In your case, your L.D should be on a daily basis (please refer to your S&P) from 14 May 2013 till you receive the
"Notice of Delivery of Vacant Possession" (posted by alice08). Heard that some developers were known to pay
the L.D on the date you collect the keys. However this is the exception, not the norm. All the best bro.

If I remember correctly, the incessant rain between Nov.'12 and Jan.'13 was a major factor for the delay. Having said
that, the delay is insignificant considering the magnitude of the project. By the way, a month's delay for a 300k property
is 192x3x4=RM 2,304.00. If your property is delayed by same period, your compensation would have been about
RM 4,600.00. Now you can salivate by the bucketful. Yuk!!!

After Duranta, will be Bromelia followed by Banyan so would be safe to expect that Banyan will be delivered before end-June.

Went to see the Banyan last weekend and the finishing quality of some aspects are below expectations. If they don't sort it out before handover, then it will be a tiresome process to go through it with the contractors.

Hope the Durantans get a well-finished home.

I have also receive my Notice of Delivery of Vacant Possession, but have to pay extra RM 450.00 to KLKH for maintainance work from 1st julai to 31 dis 2013. Is it normal practice??

Yes. Normally MDKS will only take over maintenance after about a year. As for the rate, it is subjective.
On the assumption that KLK will provide better maintenance/services, is it justifiable for the buyers to pay
RM450/6 mths.as against RM190/6 mths (approx.) for "cukai pintu"? Should we just grit our teeth, at least
for the first 6 mths, and hope for justification? Perhaps!

Would ask KLK if the RM450 include security services. If yes then maybe worth it.

Developers usually have their own security to guard their 'still empty' houses for up to a year.

If they also guard 'you' then OK-lah. Give you time to sort out your RA.

Do the LD calculation is based on difference of the S&P date and the date of "Notice of Delivery of Vacant Possession" letter, or the date we received KEY?? Because the date of "Notice of Delivery of Vacant Possession" could be BACKDATED, because we only actually received the letter 1 WEEK or more after the Notice date. Developer can just make the Notice BACKDATED so that they not need to pay or less to pay us the LD. mad.gif ohmy.gif mad.gif

In my unqualified opinion, it should be the date the "Notice of Delivery of Vacant Possession" was issued and not
the date you receive the keys. Yes, for the sake of argument, the letter can be backdated. But can it be substantiated
with undeniable proof. On the other hand, if calculation is to end only upon receipt of keys, what is to prevent buyers
from delaying the collection until the last day of the 2 weeks' grace period? Mind you, RM192/week/Rm100k is pretty
tempting. For that amount, I wouldn't mind if KLK delay my unit by 6 months. Since my unit was not delayed, I'll be getting zilch! cry.gif

Normally if go by normal Pos Malaysia, within Klang Valley, the letter will need around 3 days. Hence the date we received the "Notice of Delivery of Vacant Possession" shall be not that far from the date stated on the Notice. Otherwise, we know already the Notice is backdated...!

Yes, 1 or 2 WEEKS delayed will cost some money also (RM1,240 for 2 weeks for Duranta)... Even could cover our open house cost, if any... biggrin.gif

Great news that Duranta is ready soon.
I still have not receive any notification for Bromelia. Any Bromelian out there can advise your situation?

The S&P said - if the vendor fails to deliver vacant procession within 24 months from the date of this agreement, the vendor shall be liable to pay the purchaser liquidated damages calculated from day to day at the rate of 10 per centum per annum of the purchase price from the expiry date of the delivery of vacant possession until the date the purchaser takes vacant possession of the said building.

Let say I bought it at RM336,000.
10% per annum is RM33,600/ 365 days = RM92 per day

S&P dated 13 May 2011. The delay is from 13 May 2013 - 23 May 2013 = 11 days
11 days x RM92 = RM1,012.

Correct?

Not sure that weekend can go collect key or not rclxms.gif anyone know?

We can collect the key after bank release balance disbursement to KLK and i was understand that KLK will inform us later when everything is in order.
