btw....this permohonan can amend declare taxes back to how many years?
can one revise the declared income tax submission back few years?

ex....let says I did not deduct some deductibles on my BE 2 years ago....I kena taxed RM1000 and already paid for.
now 2 yrs later...I found the receipts...can I amend the 2 yrs old BE...so that can claim back some money?

if yes,..how many years can back track?
7 yrs as required for the document saving period?

I saw 2015 to 2018
But I'm not sure you can still amend for 2015 to 2017.

http://www.hasil.gov.my/bt_goindex.php?bt_...=5000&bt_sequ=6

From the above link:

Amendment After Submission Of Form (From Year Of Assessment 2009)

A. Amendment Submitted Before Deadline for Submission of Return Form
B. Amendment Within 6 Months from Due Date for Submission of Form

I guess only that year of assessment only.

It also mentioned that amendments allowed for either under-declared income and/or over-claimed relieves but no mentioned of under-claimed relieves:

B.1 Income under declared / not declared
B.2 Expenses / other claims over claimed
B.3 Capital allowances / incentives / reliefs over claimed

Is the activities of deriving that income is made in malaysia?
If yes...then isn't it considered derived in malaysia thus subjected to taxes?
If the activity of deriving that income is not from malaysia, then that income received is not taxable....example...income from fd in s'pore

Yea I'm doing the work from Malaysia, so it's taxable then. Thanks for the clarification thumbsup.gif

Hello,

Done some freelance design work over the internet with a foreign client and received payment via PayPal (I'm in Malaysia). Does the income need to be declared? I'm assuming yes, but some said no because of this line in the tax guide:

"With effect from the year of assessment 2004, income derived from outside Malaysia and received in Malaysia by a resident individual is exempted from tax."

Thanks

Dear tax gurus,

Could somebody clarify the following? If i rent out my property for RM1900 in 2018, does it mean that i can exempt this from paying tax? Thanks

Quote from Tax Explanation form:

"Rental received in respect of houses, shop houses, land, plant, machines,
furniture and other similar assets.
Exemption under P.U. (A) 55/2019 for Year of Assessment 2018 only.
A landlord who rents out his residential property * is exempted from the
payment of income tax in respect of fifty per cent of his statutory income
derived from the rental of the residential property.
* ‘Residential property’ means a house, condominium unit, flat or an
apartment which is built as a dwelling house.
Conditions for exemption:
a) The landlord shall be an individual citizen who resides in Malaysia and is
the registered proprietor of his residential property;
b) The monthly rental amount received from each residential property does
NOT exceed RM2,000;
c) The tenancy agreement between the landlord and the tenant which has
been executed and stamped comes into effect on or after 1 January
2018; and
d) The residential property is rented out for any period from 1 January 2018
until 31 December 2018.
Where rent is received from two or more residential properties, the landlord
who is granted an exemption shall maintain a separate account for the rent
received from each residential property. Each residential property shall be
treated as a separate and distinct source of the rent.
The landlord who claims this exemption is required to:
 indicate ‘X’ in the box for ‘Paragraph 127(3)(b)’ in item A7; and
 complete and retain the Working Sheet HK-4D for the purpose of future
inspection by LHDNM, if required."

Bear in mind, only for approved organisation only, which is normally written on the receipt. If donate to e.g. temple/church, even if they give receipt, but is not under approved organisation, then cannot claim deduction.
