How to settle non-compoundable saman by PDRM

I dont think they will issue a summon if you were looking at the phone. Unless while driving you are holding the phone or texting. |

All Im saying the police might have misinterpreted that you are using the phone, using TS example where he said he was just looking at the phone and a summon had been issued. So what happens then?
