Anyone got issues to claim  LAD (liquidated ascertained damages) ?

Developer said they will not paid LAD because they have extend construction period to 48 months and already agreed by majority owner !! doh.gif

Ya, it is for 3 months from 9/12/16-8/3/17.
rm950 / 3 month / 720sqf = 44cents per sf.
In SPA it is mentioned 29cents psf..  confused.gif

hello,

I heard from friend, the fees is inclusive one month deposit although the date mentioned in the invoice is from 9/12/16-8/3/17 (3 months).

So should divide by 4 and not 3 ? confused.gif

Do anyone get this news ?

Hi Milo118, are your submitting your claim for LAD? The most important factor is the completion period plus date of your SPA to calculate the delivery date. LAD claim cannot decided by majority owners but by each individual owner.

Best Wishes

Yup, as long as it is stated in your SPA you have a right to it. Go for it!

Hi Fairview

Thanks for ur reply . My spa is August 2013. Construction period is 36 months. Developer show me they have letter from ministry of housing show they are approved to extend to 42 months. I think other buyer who sign spa before August will have the same issue. Pls check ur spa. Need file with MOH for this. SPA is a legal contract . Developer have no right to break the contract no matter what. Is black and white.

The problem is need to waste some time to fight for this.

Hi Milo118,

Thanks for your advice and update. I agree as buyers are protected under HDA. I understand Housing Tribunal is handling LAD claim and from what I read from the internet the procedure is fairly simple.

Best wishes.

Mine the workmanship is great with minor defects. (Touchwood) No electricity and water yet tho.
However having headache with the power plug points (too few) and lightings (too many) and ceiling fan (too near the lights).
I plan to move in by end Jan or Feb.. hopefully can thumbsup.gif

Friend as for water you might have to switch is on. I believe they have a room for the water meters near the lift. Glad that you like the workmanship.

Anyone going to claim for LAD despite the fact that their Lawyer has sent a letter to inform purchaser that the developer has received approval to extend completion period by another 6 months? The letter was sent after we signed SnP. So is it legitimate?

Bigmamma, what you have raised is relevant. I tend to agree with Milo118 than if SPA is signed for 36 months to delivery vacant possession then the vendor is to deliver the property within 36 months. The SPA is a statutory document under the HDA to protect the buyers it is interesting to find out whether the terms and conditions can be changed by only 1 party after the SPA had been signed. The HOUSING TRIBUNAL may be the right platform to decide this issue. Any buyers with legal knowledge or past experiences that can help us.
