Yes thats correct. Dev is liable to pay LD. As far as I know, its not spelt out clearly in this project's SPA.

is that a common understanding or is there anywhere i can refer too in the HDA?

LAD for the Parcel (unit) is clearly tied to VP in the SNP. But for common facilities is tied to Vendor's architect cetification of completion. Anybody can explain about architect certification of completion for common facilities vs VP for the parcel?

Have a look at HDA Schedule H Cl 27. Depends on how the contract/project is carved out. Common area completion is usually certified via CCC, thats to say date of CCC. If not architect shall certify date of completion.

Just read about the forced VP, the architects questionable certificate issuance and the banks final disbursement with out a final site visit at www.rojakpot.com

I opened this thread for the 1st time i already know problem project oledi when buyers start to discuss clauses in the SPA. Good luck and godspeed. Pity the buyers.

Yes, now buyers need to fight with developer, the very people that opened their arms with smiles when the buyers came to the show unit and then sign the SPA. Buyers pay their hard earned money to developer, not pay dry leaves.....end up like this.

To me, when i see big big tall building i takut oledi. "Developer sure can built or not?". "Developer can finish the marathon or not?". Everytime i ask this question when i see big tall building under con.

My personal point of view. Try to go for developer with good past track records. The longer they are in the industry the better it is. Just to better keep yourself away from abandon risk.

This might not be 100% correct but at least I do believe corporation that built their reputation over the years will try their best to protect them.

That's why I never understand why many still purchase from unknown developers. There have been so many recently.
You can never be too safe. Don't take such unnecessary risks. I have relatives and friends who have been affected, some less painful, some more.
