I've pay tax in Switzerland, so that I dont have to pay it again in Malaysia. So this really worries me, if i need to start pay tax in Malaysia.

Please help me to sort out this issues... thank you in advance... cheers~

Switzerland (personal) income tax rate 22.4-42.2%

I would guess you are sort of like a contract worker. Therefore, you may use the country where you reside when you are onshore. If you prefer to get taxed in Switzerland, then by all means declare there. Otherwise, declare back in Malaysia LHDN.

If you declare and pay in Switzerland, and you bring the money back into Malaysia (buy house, car, etc.) and get audited by LHDN, LHDN may require you to show proof of the tax you paid in Switzerland, otherwise LHDN will tax you again.
Double Taxation Agreeement

No matter where you work, even on the moon/ISS, your income is still taxable.

Refer attached "Explanatory Notes BE 2008.pdf", item D8C (page 6/12)

D8C PURCHASE OF SPORTS EQUIPMENT
QUOTE
An amount limited to a maximum of RM300 is deductible in respect of expenses expended
by the individual for the purchase of sports equipment for any sports activity as defined
under the Sports Development Act 1997. Sports equipment includes equipment with short
lifespan e.g. golf balls and shuttlecocks but excluding sports attire, e.g. swimsuits and
sports shoes.

Under the Sports Development Act 1997 (Act-576), these are regarded as sports:

Therefore, dumbbells and medicine balls are deductible.
Protein powder (food/water/nutritions) are not. Clothes, shoes, socks, belts, also cannot.

I'm trying to attach two PDFs into LYN, but always timed-out. You may refer the first doc here (post #2201)
The second doc is the Sports Development Act 1997 (can't upload here)
