Details of the complaint : Selling faulty set and denied warranty offered.



As per title, on 18th July 2009, I bought 2 sets of NDSL Bundle set from this seller.
We contacted via mobile, i asked for black and silver set. Then we do COD at kuchai lama.
30mins before COD, he msg me and tell me he don't have black set, and tell me he'll give me silver and red. So i agree with him and take it.
Then he gave me Guitar Hero set and Super Mario set. It was at night and i didn't get to see it clearly, he just give it to me and ask me to pay.
The mario set, its not really mario set. Its just a normal red NDSL console. Which means, he has changed the console and trying to charged me another rm100 for that. But i don't care because I didn't mean to get red 1.

Problems start after a month of usage.
The buttons are very loose, flash cards doesn't works properly.
So i contact him, whether can i fix it. He say for flash card, he will send me the software and ask me reformat it myself.
Then, for buttons there are not warranty.
I asked him why, and he say there's only 3 months warranty and it's already over.
But that time is only September.
So, I got another seller to fix it.
Then for some reasons, i sold that console.

Few weeks later, my friend told me that her set is mulfuntioning. It can't be charged and can't be start.
I gave her my charger to test, but its still not working. And she purposely get another charger to test it.
So, I gave her Top Games contact details and ask her to complain herself.
He told my friend warranty over, but he can help her to fix but will charge her.

But the main problem here is that when we buy, he told me that there'll be 1 year warranty applied.

So, we argued with him. And since I deal with him on9, I decided to post it up at his thread.
Not even within 24hrs after i posted the comment, he called me and scolded me bad words and saying them i trying to ruin his reputation.
I told him that since he sold faulty set to me, he's suppose to compensate.
He say no such thing. Is either I send this set back to him or act nothing happen.
I want a compensation from him or I'll send it to other shop to repair and he has to pay for it.
He say I'm a cheater and trying to cheat his money. Then tell me his father is police, mother is lawyer and trying to bullshit that his family is very powerful people.
Think about it, if your family is so great, why are you selling faulty sets of consoles. In other way, trying to cheat money.

I was busy last 2 month, and i didn't get to post this up.
Now that I'm free and my friend keep complaining, I decided to post it up and get back what i deserve! And the total amount I've lost!!!!

Now I've no proof..

when she buy the ds lite. i told her just got silver, then she say ok. when i pass to her. after she check she nvr say any thing. after few day, she sms me say the ds lite silver very ugly and wan to change other colour.

before she buy, i told her the ds lite is 1 year service warranty and 1 month full warranty. but she just think 1 year full warranty.
another set ds lite, she help her fren to buy it. buy at july, september her fren call me, that ds llite got problem, then i told her bring it come to my shop repair it, we just charge the part and free labour. at the time her fren say ok, but she not come. after few month, kelly post to complain me , dont wan to repair her fren ds lite. oh my god, i call her to bring it come, but she dint do it. NOW, make a complaint again. Really dont know wat u wan.
i just wan to settle the problem, but KELLY just wan to make problem.

i feel for u, but reading cases frm both sides, u all shud settle in a proper manner, not talk on phone to each other throwing vulgarities and creating nuiscance, one is a customer, another is a consumer provider, i always say , a business done right, is a business where both consumer and buyer are happy and satisfied. I may not know the whole story, but if the case of u calling a throwing insults and vulgars, u are at fault over there, if she misunderstood what you say and delayed the repairing/didnt bring back within warranty period , in that case, she should have been more meticulous. nevertheless, the best thing to do Top Games, to settle like this, i suggest just repair for her and next time, prepare the disclaimer notice at ur receipts to avoid future problems like this

not fake set. that is new set. u buy ori hp or anything, sometime after u use few month the item got problem, that mean all of the ori item is fake? we will do our the best service for customer, but sometime will face the type of customer like KELLY. so unlucky.

Either one of you is lying. From the images kelly posted it's obvious the NDSL is fake.

The seller called kyoyagami, who's selling official Nintendo products in Malaysia, also confirmed it's a fake NDSL.. hope Top Games can explain what's going on

If i were her, i don't dare to go to your shop and i don't even wish to see your again.
Your way of posting is rude and guess your style of talking on the phone to her is the same.

From the beginning seller never deny he's selling fake NDSL.. There's 3 possibilities in this case:

1. kelly is lying
2. TG selling fake NDSL
3. TG selling recon NDSL (with buttons and casing replaced) and claimed it as new

I honestly trust kelly more though, since she just realized the something wrong with the NDSL which has nothing to do with normal original NDSL hardware failure.

TS, do u have the receipt with you? I though your receipt already taken by them then how u prove that u buy the nds from them when you report police? Any top game sticker on the nds? That why top game ask u to report police because they already take your receipt.

from what i see,both of u got 'things' that couldnt be agreed upon (as stated by gundamalpha on seller's thread)

then maybe the NDS u sold to kelly got mix up with a refurbished set. as she posted the image of NDS, its clearly not original NDS.

if cannot resolve here and need third part help then go for Tribunal.

That is the best way to resolve problems like this.

If buyer is so sure she got a fake unit or deserve a new set of NDS or got conned by TS then go tribunal.
If seller is so sure he did not do anything wrong or did not sell fake NDS then to report in tribunal and set a hearing date.

Let the tribunal decide who is right.

He didn't promise me to fix it for free. He's going to charge me rm120.
That's the lady shopkeeper told me. And at that moment, its still under warranty.
His konon 3 mths warranty.

The main purpose i post this thread up, is to make him apologize and compensate our lost.
Not to make thing worst.

But the fact that he's trying to escape and not explaining the truth.
gundamalpha and viledante have been proving that the set he sold to me is not brand new set from nintendo.
And he keep avoiding answering questions....

Getting it clear, 1 year warranty or 3 months warranty is still valid when the console has problem.
But you're trying to charge me to get it fixed.

Yet, recently you're being unlucky that i found out that the console you sold ain't original.
You might think that i'm troublesome, that's because I just get to know how to identify original, fake or refurbished set of NDS.
You are trying to ruin my image, but unfortunately, you failed. I've evidence to prove that you sell fake or refurbishes consoles.

If Topgames really innocence just fix it for her. Customer is always right. Usually ppl keep avoid avoid they try hide something if u fix for her RM120 will your shop over night close down?

It's normal for customers to post in your existing thread about your conduct of sales, and any negative comments will surely bring a shadow of doubt to your sincerity.
Regardless of what it is, damage has been done.

To make things simple, if you are still reading this.

Kelly and other forumers including me have been pondering upon the handheld's authenticity.
Please do clarify that, if the handheld is BRAND NEW, or RECON.

i do hope mod will create a dispute tag for topgames at the moment since pics on the fake nds provided can tell thousand of words. topgames will need to work this out and clears everything.

If cannot settle, just bring it up to tribunal..

thats the easiest way to solve this problem..hassle free!!

btw, nex time jus buy console from other reliable shop..

i got the warranty card when buying my NDS, tho its a bit diff cause mine is japanese version =/

The serial number on the box and console must match if it's a first hand/non-opened box. If the serial number does not match to the box then it's very likely the console has been switched with another prior to the transaction between you and TopGames.

probably a print screen of what he wrote can help a bit coz that is a confession that he did sell it to Kelly

After reading this thread here is my opinion of what happen.

1. kelly wants to buy NDSL and found Top Games thread.
2. Top Games make a deal with kelly.
3. Top Games think that because kelly is a girl (no offence)she may not know how to identify between ori NDSL and fake NDSL.
4. Top Games make a call telling kelly that the color she wants no stock and sell here the fake red NDSL under the pretence of it being special edition.
5. kelly takes the bait and Top Games makes a 'GREAT' deal.
6. Then the story continues as what kelly told.
7. Top Games took to receipt to cover his behind.
8. Only after taking the receipt kelly found out it was fake but it was too late.
9. kelly complains but Top Games is in denial.

From what i think happen above. (Correct me if im wrong)

Top Games you should be ashame of yourself 'if' you are really selling fake stuff. Taking the receipt away from a buyer should never be practise.

On the other hand maybe Top Games were cheated by thier supplier so they can also be a victim in this case. (Thus not knowing the item was fake).

Either way kelly should be able to get her full refund back but without the receipt its going to be hard.

To all buyers out there make sure you never pass the receipt to seller even to look at cause they only have to see not to touch the receipt. If they want to make a remark on the receipt do it yourself and then show it the the seller that you already made the remark.

In this condition i say that the seller will be able to get away since the receipt is gone.

Top Games after reading your post i can see that your very arrogant. My advise is to fess up bout your mistakes and move on.

kelly i feel your lost but take this as a lesson to learn about a product your buying before buying it. There are so many fake things in this world and knowledge is the power to preventing yourself from buying them.

My new consoles have a warranty card. That filled in 1 year.

Better than none.

That's the reason i posted it up.
Enough of evidence to prove that he's selling fake or refurbished consoles.
Nevertheless, he's been disappearing in this post to face the truth.

When one did mistake, they will think of a way to cover it.
Taking over the receipt will somehow demolish the evidence that i actually bought it from him.
