Becareful TS, i seen many time like this for zoomer and x generation, they think they can do whatever they want, wait until your company decide to bring to industrial court to fight against you, this can happen 50/50 chance if they are mad enough.
from my not so popular advice, u can consider telling them not to pay anything , free of charge work equal of 2 month salary or pay the remaining balance salary. Good luck, next time please inform carefully and be transparent. |

QUOTE(LiQuID2 @ Jun 23 2023, 07:17 PM) U have to compensate the balance notice. For your case..u have to compensate 1 and half month of your salary U are not getting a cent for the days that you work until last day. If you have leave also burn to pay notice in liue that's itPls note you are creating inconvenience to your company. It's impossible to hire, onboard train. Get system. Ready in two weeks. That's why company have the two month noticed. I am very sure your new company can wait if they really want you. Be mindful if I am the boss, if you do this two weeks notice with Ur current boss high changes you will do the same with the new company. U decide what perception you want to create for your new company. This post has been edited by g5sim: Jun 24 2023, 12:50 AM |

QUOTE(CoffeeDude @ Jun 23 2023, 11:07 PM) Then pay compensation in lieu of notice. Get the new company to buy out n pay the current company. Fair n Square.Since your notice is 2 months and you want to leave in 2 weeks, then pay 1.5 months salary to your employer. That's what I did last time. My new employer wanted me to join them in 1 month and my notice period is 2 months. My new employer paid my old employer for the short notice and they accepted it. |

QUOTE(WaCKy-Angel @ Jun 23 2023, 11:53 PM) QUOTE(Thebestscammer @ Jun 23 2023, 11:55 PM) that was the sentence that pissed me off more than the fact that he asked the same shit 2 months ago but didnt even jump back then This overall shows TS wanna ppl to agree with him when u said otherwise they don't want to hear. if he had jumped back then and served the 2 months the issue is gone the other thing is this TS has to be a kid or something. boss reject resignation? wtf??? how can an employer reject a resignation? he is in sales no less, want to exit out quit? stop meeting your quota and they will kick you out within a month's notice. easier than resigning. he is so full of shit and abusing the serious K thread This is similar like those jokers who put down payment let said Toyota Vios, then come and ask is it a good car. Those are seeking agreement on what they did is correct. And as mentioned Employer didn't even had rights to stop you from resign, but they can stop your early release. Lol If the employer wanna to play TS and make him example. GG lor. |

All those who say if his salary is low, the company won't sue because legal fees higher than his salary, you people forget that most companies have their own legal team. Salary already paid for whether they sue or no sue. Rather than goyang kaki, better to show that they are useful if you know what I mean

LOL first time heard resignee can say when they can leave, usually HR will come out when you can leave after deducting all the leave to off set, if you want to cut short your stay, you need to ask the new company to buy you out.

I just repost something from Donovan & Ho website https://dnh.com.my/employees-who-resign-without-notice/ QUOTE Labour Court If the employee’s monthly salary does not exceed RM 5,000.00, the employer is able to recover the payment in lieu of notice through the labour court pursuant to Section 69(2)(iii) of the Employment Act 1955 (i.e: inquiries by the Director General of Labour). There are no filing fees involved in recovering an amount through the Labour Court. The procedures involved are also relatively less formal compared to legal proceedings in the civil court. However, as there are no specific timelines under the Employment Act 1955, delays may occur. Any decision by the Labour Court may be appealed to the High Court. TL;DR - It costs the company nothing to file a claim if the employee's salary is less than RM 5,000 per month nelson969 liked this post

QUOTE(Sha91 @ Jun 23 2023, 07:43 PM) 1. Request an early release without payment then if it does not work; Option 1 impossible, especially at current economy.2. Ask the new company if the can buy you out, if does not work; 3. Then you have to pay for the balance. Option 2 should be deal with new employer before signing offer letter and commit the start date. Seems like ts didn't do this, so rule out. Only option 3 is available, topkek. And with this, he basically spoil his relationship with his boss and company in addition to forking out own money. Good lesson to learn anyway. |
