Completed the rayuan by:

1. Fill in the BE form for the years missing (Better write the figure in pencil and let the clerk over there check before you photocopy). Photostate a copy of the BE form along with your EA form.
2. Go to LHDN Kompleks Kerajaan at Jalan Duta
2. Go to building 8A First Floor and turn right
3. Get the queue number by pressing A. The first option on the touch screen.
4. Wait for your turn and pass them the letter you received along with your original + Photocopy BE form, photocopy EA form and all your original documents.
5. The clerk will chop and return you the photocop BE form as a proof that you submitted.
6. You will receive a letter in a couple of days time in your letter box.

Try to avoid Friday as there is a mosque nearby. The traffic is still acceptable though if you are there early. LHDN operation hour is at 7.30am - 5pm from Monday to Friday.

a Big thanks to you for the sharing.

In year 2009, i have worked for 2 companies, company B has reverted the EA form to me, and i just rang company A to chase up the process.

So the required documents for appeal, is the original + Photocopy BE form, and photocopy EA form right ?

And along with all the supported documents for your deductions if you make any such as books, computers, insurance receipt etc. and you're welcome =S best to settle everything fast

Bro...i also got the same letter last week.my company didnt do PCB deduction on that year..my tax need to be paid almost 4k... cry.gif . anything else
can reduce the amount?...i know insurance and epf only..do they charge for penalty too?

I just rang the LHDN customer service, the lady told me to post the EA form and BE form to Bangi, because that site is procession centre.

She said if I visit the jalan duta branch, they cannot process anything for me, everything need to be processed by Bangi branch first before visiting other branches. blush.gif

i just submit back the BE form 2009 with EA form, the officer verify back all the figure and i got extra tax paid. hopefully able to offset with the penalty, the officer just ask me to wait for letter if there is penalty need to paid. Normally first time able to waive the penalty.

my branch at lhdn raja chulan, menara olympia.

so just bring the EA form 2009 + BE form 2009 and walk in to the menara olympia branch, then they able to process for us right ?

The way our gomen going all out to find tax evasion, I doubt u can waive the penalty..

anyhow, like the officer said. u just wait for the letter tongue.gif

Hello to all experts.

I just get the EA form from my ex-company, in year 2009, i have worked in the company for 9 months.

However the figure of item B is not that accurate, as my monthly salary is about 2.8k.

will LHDN questioning about the why the PCB is deducted a lot from the 10,942.80 ?

I have checked with my ex-company HR, however the person doesn't say anything about it, just mentioned this is the total figure from Jan to Dec.

yes, as per their advice thru the phone before i went to the branch. if there is support document like receipt also can bring together for tax relief. Once all the detail is complete, they give me front page of BE form with their LHDN chop for acknowledgement.

er...i wish what officer told me is legit. biggrin.gif ..he said, for the first timer that doesn't declare the tax, penalty can be waive but must appeal first.

PCB deduction is the company's responsibility. LHDN will question the company rclxms.gif

oops wrong link, that was 44(6) ita... i cant find the list from their website, but i dun think language course can claim tax relief.

2. Deduction for further education fees - paragraph 46(1)(f), ITA 1967

2.1 Prior to year of assessment 2006, a resident individual is entitled to claim a
deduction of up to RM5,000 on the amount of fees expended for
undertaking selected courses of study up to tertiary level in any local
institution recognised by the Government. With effect from year of
assessment 2006, these selected courses of study can also be undertaken
in any professional body in Malaysia approved by the Minister of Finance.
2.2 With effect from year of assessment 2006, the scope of courses eligible for
deduction is also extended to include professional courses up to tertiary
level in accountancy and law. These professional courses can be
undertaken in any local institution recognised by the Government or in any
professional body in Malaysia approved by the Minister of Finance.
2.3 With effect from year of assessment 2007, the scope of courses eligible for
deduction is further extended to include courses in Islamic financing which
are approved by Bank Negara Malaysia or Securities Commission.
Islamic financing courses can be undertaken in any local institution
recognised by the Government or in any professional body in Malaysia
approved by the Minister of Finance, including the International Centre for
Education in Islamic Finance (INCEIF).
2.4 The list of local institutions recognised by the Government or local
professional bodies approved by the Minister of Finance, for purposes of
this deduction, will be made available on the Inland Revenue Board
Malaysia website from time to time.

Just an update to those who received past year undeclared taxes: I've received the letter from LHDN and the letter basically outlines the BE form that I've submitted earlier. BUT the thing is, they purposely miss out the PCB deduction resulting in a higher amount of tax to be paid =.=""

I went to the office in Jalan Duta again yesterday and checked with one of the LHDN staff and she told me that the PCB is never shown in the letter but she checked the system which thankfully has the PCB deduction. What you need to do is just ask for an overall statement and in the statement, it will outline how much you are suppose to pay or get back which included the late year BE submission. Then just go to the counter below and pay it off. I manage to save like 1.2k after everything. A hassle but it is worth it. Phew*
