Incase anyone would like to know or already known. But i just got a reply from the LDHN and tablet-like laptops i.e. Surface Pro 3.

Doesn't qualify for tax exemption.

i think LHDN make it clear, only classic laptop and pc can claim. any hybrid will not be entertained i guess. anyway thx for ur info.

PUTRAJAYA: Kenneth Chin was flying in to KL International Airport 2 from Australia on Aug 15, a trip he has been making regularly for the past five years, when his passport was barred at an auto-gate.

He checked at a counter – and found out that he had been blacklisted by the Inland Revenue Board. He is one of thousands who now have to settle the matter or they cannot leave the country.

The IRB is on the hunt. Tax evaders – even those owing as little as RM200 – are being barred from leaving the country until they have paid their dues.

The officers have been very busy in the last few months. This year alone, the IRB has successfully recovered RM8.37mil (RM8,378,871.48) from those who had been planning to leave the country.

The IRB has engaged the support of the Immigration Department to enforce the travel “blacklist”.

“Whether the purpose of leaving Malaysia is for leisure, business or migration, the no exit order will apply to all tax offenders,” IRB corporate communications director Nor Azirah Mohd Said told The Star.

“The law explicitly says the IRB director-general may issue to any Commissioner of Police or Director of Immigration a certificate containing particulars of the tax, sums and debts so payable with a request for that person to be prevented from leaving Malaysia unless and until he pays up,” she said.

The authority to issue a stoppage order, or to blacklist a tax defaulter from leaving the country, is granted to the IRB under Section 104 of the Income Tax Act 1967 (Act 53).

The law allowing the IRB to do this has been in the books since 1967 but active enforcement has only been done in recent months.

Nor Azirah gave an assurance that tax offenders would not be held in detention at Immigration checkpoints but if the offender wished to continue on his or her journey, the person is expected to pay all liabilities.

Income tax from qualified citizens forms a substantial portion of the country’s income, with the amount being on the increase every year.

The IRB is chasing after 97,343 defaulters to get them to settle an accumulated unpaid tax totalling a staggering RM2.88bil (RM2,886,891,630.59). This year, 8,332 new names were added, with cumulative unpaid taxes totalling RM162.97mil (RM162,971,207.33).

Offences under a tax gap may occur in several forms, including non-payment or a deliberate avoidance of tax, as well as a false declaration of income tax returns which results in an under-payment of taxes.

Under the Act, any person who is found guilty of failing to furnish an income tax return may be liable to a fine of between RM200 and RM2,000 or a jail term not exceeding six months or both.

Any person who makes an incorrect return by omitting or understating income received may be brought to court and, upon conviction, be liable to a fine of between RM1,000 and RM10,000.

The offender may also be liable to pay a special penalty of double the amount of undercharged tax.

Hi, I want to ask some questions.

if I want to submit taxation for previous years like 3-5 years ago, how can I do it?

Print out the form from lhdn to fill up and submit?
Will get penalty if submit now?
How much does it usually cost to hire a tax agent?

Hi All,

I have just submitted and filed my 2013 income tax. I know the due date is April 2014, but this is first time that I am doing it. I also noted that I didn't declared as well 2012 income tax, which is small amount paid. My employer has done PCB deduction every month, and it is my fault that I thought that is enough since it was deducted and I don't have any additional income. So basically, I called office and they asked me to submit e-filing which I have just done.
So my concern will be what's next? Wait them to call me? I should go to their office with my EA/BE form? And will they fine me?

print out the form using Laser jet printer on 80g papers and the submit
sure got penalty la, normally late submission is around rm200 per year, then plus the penalty around 10% on ur tax payable to lhdn
tax agent ? depends on wat type of income tax form u need them to fill, BE is like rm300? B, P , C are all more expensive than B i guess.

they will send u love letters, meanwhile just wait. unless u have lots of free time, u can pay them a visit to clear things up faster. u worried tat u cant go out of malaysia izzit?

WAs stop at the Immigration at KLIA2.

Can anyone one advise how to go about settling this problem?

Tax filing was done ages ago. Already retire >55years old. But had problems as several tax officers was involved in the matter. ( Resign, etc ). Also previous employers who has deducted my pay for Income tax has NOT made payment to IRD. They subsequently ..." disappeared" . So bad luck and complication ?

Question in Hand.

a) How long can Immigration hold your name in the Blacklist.?
b) Do they(Immigration) have the right if no notification to me of this problem by IRD .?

c) Heard can get "Letter" from IRD for overseas travel. How and where ?
d) Where is the IRD place /location office for such matter ?

Any comments / advise ??

yaya, will get penalty. i thk around 200 for each year.
sometimes IRB will ask for supporting documents too besides the forms
yours are company tax? individual with employment income or individual wit business income?
to hire a tax agent, depends on your location & to file for which source and also which tax agent.
for Form B around RM 400 & above
Form BE around 300 & above
not yet includes service tax and out of pocket disbursements.

Why do you want to submit prior yers income tax?

if your income like very high, then you might get their attention to issue letters to you lo.

Hi guys

Help me, today I have received a letter from LHDN.
In the letter it mentioned that I failed to obey rule section 77 akta cukai pendapatan 1967, and referring to year 2009.

That time I was just graduated and working in a local company for 9 months.
Not aware that I will have to declare the personal income tax.
And until now when I read the letter, I just realized that I missed out to declare income tax for year 2009.

My queries are, besides paying the outstanding tax and penalty, what shall I do to get this issue resolve? (possible request for waiver?)
In the letter mentioned that I can appeal within 30 days, however the letter's date is 13 July 2014, and I received this letter on 8 Sep 2014.. Still able to appeal ? sweat.gif

matador_15: I got the same letter yesterday and called them today. It appears that you may appeal by filing in your BE form again with supported documents. Then go to their office which is written on the letter and get things done the manual way again.

I am thinking those deductions that you are eligible such as EPF statement, your insurance, medical etc. Just go through the BE form and you will know what kind of document you will need. I think you have to go EPF to get year 2009 statement as I am unable to retrieve statement from more than 2 years back. Sigh*

EPF statement only able to retrieve for year 2013 and 2014.

in this case i guess we just need to bring over our EA form 2009 should be enough (based on my colleague information).
