If company sue me, what benefit do they have?
*
They won't sue you la, dun listen to those ppl, unless you are super high pay like the ceo or etc.

If you just a small fart, the fees to sue you would have been more than the 2 months you owe them, and not to mention the additional hassle.

My position is Senior Sales Executive.

My boss reject my resignation, why u blame me bodoh?

I wanna leave urgently, that's why i just hope to serve 2 weeks notice.
*
dude u hv got the offer back in May and drag the feet to submit resignation letter. the notice period is for company to look for replacement and handover of task for smooth transition

1)why u did not submit letter by end May?
2)why u did not inform new company that ur notice period is 2 months? if they need u urgently, they will pay for u the gap
3) why burn the bridge n damage ur reputation. the industry is small and future potential employer might take note of it
4) why share ur irresponsible action in lowyat? expecting getting acknowledge?

Still low for them to want to initiate legal action.
Lawyer fees and all that will be way more than that.
In the end, they will rugi if they proceed with legal action.

If I were a good lawyer, I would probably do it in such a way whereby the judge will rule in such a way that will penalize in the most harshest way possible.

But I dun think there are many such lawyers in Malaysia

So many said TS is libel to compensate notice period in full (remaining 1 month, 2 weeks) yet TS believes TS is not at fault.
Easy way don't want then let employer teach the hard way.

Even if you are buying out with short notice period, you will already be burning a lot of bridges.

And here you are talking about leaving with serving any notice period and no compensation… good luck

He can't reject your resignation but you need to pay back the amount for early release.

Best case scenario, they won't pay your final month's salary and also ask you to compensate them for the remaining month.
If you want your new company to pay for it, that is normally negotiated before signing on the new offer letter.

Worst case scenario, in your new company, if you have a 6 months probation period, during probation period if their HR do a check on you and found out from the previous company that you didn't pay, you might not get confirmed. I have done that to one of my new joiners before. I made sure that he paid off his old company first before I made HR confirm him.

Just pay the difference in notice period Vs actual last day. Its up to employer discretion if they want to accept but usually they will take it.

No company can reject your resignation letter.
But company can ask for compensation from you if the contract says that you need to give 2 months notice period as you already signed it.
Best if your new company can buy-out your remaining notice period.
If not then you have few choices:
1. Pay company $$ for those notice period that you cannot serve.
2. Nego with your boss to release you instead.
3. Ask new company to buy-out your remaining notice period.
4. Maybe a better way but I don't know about it.

So sorry to hear your situation. In all cases the notice count down when you inform the boss n hr with a dated letter

If you pull back then you will have to re resign

In all cases the repercussion of not serving your notice is clear - you will letter of demand or salary hold depending on which route taken

My advice you are fickle minded, suggest to think what you want then decide. There should not be doubt then move on from there

The notice period is there for an obvious reason.

2 months and potentially can offset with AL balance subjected to approval

Else compensate.

Strange that TS jump the gun
