hmmmm, a daikor already shared info that he written to related government department asking about whether soho under schedule H is subjected to GST and the reply he got was positive..... so no GST involved for our soho units!!!!yeay rclxm9.gif  rclxm9.gif  rclxm9.gif  rclxm9.gif

as long as you are buying by your name, and you are not registrering as a GST tax payer, you no need to charge your purchaser / tenant GST 6%, unless you are using a company to purchase a unit, and your company annual turnover is more than RM 500,000.00, you are compulsory to be GST tax payer, then charging 6% to your new purchaser/tenant is a must.
Luckily I buy by using individual name.
*
in the talk i attended, the speaker cautioned that the tenant might actually prefer to be charged 6% gst in future because the tenant is able to claim input tax. this is in comparison to landlords who doesn't.

but that daikor states that soho under Schedule G or H is considered to be residential.... so, we'll just wait and see.

kochin gor, this was extracted from your link.....
"If a residential building is built on the commercial land title, it will
be treated as residential and such transaction is exempted from GST. However, if the residential building has been used for commercial purposes, GST is charged on the sale of this building."
pls correct me if i'm wrong, but my comments are a bit biased la, i personally hope that the soho i bought is not subject to GST.
*
this para if i intepret it correctly is meant for serviced apartment built on commercial titled land.
as it explicitly mentioned SOHO is treated otherwise, so ....

btw, am not vested. speaking on neutral ground.
i know soho owners won't like it but i think still got leeway to appeal lah.
best is get rehda to appeal through moh lor since moh recognise it under hda liao mah.
how can custom overrule moh, right?

i dunno the details.
probably because if he lease a shoplot from you.

say individual @ RM3k/mth
he does consulting and charges others a fraction of the rental of the shoplot to others. say total at RM5k/mth + 6% GST (RM300). he needs to pay GST RM300 per month.

say co @ RM3k/mth + 6% gst (RM180)
he does consulting and charges others a fraction of the rental of the shoplot to others. say total at RM5k/mth + 6% GST (RM300). he needs to pay GST RM300 per month. but he can claim back RM180 which he paid earlier? so his actual GST is only RM120 instead of RM300?

like i said, i dunno the details. don't shoot me! icon_rolleyes.gif
