TS already mentioned that he tagged him on Twitter. hmm.gif

The time for reply is usually 3-5 working days, also time zone.

He can always follow up if he did not get reply after 1 or 2 days, to copyright strike people just because he does not get immediate reply is just crazy.

Fan art are allowed as long as it is not monetized unless the IP owner deemed it damaging to their IP, the same goes on the opposite as well when the IP owner want to use the fan art. If it is for profit, IP owner usually ask for a commissioned work because no one wants bad publicity and it is a good way to maintain a good relationship with the community.
*
In the end, if it's a question of whether the artist owns the art, I would have to say yes he does. If it's a question of whether he can claim copystrike for it, that's up to YouTube, not the courts.

So, on what grounds does he have to sue TS when what he really needed to do is appeal to YouTube?
It's Youtube that took down his video. Are you so stupid that you are seriously going to argue that TS has power to instruct YouTube to take down videos?
*
Because his income were effected by TS retarded action? His video got taken down, and his channel is on the risk of getting terminated?
'TS caused a monetary damage to my income with his retarded copy right claim etc' something like that.

Also YouTube is 100% on the copy right claim side, and the burden of proof to prove other wise is on the youtuber who got striked.
It is an automatic process (except on the more notable channel where it was manually reviewed).
Which is why every single fucking creator out there shat on youtube for this.

The 1 thing
We all were wrong is:

Has nothing to do with bandai.

The art is base on pokemane and itsagundum youtuber.

We all thought is gundum itself.

Youtube did the review on striking take down.
Ts can claim then jeremy get yellow stop getting monenitize only.
But youtube responsible for taking down the video.

I dont believe jeremy cause he had many pass shady drama that revolt around him for harassing.

If jeremy is innocent he can appeal lol.
Nobody is safe from strike.
Ts is giving him the chance get big.

Now its upto itsagundum defend ts or not cause he also a drama channel and the ip belong to him.

Youtube only provide the tools to make the claim, they do not uphold or dismiss the claim. You make a claim they take it down, that is all.

The copyright claim can be disputed by the channel owner which by then the claimer will have to file a case in court or release the claim.

I don't even know why you arguing fair use when the YouTuber knows that he shouldn't use fan art without permission.

I'm pretty sure that you can dispute a claim on YouTube without going to court. The only reason for going to court is just to harrass the other person.

Youtube will take down the video regardless if there is a copyright claim on it, that is why they are given the safe harbor status by the government. And believe me when I say he will be disputing the claim especially when it is clear cut case like this, he does have a lawyer that advise him on this kind of thing.

What happened in the past has no relation to this claim and even that was debatable.

It have everything do to Bandai. TS is claiming that the depiction of a gundam head is his.
Even ItsAGundam himself never claimed copyright to his mascot, or even his channel name.
Said Gundam head is a copyrighted materials, and any similarity to its is considered as plagiarism.

The fact that you said the art is 'based' on certain likeness or IP is by itself an admission that its a plagiarism under the protection of fan-art.

Youtube rarely does any human review of a strike, they only did it for selective channel. It is almost always automatic.

That's what he said

Ts copy strike utuber
Utuber fight the claim

If able to prove, utuber can go on a normal

Then TS need go court to further the claim, if not the claim is null and voided

The claimer can either release the claim if they don't want to file a case or let the claim expires, either way TS gets nothing except notoriety for being a false copyright claimer.

There is nothing wrong with TS making a copyright claim cause like I said, the artist owns the art. If YouTube has a different view, then they need to change their terms and condition.

Do you understand what civil suit is?

Yes, it is generally nice to ask for a permission, but that's it.
