Yes, correct.
It was currently an agriculture land, which developer needs to convert it to residential land ( for housing purpose ) before they go on to get the AP & DL. Without AP & DL, developer actually only can sell it under "Special Preview" where we "Offer to Purchase the Property at said price RM xxx,xxx from the developer and the deposit shall paid to XXXXX as the stakeholders" with additional of, if there is any changes of prices, floor plan, master plan etc, I shall agree the decision of the developer to cancel our purchase or increase the price in due course. Means not developer sell to us because we want to purchase from them.
Without AP, developer cannot fully advertise the project with selling price where they can't accept any booking which paid to their company.
Without DL, developer cannot sell the property as this is the license from the housing government for the developer to sell to public.
That's why we paid the booking fee to the S&P solicitor as stakeholder under "Special Preview" or before AP & DL obtained.
