Beside buyers loan drawdown, most developers need bridging loan and borrowing for land banks.

Over claimed mean developer and contractors are short of cash flow. Banks are normally shy away from clients having cash flow difficulty.

I notice that the facade and all artistic feature that this developer put on really required huge sum for maintanence. They use many steel work , mesh... that wont really last. Need periodic maintainance, galvanizing or repainting. The painting seem to fade and peel off quick too...

the architect can issue certificate of partial completion..meaning sectional vp of the development..need to see the actual documents oso lor to really confirm whats the case

i read here the architect in empire inhouse architect..maybe deswai not really impartial...u need to remember the relationship in this development. Client(developer) hire consultants (ar., ir.,sr). then PAM Contract 2006 that binds developer to Contractor/builder. then u get the SPA that binds the purchaser and the developer. key person here is the developer lorhh...360 degrees pipu can sue them if got misconduct. they oso got power mah over the builder n consultants..so really complex issue. all side oso will take measure to protect themselves hmm.gif hmm.gif

guys side track a bit to clarify:

in HDA and in SNP there is clause describing the completion of common facilities stating that the commong facilities of the development shall be completed by Vendor within 36 calendar months from the date of agreeement (SNP). The vendor architect shall certify the date of completion of common facilities.

If the vendor fails to complete the common facilities in time, vendor shall pay immediatelyto purchaser liquidated damages to be calculated from the day of the rate of 10% per annum of the last 20% of the purchase price.

Is the Completion of Common facilities tied to the VP? if the VP obtained late, does this mean purchaser have the right to ask for the LAD including common facilities with the same duration?

LAD applies for both the unit itself AND common area ..
