Mate I wonder what will happen if the person "tak mengaku" lets take TS case, if the really wasnt holding the phone and was just looking. He can say tak mengaku guna phone semasa memandu and provide his explanation right. so would the case be moved to another day for hearing/?

All Im saying the police might have misinterpreted that you are using the phone, using TS example where he said he was just looking at the phone and a summon had been issued. So what happens then?

Anyway usually police will not do that because its just wasting time they rather find guilty ppl atleast some willing to give them kopi.

Well how do u look at phone when u are driving?
The term "using phone" is a loose term to describe holding phone regard less whether u are making calls, sms, FBing or whatever. As long as phone in hand is wrong.

If u say use Waze then should use holder and not holding phone.

Maybe I was not clear, when i mentioned look, meaning the phone was in the holder and you were looking at it; not holding on the hand. Definately holding on hand is no-no, anyone doesnt know that, better gantung lesen...hahaha
