Everything you said is irrelevant. The case you mentioned has a youtuber suing another YouTube directly which is very different from a copyright strike from YouTube. Even if he sued TS, no courts in the world can force YouTube to remove the strike.

ComicCon in 2015 I think have a panel revolving around this fan-art, artist alley and suff.
Its basically boil down to no, these fan-art is illegal and selling them on the con itself is super illegal.

But its still generally safe to do these fan-art and selling it in a small quantity because of a mutual understanding between the community and the company.
As long as neither of them cross the line everybody is happy doing their own thing.

This is the line that TS have crossed. The risk of getting sued went from nonexistent, to I-hope-to-god-they-doesn't-do-shit.
TS need to quit while its still cold, quickly.

I guess it's a debatable area but I believe that in general, the artist will always own the art even if they don't own the IP cause if the artist doesn't own the art, does that mean that the IP owners can use fan arts for profit however they like?

He doesn't sue TS for copyright, he is suing TS for wrongfully taking down his vid under false copy right claim.
That is the ground that H3H3 used to sue Matt where Matt took down H3H3 video under copy right claim which ended up being wrong.
H3H3 never claimed the material they used in their vid is theirs at all.

Fan art are allowed as long as it is not monetized unless the IP owner deemed it damaging to their IP, the same goes on the opposite as well when the IP owner want to use the fan art. If it is for profit, IP owner usually ask for a commissioned work because no one wants bad publicity and it is a good way to maintain a good relationship with the community.
