Yeah you SHOULD inform and get buyer's consent before selling the item to buyer in this case.

It's like if Nike and another China brand get their shoes manufactured from the same manufacturer. You said you are selling Nike, and you charge me Nike price, but when I get the shoes, I get some random China brand shoes and you said you are right to do so because it came from the same manufacturer and it's the same product, just different brand.

u shuld hav stated "this item comes wif different branding logo due to different telco operators using the same modem for their telco services" , n list down the list of brands for example, vodafone, smartone, maxis, celcom etc instead of just "operator logo might vary"

alot of ppl duno dis OEM thing wan, u hav to explain properly, even though its the same thing wif diferent branding logo, come frm the same manufacturer but not everyone is aware of this

your statement above only cover you on different LOGO e.g. Maxis, Celcom, Digi or whatever that may be printed on the modem. However, it totally does not cover different DESIGN/APPEARANCE, COLOUR. I strongly believe TS has a valid case against you as what he's complaining is the totally different design/appearance.

you need to rephrase your DISCLAIMER statement in order to avoid such dispute in future.

I did not read all pages, but few pages. I believe that seller did not purposely doing it to scam others, just that the disclaimer statement are not cleared enough for buyer to understand fully. I really hope that both buyer/seller would solve this issue with win win situation.

As I can see seller did mentioned "refund" earlier, hope this will help out buyer being feels cheated.

As for cases like this if buyer truly don't likes my items and feels that they being cheated from me provided with acceptable reason, I will refund for my customer and I will pay for the postage fees as my loss.

its kinda stupid that it reaches 9 pages for such a trivial issue. At first i thought that it was 2 different model, but it turn out to be same model just different telco logo or at worse 2 different casing. Its not like paying for Porche and getting a Myvi. And its a bit retarded to compare it with a car even so.

If its already confirmed that its a same model just cosmetically different, then just accept it, as Seller already mention that it might be different operator logo. Unless thats really important to the buyers to have the exactly the same, then just accept the Seller offer for refund.

If i were the Seller, I would gladly refund it as to save this kind of trouble from immature kids.

if got disclaimer when buy car say the actual color may vary from photo. but buy red came out yellow. still same car. then how?

as long as the base 3g base band can run both, then its ok. i bought a 4g broadband with only 2100 mhz 3g band, my area kampung area can only run 900 mhz, now laying at a side, not from this seller thou.

E398 run better than e372, stronger reception and faster, but 2100mhz only sweat.gif
