Who should responsible for this?, Contractor, developor or me?

Water Pipe Leakage from underground is found. Once the main water tap is on (at the water meter), water is coming out from underground, like fountain. Plumber dig a little bit to find any hole. Didn't find any leakage from the surface. So he concluded that it's from underground pipe. Asked me to check with developer. Developer checked, and said that it's my contractor who caused the leakage when they hack the tiles and concrete. Developer is not responsible for it. So now what?! My contractor said the plumber quote him RM450 to fix the problem. Ask me to share 50-50. Reasonable??? Who is the culprit?

Developer fault at first. However, once you start renovating, it becomes your fault for not checking properly before renovation. That's why developer ask to sign black and white upon handling the keys to you and when you filled the complaint form. Erm, price ok lo since year end sale got 50% haha. Try ask for 70%

There is no leakage at first. I also suspect that the leakage caused by the contractor when they do the hacking. But my contractor said if we never change the tiles, we never know the water pipe from underground is leaking, as it won't surface.

Either way it got to be fix. If someone willing to share, think you have not much option but to accept it. Unless you want the job to be delay. He is right in a way, if water is leak under the ground, it will flow down and you may not notice it. And keep on paying extra water bill until you redo the piping. I understand. But i cannot stand when the contractor and plumber keep telling me it's not their problem! When i tell him off that it's not me who caused the leakage either, he got pissed off and said "Ok Ok Ok, i bear everything". What is this? Huh...

Let me understand here...3 parties involved. 1. Developer 2. Contractor 3. Plumber
What is the Contractor role here? Is the plumber were hired by contractor themself or you hired personally? If contractor hired the plumber then they should bear the cost.

If you are on his shoe, and get blame of things not made by them how do you feel? I think this is a small matter, and is good to know now than later stage. Try focus on the solution, and ask what is the work involved how the pipe was broken / leak that need RM 450 to fix? If you find is reasonable and since he willing to share to cost, than try settle it.

you have no choice but to pay rm225 to fix it ..... BTW, its easy job, can DIY  Edit: look like new pipe connected to the existing water pipe, this should be rectify FOC by your contractor. This post has been edited by skng03: Dec 7 2011, 11:50 PM

There is no way TS can prove the leaking is caused by whom.
Hacking already done, developer may not want to take the responsibility. Generally, developer only take responsibility if the property never altered with. While for contractor, may say leaking already there, hacking just reveal the leaking only.
So how? No way to prove it.

One way is, you can check ur monthly water bill before & after renovation. Normally its minimal if the house is vacant for a period of time. The average water usage can be used as guideline. Btw this is difficult to be done if you start renovation after receiving keys without a period to establish the minimal avg usage of water.

I also feel they wanna parang u as they wanna charge RM 100 to get the 7" hole. Is the pipe that is leaking very deep? If they nd to dig a little and change the part that is leaking RM 450 is quite exp. However, if several parts are leaking then the price is reasonable. Try to ask what is the job scope like.

what the quality your developer is offering to you ? water tank got leakage at first and now the underground pipe... where is your house ?

Is this a GI pipe or PVC? GI pipe maybe harder to fix.

Look at your 2 & 3 photo, it is your contractor who causing it as it hacking the place which I guess is over it acutally near to pipe around. Is the place original have any water tap?
For sure you been ask for high price lol, as for hacking the floor and look for hole should been done by your contractor, than the plumber work to get it fix which I believe not even need a day job.
Question: What the pipe lay on the floor for 2nd photo are for? is that new pipe and allocated to behind? If yes, should you pipe lay near and follow the way instead of laying like that?

1st.. is that area are toilet/kitchen before? 2nd why your contractor didnt make new pipeline for your new extension? - i mean hacking the brick for new pipeline from outside your house? put the gate valve there... why must using existing pipeline under that floor? just to remind, you will get BIG trouble if the existing pipeline (under your floor) blow.. then your tiles must be hacked to find where the leakage come from...  when that day come you'll got heart attack!
