I did not said simply claim. I just said there is no harm to claim from LHDN if we donated to the approved charity channel.

That's why my donation receipt there is a clause "Dikecualikan Cukai Pendapatan Menarat Sek 44(6)" clause.

What I stated there is clear enough. I was replying to someone suggestion not to claim for tax rebate for donation since we did it on good faith to the god.

Hi!,

I was at the LHDN yesterday & made enquiries with the Tax Officer on 2 items:-

1. Tax Relief for "Purchase of Sports Equipment"
--------------------------------------------------------
I asked the officer whether the Ogawa ezTone can be claim for Tax Relief. He wasn't sure so he called his boss & CONFIRMED that can be claim.

My worry is if I claimed for Tax Relief BUT after a few year they may reject & impose a penalty of 45%.


2. Tax Relief for "Medical expenses for serious illness (incl. full medical examinations up to RM500) for spouse.

My wife (full-time housewife) was admitted to hospital for "acute gastritis".
Expenses incurred incl. medical examinations (imaging, X-ray & laboratory tests) plus treatment/procedure/wad.

Question:
Can I claim for the TOTAL EXPENSES incurred? If NO, then can I claim just for the medical examinations (imaging, X-ray & laboratory tests) COST which is subjected to a max. of RM500. I did not claim the medical examination for myself so the RM500 relief is still unused.


I have made "online" enquiry via LHDN website becos' I need a black & white answer from them before I claim for the Tax Reliefs. Worry that they may change their mind on the intepretations & impose a penalty on me at a later date.

Any comments will be appreciated. Thanks!

Of course it's an annual income. If that amount is the monthly income and not subjected to tax, I believe every citizen will be extremely happy of it.

So, in my case, kinda rugi as I am deducting my EPF.

So, if I may say so,
for better tax planning, I would have to encourage my employer to deduct my monthly salary towards my EPF, right?

Thanks for your suggestions.

Anyway, I just received a call from JHDN regarding my email enquiries and they CONFIRMED that the Ogawa ezTone is claimable as for Tax Relief under "Purchase of Sports Equipment".

As for the medical expenses, they do not consider it as "serious illness", BUT I am allow to claim Tax Relief for just the medical examination only, subjected to a max. of RM500.

EPF relief together with life insurance policy is RM 6k max.

This you no need to worry too much about.
If say you are paying tax at 20% rate for that year. And you "claimed" rm300 of tax relief.
When they found out that you are not entitled for that, they will send you a letter and ask you to clarify. And if they concluded that you can't get relief, you only need to pay rm60.
Remember, get any official letter from LHDN, don't ignore it and settle it ASAP.
But once you have this problem, you will be "black listed" for 1-2 years. They will keep on looking on your records to see is there any "mistakes" done or not.
I made "mistakes" few times already and I never asked to pay penalty.

Just clarify with your church. If I'm not mistaken, they have to be registered with the gov to be able to be tax deductible or something. Those famous NFP organizations usually will advertise donating to them is tax deductible and they will issue us a receipt clearly saying "For tax purposes".  laugh.gif
