Its confirmed that they are not proceeding with the condo. They will send out letter to all buyers to inform them. I have already sent my cancellation letter to them. It takes 2-3 months to process the refund, sigh.

I have paid the load agreement... can we get it refund from the developer also?

I even have the duplicated copy of the SPA in hand (the SPA has officially stamped), so in this case of developer cancel the project, can't we claim all the losses from them? Because this mean they have broke the agreement...

I am also a victim to this developer. I paid the RM5000 and signed the SPA and loan agreement. Quite a bit of money is stuck here. Since the project is officially called off, or at least from what I hear people discussing here - what are we going to do? Can we sue for damages? We have a signed SPA and the developer is going against their promise. If you read one of the clause in SPA, it clearly states that the developer is required to pay us in damages a certain percentage of the property amount in the event they do not deliver the keys in time.

Anyone got any idea on what we should do moving forward?

last heard from the SA, confirmed they going to cancel this project. It is just the matter of time...
Spoke to the lawyer also, they advise we don't cancel the deal, else the money paid for loan agreement will be burn... But if developer cancel the deal, then they will need to return our losses...
I think they (Mayland) just buying time, so more buyer will cancel the deal, so they reduce their losses (not need to refund the loan agreement)...

Hi all, I'm one of the purchasers of the property. Just spoke to one of the representatives of Mayland. Apparently they're still pushing for construction of the property. The case is in court right now but not sure when the hearing is. Not sure how they are going to meet the projected completion date but he said that they will pay compensation if there's delay. Typical sales pitch and I don't believe any of it.

I'm trying to revoke the SPA and they're willing to give back my booking fee (RM5000) minus RM40 for admin charges. But I will need to pay the legal fees, stamp duty and loan penalty apparently. Not sure how much all this will add up. Anyone here managed to sort these out yet? Please advice. Thanks.

Yes, as I said they are buying time and wish all buyers will cancel the deal, so they don't have to compensate anything.
My view is, lets wait for them as we have nothing to lose, since if they can't deliver they will have to pay, and if they cancel the have to refund all (includes loan) in FULL.
