last weekend i just got a saman at police roadblock because i was looking at my phone while driving, so the police issued me a saman, but it doens't state the amount, then at the bottom there is a remark, 'Kesalahan ini boleh/tidak boleh dikompaun', 'This offense is compoundable/not compoundable'

and i need to attend court at PJ on 30 Nov, is there anyway to settle this without going to court? and what's the fine amount?

cannot settle. you have to attend court.
Judge will decide how much is the fine.

I heard if cannot compound means go court rd. If they say you must go, then you must go

usually how much is the fine? if court is minimum 1k?

what's the process for that? and how much for the fine?

when i ask the police that give me saman whether this saman can be pay or not he say can, then when i get the saman the paper there write non-compoundable :x

Just go court or send rep, tell them
u wrong and ready to pay fine. Lawyer not necessary.

I dont think they will issue a summon if you were looking at the phone. Unless while driving you are holding the phone or texting.

Mate I wonder what will happen if the person "tak mengaku" lets take TS case, if the really wasnt holding the phone and was just looking. He can say tak mengaku guna phone semasa memandu and provide his explanation right. so would the case be moved to another day for hearing/?

I not sure, since i really talking phone. Maybe attn another court?

Anyway usually police will not do that because its just wasting time they rather find guilty ppl atleast some willing to give them kopi.

And if u go court u dare to lie? Even if u dare im sure judge will believe police word than yours.

All Im saying the police might have misinterpreted that you are using the phone, using TS example where he said he was just looking at the phone and a summon had been issued. So what happens then?

Well how do u look at phone when u are driving?
The term "using phone" is a loose term to describe holding phone regard less whether u are making calls, sms, FBing or whatever. As long as phone in hand is wrong.

If u say use Waze then should use holder and not holding phone.

Maybe I was not clear, when i mentioned look, meaning the phone was in the holder and you were looking at it; not holding on the hand. Definately holding on hand is no-no, anyone doesnt know that, better gantung lesen...hahaha

its very obvious difference looking at phone on the holder vs holding phone or talking on phone.

If you have a passenger to support your not guilty plea, then fight till the end and provided your passenger is willing to go with you to court everytime. Otherwise, the benefit of doubt is given to the enforcer.

In any court cases, witness or evidence is paramount.

Using phone while driving is usually a compoundable offense. Why not go to the traffic police station and enquire?
