Regarding the hard copies document that need to keep for 7 years, I am a bit struggle with the receipt that I keep especially for book. Even the printed receipt by Popular, it will going to fade off, after 2 or 3 years, look back at the receipt, it is just a blank paper. Started last year, I hv started to photocopy the receipt and keep together, but I am not sure whether the photocopy can be accept by LHDN, since the original copy is already fade off. Anyone hv the same issue??

Officially is 7 years. But if due to some legal issues, court/officials may request for documents or proof. There are on-going court cases that is requesting for 1980's income tax returns.
Therefore, my advise is not to throw away the docs, but keep forever.

Yes, whatever needs to pay or claim back, still need to pay or claim back. What I am saying above is for the penalty or fine only, whether can waive.

I think for business really needs to to keep, as for individual without business income, can keep for 7 years only.
Don't scare on this, I only keep for 6 years sweat.gif
Penalty usually can, unless it is big amount and they find out you do it with intention.

Mine faded within a year doh.gif
They won't really check on you, unless you are blacklisted.
Just make sure you don't simply claim or do mistakes. And if you are "clean", thy won't check your past records thumbup.gif
Last time I do made mistakes on claim wrongly. Slow talk with them and I have to pay that difference. But then for the next 2-3 years they may check your hard copy records which happened to me once on 3rd year.
BTW, they will randomly check only, not necessary you will be that lucky one laugh.gif

Go ahead to claim it and pray hard that you're not picked for audit.

Best Practice
1. Photocopy the original receipt
2. Keep both original (even it's faded to blank paper) & photocopy receipt for 7 years

When IRB audits your tax file, show them both items in (2).

Guys, I understand that company handphone and petrol allowance are exempted from tax.

But where do I key in those amount in the BE form? Should I just deduct straight from my statutory income?

The section G in my EA form is empty, but I have a letter from HR stating that xxx amount of allowance money was for company usage. Can I deduct this amount from my total amount in EA form?

There are several ways to do it, if just 1-2 years, normally will just lump up all the gross income into "Pendapatan Tahun Kebelakang ..."

But in your case ... 2009 - 2013 are 5 years to assess.
What to do:
1) Bring all documents, receipts, EA form, PCB, etc. to LHDN
2) Ask to speak to officer, get number.
3) They will give you 5x same BE or B form, and use pen to struck out the YA2013 and write each year.
4) So you will fill up year by year, i.e. do filing for 5 years.
5) So, the PCB whether is extra or not enough, is calculated yearly.
6) Then summarize up all, whether there is balance or need to pay.
7) This whole thing may take up several tries/trip to LHDN, or may email/call the office involved.
8) Keep all the forms and docs forever.

If they penalise you for late or no submission, ask for leniency or waive (talk nicely, you know govt dept).
If still need to pay, just pay. Nothing much can do, unless you go legal/court/challenge LHDN.
Remember, there are two things in life that can't avoid: death and tax.

Even though it is messy now, if you don't sort it out now, in future, it is even more messy. And you still need to sort it out.

No need to deduct or key in anywhere in the BE form.

Make sure that your HR put that amount into the Section G of the EA form under tax exempted BIK.

Does that amount appear in the Section B of the EA form? If yes, you should ask your HR to correct the EA form.

Any amount appears in the Section B are taxable.

If no amount at Section B, just ignore it.

Hi guys,

On the e-BE 2013 form:

1) What scheme can be considered for deduction for:
Skim Persaraan Swasta Dan Anuiti Tertunda section?

2) Below the deduction section, there is Rebat / Tolakan Cukai / Pelepasan Cukai section that states:

Zakat and fitrah

Tolakan cukai seksyen 51 Akta Kewangan 2007 (dividen)
Tax deduction under section 51 of Finance Act 2007 (dividends)

Tolakan cukai seksyen 110 (lain-lain)
Section 110 tax deduction (others)

Pelepasan cukai seksyen 132 dan 133
Section 132 and 133 tax relief

I know zakat and fitrah, but what is tax deduction under section 51, 110, 132 n 133 tax relief?

Thanks for help!

I've been doing this for 4 years, never have problem, books, sports equipment is used to "balance" my tax return, such that I pay them some extra or they pay me back some.
But make sure you don't claim maximum on them.

I really hope you won't call for the audit.

We don't encourage stoppy to do that.

Of course, the final decision is still on you.

LHDN is very strict this year.
