unlock and jailbreak are 2 different thing. Why lots of lock phones owner waiting for jailbreak? because they need to jailbreak first to unlock it.

To jailbreak, it does not matter if your's are factory unlock or lock phones. If your phone comes preloaded with fw3.1 or OTB (Out of The Box), then you are out of luck in jailbreaking (only applies for 3Gs phones).

Why?
Becoz of the ECID and SHSH thing. To be able to jailbreak fw3.1, you must have the 3.0 @ 3.0.1 ECID and SHSH. If you grab the ECID and SHSH for 3.1, then you can only jailbreak fw3.1.x or 3.2 in the future.

bro if the 3gs was pwned in 3.0 and accidentally updated to 3.1 can this new pwnage tool work to jailbreak the 3gs?

The RED BOLDED sentence should answer your question. It's only for Pwned 3.0 or 3.0.1 3Gs. If you already upgrade to 3.1 then you are out of luck unless you stored your ECID and SHSH when you were in 3.0 or 3.0.1.

as main topic says dun update to 3.1 its buggy.. anyone please confirm that how buggy is buggy? i really want to update the firmware coz i constantly receive the Network lost screen every 30min interval and it really pissed me off!! (3.0.1 right now) , calls drops, cant receive incoming calls, sms delayed, mms delayed.. all sorts of crappy problem...
