Is it better to set up an LLP or Sdn Bhd for my current case?

Since your turnover is quite huge. It is advisable for you to get a qualified tax account.

Dear Sifus...

I have resigned from my permanent position this year and become a consultant with the company.

Every month I receive about 10k as salary. I only paid zakat pendapatan through online every month. No contribution at all to EPF this year.

I did setup a company under my name as long term strategy,

Any advise how should best declared my income for the year 2013 ? And may save some $$$ in the tax contribution.

your company should have a breakdown of all the salary they paid you
best u declare as how much they pay u i guess

unless u r treating as business purpose then there are deductable exp that u can use to your advantage to reduce tax

What I know that every month I will receive 10k in my bank account. The also provide me with salary slip but only one line mentioned 10k salary without any deduction. When I was permanent staff there were few deduction mentioned in the salary slip like Zakat Pendapatan, EPF, SOCSO & PCB....

how should i declare my income as i 'm a full time employee
and doin some freelance work
filed under other income?
If i received bank transfer of RM500
should i deduct all the meal n expenses cover before declare?

Hi guys, dunno should i ask here or not but need some advice. Recently my dad receive a warning letter regarding income tax due around rm 1.6k from hasil.gov haven't paid for year 2000~2006. We were shocked because during those year, his salary not even reach rm2k. So he went and ask today, and they said it was for year 1987~1990 when he still own a medicine store before it went bankrupt. I think he didn't declare salary at that time because I doubt he know he need to declare it since the store actually belong to my grandfather, but register under my dad's name. So should he pay for it since already pass more than 20 years? Or is there any other method to settle this since the store went bankrupt?

Your father need to discuss with the Tax Officer and ask for leniency (or waive). Paying taxes is a must

SME tax rate is flat 20% (up to 500k profit) compare to individual schedule up to 26%.

eg. 100k profit for SME = 20k
100k profit for enterprise = 14k ish~~

and for your info, changing into sdn bhd is never gonna save you anything. with accounting, audit, tax agent, and company sec fee judging from your turnover rate can easily hit 5k~10k + - sdn bhd is when u wanna expand, not when u wanna save cost or tax planning.

Recently I went to Tax Office to appeal to LHDN to either waive or reduce the penalty impose due to the late submission of the tax form in year 2013.

To my surprise, instead of entertained what I requested, the Tax Dept actually digged out my tax records ways back to 1995 etc and charging me additional penalties related to the 1995 to 1997 submissions..... mad.gif

What should I do...thinking to ignore their additional penalties as I think it is very unreasonable for them..in the letter they said will take legal action if I failed to settle the penalty.

Any external parties such as Tax lawyer or accountant who can help me?

I thought we only need to retain 7 years records / receipts for income tax purpose. 1995 is more than 7 years back! doh.gif Is yours corporate tax or individual tax?

Yeah, experts, pls advise. I wanna know too.

I also would like to know if the children who get inheritance from of a deceased person need to pay tax for revenue earned by the latter ( if lhdn discovered it's unpaid).

I am working in an audit/tax firm right now for my internship program and man, there were lots of people who
faced the same situation like you do.

They came to the office bringing a letter from LHDN, demanding them to pay the fines. Some even had multiple fines.

Even the dead wasnt spared.

Income tax department no money these days?

Individual tax. I worked for people.

Actually, I didn't expect them to waive my penalty 100% for late submission, but hopefully they can reduce it since it was only few days delay....end up paying more tax.... doh.gif

I will ignore the LHDN notices until they take further action at this moment....don't care what the hack is their tindakan mahkamah...also no time to visit their office + it is dreadful experience to meet up their #$%&*~~ tax consultant.

Anyone has experiences ingoring the LHDN penalties? What are they going to do with us? Really bring us to the court?

How much the small audit/ tax firm will charge to handle the minor individual tax dispute case like mine?

The firm settle the case for us or just give us the advise?
