Need advise. Appreciate if anyone can help as i am confused with (a) benefit in kind & (b) allowances.
Receiving the following fixed allowances from my company and not sure if it is taxable (classified as Penggajian in BE Form)

a) Parking fee of RM150 per month
b) Travelling allowance (fixed) of RM300 per mth - this is travelling expense between home & work.
c) Telephone allowance (fixed) of RM200 per mth
d) Reimbursement of annual membership fee with accountancy profession (reimbursement is RM1,500 of total membership fee of RM2,000 per year)

My EA Form from my company includes all the above as taxable penggajian section.  rclxub.gif
Thank you so much

Benefits listed under Penggajian is taxable.

Benefit listed under "Jumlah elaun / perkuisit / pemberian / manfaat yang dikecualikan cukai" is tax exempted.

It's all listed clearly in the EA form and it depends on your company where they put that particular benefit into the EA form.

Apologies, need to clarify further. Quite a lot of time, we hear comments that the EA form classification maybe incorrect. In the monthly payroll slip, can see the breakdown.

As such: are any of these expenses considered tax exempted from employees perspective in BE Form?
- Fixed allowance for parking, travelling, telephone allowance
- Membership fee

Thank you so much for the quick response. Appreciate it smile.gif

If the classification done by your HR is incorrect, ask the HR to correct it. Ultimately, LHDN will refer to EA form.

a) U can deduct ur parking fee portion that was incurred to carry out company's duty, max tax deductible is at the total allowance given. Home to office -> taxable. Incurred parking fee when engaging company's clients -> not taxable.
b) Similar to above. From home to your office -> taxable but to your company's clients premise, venue or etc -> not taxable.
c) Similar to above.
d) Not taxable if that's the requirement from your company to carry out company's duty.

Any income which is derived from Malaysia is taxable.
Your case, it is an employee who performs duties outside Malaysia which are incidental to his employment in Malaysia.
So, it is taxable.

Anyway, you can claim relief to save tax.

APAKAH YANG DIMAKSUDKAN DENGAN JALUR LEBAR
2.1 Internet merupakan satu rangkaian sedunia komputer yang
tersambung menerusi talian telefon, gentian optik dan teknologi tanpa
wayar. Usaha untuk menghasilkan sambungan internet yang lebih
pantas terus dijalankan dan teknologi jalur lebar terbaharu terus
diperkenalkan.

I got it.

iPad is treated as a Personal Computer because it can function like a PC.

Info from recent IRB Conference.

Should we look at policy and apportionate them out?

Should premiums are paid for Life + Medical + Other.

How do we count for Other??

Traced to one of the policy summary.

ZZzz headache.

"Any income"

but its not income, more like allowance? its to pay for meals, laundry etc.
e.g. going overseas for a 3 day conference.

I still get my same monthly salary and I am not posted overseas for work, just overseas for meeting or exhibition etc.

the company pays for accommodation, and then gives us subsistence/allowance

Your insurance annual statement will state them out clearly.

Ex:
Basic Life Premium Insurance: RMxxxx.xx
Medical Insurance Premium: RMxxxx.xx

If you didn't received ur statement, perhaps u can call their call center, for Prudential they will be able to fax to u immediately.
