Having some trouble on where to put my severance tax relief, "pampasan yang dikecualikan cukai". Let say I am entitled for rm30,000 tax relief because  I worked in my company for 3 years before getting retrenched. Do I deduct that 30000 directly from  my pendapatan berkanun penggajian?

QUOTE(zmt @ Mar 18 2016, 09:54 AM)
Seems like my HR did not put this under section G. Will check with them.

Did you manage to solve this? I have the same situation as you. is your RM30k tax relief example above based on the RM10k tax relief for each year of service? In my case, I have worked 4 years but my severance package is less than RM40k so does that mean that I can claim tax relief of 40k or should it be the actual severance payment amount?

My ex-HR also did not state this under Section G. Do let me know how you settle yours, many thanks in advance.

Yes, I just deducted from my total taxable income because my HR did provide a HK-2.7 lampiran, "Pengiraan Pampasan Yang Dikenakan Cukai". You might want to call up lhdn if you are unsure.Otherwise, please see David83's reply to my question.

called LHDN this morning, they told me the refund is in process. If not get it within 30 days from date of submission, they ask me to directly ask for the cawangan who handle my refund, in my case is cawangan shah alam.

i wonder is it the cawangan shah alam slow in this kind of process. I face the same issue with this last year.

Government no money now, refund sure slow, but if you need to pay them, you need to be fast.
Now I still need to pay them rm10000, they wanted me to pay within 4 months, after a long conversation, I managed to make it to 8 months shocking.gif

Hello,

I'm not sure if anyone faces this question before. I'm currently working in SG since YR2015 Jun, and my last day of working in MSIA was YR2015 May. Therefore, am I considered as Resident Tax for YR2015 assessment?

Upon reading http://www.hasil.gov.my/pdf/pdfam/individual.pdf - I am considered as Resident Tax based on 1©

"he is in Malaysia in that basis year for a period or periods
amounting in all to ninety days or more, having been with
respect to each of any three of the basis years for the four years
of assessment immediately preceding that particular year of
assessment either—
(i) resident in Malaysia within the meaning of this Act for the
basis year in question; or
(ii) in Malaysia for a period or periods amounting in all to ninety
days or more in the basis year in question;"

I did call up to LHDN customer care and wasn't told any of the above condition, but only a mere answer that I can still submit my EA (Jan-May 2015) and attach supporting document from SG Revenue Board (Jun-Dec 2015).

Anyone faced the same situation? If so, did you manage to get different answer from LHDN? notworthy.gif

The team that is reviewing the current assessment != The team that is processing the current refund != The team that is auditing the current assessment != The team that is reviewing the previous assessment != The team that is processing the outstanding backdated refund

This is how government agency works! whistling.gif

Just received this letter from lhdn.
So what they mean is they will check my file.
If nothing informed from them within 3 months. I can just call to ask for refund?

Or this is simply an excuse for them to delay payment?

hmm.gif just from my previous encounters after receiving these letters.
they will not contact you......
you have to contact them,...bring along your submitted data...(ex, BE form, EA form, receipts (proofs) of the items you claimed during the submission of the BE form)...they need to verify the data submitted.

well, that is just my encounters....hope yours are not the same.

Meaning in short, they're not in the rush. If you're in the rush, you better initiate the "audit" process. LOL

The way they wrote the letter is so convenient! LOL

It will be straight following your previous year's tax bracket.

last time also my friend got a letter like that. i then called about it and asked. then they were questioning some thing on the reply. I don't understand Malay so I told them. Then the girl (speaks like a newbie) laughed, and just said never mind.

Just call them and ask what the letter is all about. So you can get your refund ASAP.

I unable to call the Shah Alam Branch for the detail this morning (semua sibuk)

so I call 1800 LHDN general line, and the person help me check and notice I didnt enter my dividend taxable income even I have enter it in HK-6 form
In last year, when I enter HK-6, it auto populate the taxable income & tax paid from the HK-6 to the main form, but not this year.
This year it populate only the tax paid to main form but not the taxable income. So it turn out that they deduct the extra tax paid in total but no dividend taxable income.

The official tell me to bring all my form to Shah Alam branch to settle, what a mess rclxub.gif
