Technically he has right of way. Even if u want to make report, polis may not want to waste stationery. I was involved in same accident before. Other cars stopped for me to go but speeding motorbike crashed into my passenger door smashing the screen. My dad sitting sitting passenger side just got down and gave the motorcyclist a tight slap.
