yeah sorry. it's 20x70. i got confused with the other unit.

What do you think the manager/owner cares about most? The well being of the neighbourhood?

It's a resident area, not commercial area.
Bought an unit there, but thinking of letting go in future because me and family is looking for privacy.

The existing of the kindi did not serve the purpose of G&G anymore. I forsee more problems will happen.
- Every year, new kids enroll. More outsider cars will lingering around that area if they allow parents car to go in. How do we ensure that they have kids in the kindi or just come in to look around that area? By verbal?
- Guards efficiency and security may be used most to guard the kindi safety due to many people come in and out. (so their load will be more to take care of our security but we all pay the same Amount of Maintenace Fee)
- TTDI Alam Impian's selling point is More Space, More Peace, More Privacy. With existing of this kindi, do u think it aligns with TTDI's selling point?
- Imagine if you are on leave or MC leave, or ur kids have not gone to school (afternoon school), you will hear the noisy sound coming from the kindi. Spira area is very small only. All will be effected.
- it's a drawback for serious home buyer who looking for a peaceful place to stay. The value of the house will not increase much. The first impression is not attractive with the yellow kindi as major landmark. (spira area is very small only). They will rather buy other phases cus inside facility not sharing with kindi and those area will not as busy as in spira.
- with more kindi's parents going in and out, the residence are paying the maintenace of the "intensively used" gates, the pole, the camera, park and almost everything.

In one word, Spira no need a kindergarten, they can be outside, not inside the G&G compound. The kindi will take advantage of what we have there, giving more trouble than provide service to our residence in spira.

Those resides in spira will organize Gotong Royong more often to clean up the rubbish and repair/maintain the facilities. Those not staying there won't care a darn abt Gotong Royong. Do u think the kindi's owner or worker will care about it?

Well, don't be too downcast! This kindi may not be there for infinity. Business come and go! If there is better facilities somewhere or the rental has gone up, they will have to move or the owner will take back the unit for own stay or sell it in future. Be patient! life is full of surprises!

exactly! let's see how's the business first. from the owner's perspective, he will have a good selling point (kindi is in a G&G area and hence better security) but to the residents it's a different story all together as the privacy is compromised. let's play by ear and see the consequences of this business in the neighbourhood, and the next course of action should the situation worsens.

I'm not here to punish people I'm far from being an executioner. But again, I reiterate, if most of the SPira home owners are unhappy about this, don't just let your minds speak here. Transform them into action.

1. Get the votes.
2. If majority opposes the kindi, an RA rep should write to the local council informing them of everything. If no news, contact the wakil rakyat from the area. Worst case, tell MB Khalid Ibrahim.
3. If still issue not resolved, use the power of the people. Meaning our powers to reject the kindi, by rejecting the goods and services. Don't go send your kids there. No demand, no supply.

With all these three being said, it can only be done if and only if THE MAJORITY opposes to the kindi.

I personally reject the idea of this sneaky business venture. None of the residents were informed. Just some dude coming here to making some research and went ahead using some cables to speed up the process.

Yeah, they take advantage of the fact that all the neighbours are still not there and hence need not get their permission. For RA, right now, we have only 30% occupation rate and hence difficult to have majority vote. Naing should help if he is willing.

Legally, it is not wrong to open a kindi provided that all neccessary approval had been obtained (MOE, local council, etc).

If there is no DMC, or there is no such clause within the DMC that you guys sign, you would be lacking of legal ground to deny the business being set up there. This is individual title property, theoritically, the road , playground and other common area belongs to local council or the public. But, it is in malaysia that sometimes, we understand the situation and do not forcefully do things that might not be beneficial to anyone or in other words, we dont simply want to make trouble for oourselves and others.

Guys, dont get me wrong, i am not here to pour cold water, but it had to be dealt be on a sensible manner. Let what Jeghui mentioned, if majority like the kindi to be there, then story end. But if majority oppose to it, you all can still protest or appeal, but i am jsut saying that on a legal perspective, it is not easy. At the end of the day, the owner of the house (not sure if he is the owner of the kindi as well) also a house owner there....

Should discuss this is Naza to find a better solution how to accomodate kind setup (this is necessary within a neighourhood anyhow), but it is the planning that is important. Unfortunately, for Naza ttdi, all projects are so -called gate and guarded...so a bit tedious....to accomodate this.

One of the questions that potential customers of the kindy should ask themselves:

"Are you willing to trust the wellbeing of your kids to such a shady business operator?"

I believe KRISTA is a good kindy francise. The problem is this particular operator clearly knows that some people do not welcome them there and yet he forced his way in. Business should stay in business premises.

true....

been reading this topic a while now, can feel the frustration of many. key issue- is there a dmc or not?
can an owner pls comfirm??

if no dmc, spiderm is right and right - no legal recourse, really.

with dmc, it usually says the owner assign the rights to decide on such matters to the mgmt co. which is the dev itself until it gets handed over to a committee, i.e. the residents. if the developer's mgmt co. agrees to a kindy, little the residents can do until they take over the mgmt co.

to have a better grasp of the situation, need to know.... is there a dmc or not? tq.
