My understanding is although the Custom guidelines categorised SOHO under commercial, REHDA has written to Custom to apply GST based on the usage of the actual unit. If it is argued that SOHO is under HDA and hence is residential, then the usage should be residential and not subject to GST in both selling price and subsequent rental charged.
Not sure whether REDHA has receive the confirmation or not yet...

GST depends on the use of the property and not the title nor it's sitting on an integrated commercial devp Given this is a new project and the use is then determined by HDA and the design concept...the latter cld be difficult when soho has dual use

GST licensee tenant would prefer owner charge them GST so that they can claim it from custom as input tax.
However, SOHO means small office home office which target for small business or individual and very likely this group of tenant does not have GST licence. Therefore, they will prefer if the owner not to charge them GST as it is not claimable for them. It is just my speculation.

As long as yr business annual turnover is less than RM 500K, you are at your own choice to choose whether you want to be a GST tax payer or not, whereas if your annual turnover is more than RM 500K, it is compulsory.

Anyone observed that there were a few mini property fair going on last few days? For example: (1) Paradigm mall - around 20 booths (2) TCM - less booths more for subsale (3) Sunway Pyramid - Claimed to be 40th anniversary, but selling Sunway properties. Wondering if they do it interest hike or the market is slow.

One more salt to the SOHO under HDA debate, utility will be under residential rate. How about assessment rate from DBKL whether based on residential or commercial since the land is commercial title
