Just to inform, i just received my VP letter today..i signed the SnP on 6th June 2006..i'm yet to see what are the docs attached to it..will post it tomorrow..

Hi, I'm ph 1 onwer and just joined this group.

I received vp together with architect cert yesterday. FYI, my S&P due on 12/07/2009 and the completion date stated in architect cert is on 17/07/2009.
Is the VP valid?
Should I submit the LAD claim now or wait for CF issue?

Just call Wirama office, A lady pick and forgot to ask her name...she said I need to check with my bank whether they have release the full amount the Wirama before I make an appointment with them to collect key. As for LAD...I need to write a letter to them stating how much they owe me and bring the letter together upon collecting key. Is this a correct way ?  rclxub.gif

My case is same as u.

WSB charged me the late payment interest, but I found that the late payment made from end financier. Therefore, I faxed my statement to end financier and ask them to clarify.

1.have you called to architect firm to verify? or alternatively call to mps to verify on the borang E submission date. mps will give you the confirmation letter on the date of acceptance, vp date should base on this date.

2. if you have done no 1, then vp is valid. then your LAd should be 13/7 to 17/7= 5 days

3. you can calculate your LAD = selling price x 10% x 5/365, then write in to developer to claim and request them to contra your LAD with your misc. payment. after the contra, if your LAD enough to cover misc pyt, then you req for $, if not enough, then you top up la.

4. LAD should stop on the day of VP & not cf date. vp date meaning developer submitted borang E & authority accepted the borang E. According to regulations, after borang E submission, within 14 days cf will be issued.

Just called to architect firm and confirmed that the borang E has been submitted, so I can bring my letter LAD to developer office and ask them to contra the outstanding payment for me, rite?

My LAD is not enough to cover the amount of misc payment. Can I just pay the balance after deduct the LAD.

now i think got 2 type of date archt certificate issued ,for first batch i think the date was 31/12/2008 completion , for second batch pula 17/7/09 completion !

See , Y not all the buyers collect the archt certificate on same date ... .... Yesterday spoke to Yasmin she said no VP will issued against to first batch buyers that collect their VP?

Can we report to KPKT we all received the Different date completion of Archt Certificate ?

VP is valid only when u received together with Architect Cert and prove of submission and acceptance of borang E by MPS. If they only issue to you VP with Acrhitect Cert only, that means it same with me when i received it on last January 09. The VP still not valid and LAD still running

I also received the VP with the architect cert dated July 17..but no prove on borang e submission and acceptance....so meaning this VP AGAIN IS AN INVALID ONE???

how to clarify on this....can we ask for copy on proves for borang E?

and what if the bank being misled and they released the final payments?

most of the developer when issue vp letter will only attach the architect cert, you can further request a copy of borang E submission from them to verify. alternatively, you can go personally to mps and request a confirmation letter for borang E submission date. I got the confirmation letter from mpkj then i proceed to claim LAD(liquidated ascertained damages).

Bank will release base on architect cert, they seldom request for borang E, so it is better for you to do your verification before they release.

LAD = liquidated ascertained damages, meaning if developer hand over the vacant possession to you late, you can claim them LAD as compensation.

I just called WSB and asked whether can I contra LAD to settle my partial misc payment, but the person who answer the call said the management would not accept the matter of contra for settle payment. She asked me to write in first and wait for the approval.

Is this the normal procedure to claim LAD?

u hve to write to developer to claim LAD. Usually the developer do not pay the LAD claim in full. Stand firm don't accept if it is not full payment.
Make a claim to housing tribunal and you will get full amount.

yes.... same case as me.... i just called the developer... they also asked me to write in for the LAD claim then they will submit to the management to decide... so what should we put in the letter in order to (sure will) get the LAD....

my vp and the architect cert also 17 july... i believe is all 2nd batch....

same case.. wait the bank release the 17.5% to them .. then we only can get the key..., i have to pay RM1059 in order to get the key... must in cash or bank draft....

they also told me that same old story... 2 weeks later the CF will issue...... hope is true....

your LAD will calculate from the days late until the vp letter date.

meaning : if snp due on 15/4/09, then you receive vp letter dated 17/7/09, your LAD will be from 16/4/09 to 17/7/09 = Apr 15 days, may 31 days, june 30 days, july 17 days = 93 days

what you need to do before you make appointment to collect the key:-
1. check with architect & mps to verify on vp whether is valid

2. check with your bank whether developer has claimed them, if yes, whether bank has released, developer will not let you have your key before bank release

3. after bank released, you can proceed to developer office to make appt to collect key

4. the vp letter normally will attach the summary statement to notify you how much you need to settle with misc pyt, progress pyt etc.

5. for progress pyt, if you have bank loan, then have to wait till bank release, if you are cash buyer, you need to settle it

6. for misc. pyt, normally is quit rent, assessment, fire insurance, maintenance, sinking fund, late payment interest, security depost etc.
7. for quit rent, assessment, fire insurance, check with developer how they calculate and get a copy of the receipt to make sure they are not overcharging you

8. for maintenance and sinking fund and deposit, if developer req you to settle one yr in advance and free 12 months, then you check with them when is the date you need to pay for maintenance after you paid this 12 mths? get confirmation letter from them coz they told you first yr is borne by developer, what you pay now is for 2nd yr maintenance. meaning you only need to pay again on 3rd yr.

Added on July 21, 2009, 2:00 pm9. late payment interest is d tricky one, this interest charge due to you/your end financier late release to developer. d late payment interest statement will attached together with vp letter, study them, after that call to relevant party to verify whose fault to cause the delay of release? lawyer? bank? developer? or yourself? if you want to dispute this claim, you need to do up the chronology and write to developer

10. if you have LAD to claim this developer, write in to them on your claim, req them to contra the LAD with your misc pyt, any excess req them to pay you $. your LAd not enough to cover the misc pyt, of coz you need to top up. DO NOT FORGET to get a copy of Credit Note from developer for this contra. in case later, they come back to you and chase you for the payment eventhough you have contra.

11. after all the hassle, congratulations! you are able to collect your key now. but this does not give you the authority to move in or renovate your house. you can check your house and submit the defect list. move in & renovate still need cf.

12. the warranty period is 18 mths from 14 days of the letter, meaning you receive letter dated 17th, on 31th whether you collected your key or not the warranty period starts and end on 31/1/2011.

13. the maintenance will start to run as warranty period. 31th whether ppl move in or not, maintenance will start charging.

14. Aug - Dec 09 = 5 mths, Jan -july 2010= 7 mths, your free maintenance period should end on 31/7/2010

15. then from 1/8/2010 onwards, the payment you paid now starts running, 1/8/2010 to 31/7/2011 = 12 months.(paid by you now)

16. 1/8/2011 you start to pay for further maintenance already.

anything not clear? post in your question, i will try my best to advise you or assist you on your doubt.
