well..I think case can be concluded already..
1st point : Seller's bad packing, and irresponsible "NO PERSONAL WARRANTY FOR COURIER" statement. BAD SELLER.
2nd point : Buyer overlooked the importance of warranty, as he thought it will be just fine as the seller said. Learn your lesson, be more careful next time. Be sure to ask for more details photos and warranty. COD when dealing with electronic stuffs.
3rd point : Faulty item, no matter how it become a faulty item, it still a faulty item that
CANT last long..who's fault is this..only God Knows.
well..for seller, nothing much I can say about you, because to me you are irresponsible, u are not even offering any possible solution from the beginning of the thread,(eg asking the seller to send the phone to phone shop or watever,)instead, u just keep defending yourself and pointing your fingers on the buyer and keep talking that it was his fault and mistake and he is lying or whatever.
You didnt pack that thing well, that is your mistake and fault. Although it is not proven that the bad packaging spoils the phone, but by all means, you should pack it nicely, with shock protection. Your packaging is bad, really bad, I cant imagine you pack the same thing for the perfume.
And the phone's condition is bad too, that is out of "normal wear and tear" or it should be normal wear and tear after 5 years..
you should know the scratches are the things that a buyer would consider and ask. Frankly speaking, most of us(that includes you), would think those scratches is way off limit from the term "Normal wear and tear" right ?? You really should show them, and offer a good price to make it a reasonable deal.
You should show all the scratches on the phone, not just hiding them by putting one photo of the phone which show the best part of it. When asking why didnt you put the photos, u point your fingers to the buyer again.."Bcoz he didnt ask mah...~~~

conclusion : you are not being ethical,honest and transparent enough..
for the buyer,think it and take it the positive ways, not much amount involved in this transaction, and your still can send your phone to repair..ask them to quote it how much to repair it first before you actually asking them to repair.
learn your mistake well and remember it for the rest of your life..ask for more details, more photos and security when dealing. No personal warranty for electronic device is NO NO, unless u got a change to test it "kaw kaw" on the spot,but still, will warranty still the better choice..
And not to forget, if possible, trade with safe-traders and a reputable traders. I know it is hard to know how good or bad is a trader, but for the least,
please dun buy thing with courier service from junior members ,because most con-case / dispute happen from there. Unless many other forumers have positive feedback on them.
conclusion : learn to be smarted next time..and become a better seller and buyer.

and here is something for everyone, here is a true story i have read from somewhere else, it happened in Hong Kong.
first, the seller is selling a glass-type decoration on the internet,
a buyer come and buy it, same thing there, the seller say NO PERSONAL WARRANTY will be given if the package is broken on arrival, but she swears that she will pack it nicely..and she say the courier company will responsible if the package is broken upon delivery process.
so the buyer accept the terms without much hesitation. And this is the bad thing happens, the package look nice from the outside, but after the buyer open it, what the buyer could see is just a pile of broken glasses. And the packaging is really bad for sending fragile stuff.
So the buyer called up the seller, the seller say he should call the courier company.
So the buyer did, but the courier company say that it is not their responsibility since the buyer already signed and accept the package in nice condition. A buyer mistake here.
Nevertheless, this buyer has a friend who is working in law firm, not a lawyer,but he knows the lawyers on that firm. So the buyer consulted the lawyers. The lawyers said according to the laws,
The seller has to be responsible for the whole thing. Because the risk of courier should be bear my the seller and not the buyer, and the packaging is bad, not up to standards.
So they have in court and of coz, the seller lost, and she has to pay for everything..including the legal fees. The critical point that makes the seller loses is because the packaging, it is not applicable for sending glass in what ever sense. The packaging is just box, and the item was wrapped with a pieces of newspaper. Nothing more.
and for sure many of you will wonder why they make it so far to the court..
it is because the glass decoration item we are talking here is worth more thousands, it is an antique. Yet they still choose to use courier service without paying insurance..I really wonder why..
